Armed Suspect Shot at Capitol

A Capitol police officer shot and injured a man who brought a weapon into the U.S. Capitol Visitor Center Monday afternoon, the chief of Capitol Police said.

An officer fired after the man pointed what appeared to be a weapon at him, U.S. Capitol Police Chief Matthew Verderosa said. The man was wounded and was in surgery Monday afternoon at Washington Hospital Center, where he is listed in critical condition, according to hospital officials.

The U.S. Capitol Police Department said Larry R. Dawson, 66, of Antioch, Tennessee, has been charged with assault with a deadly weapon and assault on a police officer while armed. They said Dawson's vehicle was located near the Capitol and was secured at a separate location.

A female bystander received minor injuries and also was taken to a hospital.

"We believe that this is the act of a single person who has frequented the Capitol grounds before, and there is no reason to believe this is anything more than a criminal act," Verderosa said at a news conference.

The man went through a metal detector at the visitor center, an alarm went off and he pulled out the gun, two sources told News4's Shomari Stone.

"It appears the screening process worked as intended," Verderosa said, noting the suspect has not yet been charged. A weapon was recovered at the scene.

NBC News’ Pete Williams reported early Monday evening that the weapon was a pellet gun. Dawson was known to U.S. Capitol Police and was a frequent visitor, Williams reported.

Dawson is facing charges for allegedly standing up and shouting Bible verses in October 2015 in the House Chamber Gallery. According to court documents from the Superior Court for the District of Columbia, Dawson identified himself as a “Prophet of God” to the people in the gallery.

According to the documents, Dawson was removed from gallery and, while being removed from the building, pushed a police officer and began to run. He was caught and charged with assault on a police officer.

A Stay Away Order was issued to Dawson, including a map of the area he was supposed to avoid, which included the U.S. Capitol building and grounds, including all Congressional buildings.

The U.S. Capitol complex was locked down about 3 p.m. The shelter-in-place order was lifted at 3:45 p.m., but the Capitol was open only for official business. The visitor center remained closed.

At first, anyone outside was advised to seek cover immediately, U.S. Capitol police said. The D.C. Police Department later said in an update that there had been an isolated incident and there was no threat to the public.

Visitors were turned away from the Capitol as emergency vehicles flooded the street and the plaza on the building's eastern side. Police, some carrying long guns, cordoned off the streets immediately around the building, which were thick with tourists visiting for spring holidays and the Cherry Blossom Festival.

Initial reports by The Associated Press said a police officer sustained minor injuries. Sources told Williams and Stone that was not the case. Verderosa said no officers were injured.

The visitor center will be open as usual on Tuesday, Verderosa said.

Jill Epstein, executive director of the California Association of Marriage and Family Therapists, told NBC News she was at the visitor center on a lobbying trip to meet a senator when an active shooter was reported.

"I was with a group of my colleagues walking into the visitor center and as we were literally going through the metal detectors, people started screaming, 'Get out! Get out!' We didn't know which way to run. We ran out and and they told us to get against the wall so we were crouching against the wall outside the visitor center,” she said.

"Police appeared out of everywhere and they were screaming, 'Run for it! Run for it! Run up that ramp!' And we ran like you see in videos. It was surreal. It was so beautiful out and the cherry blossoms are in bloom and people are running for their lives. It was unsettling and scary," Epstein said.

The witness said one of her colleagues bolted for the door without his watch, wallet or phone, which were still on the conveyor belt of the metal detector.

It's the second time in less than a year that the U.S. Capitol was locked down due to a gun incident. Last April, a 22-year-old from Lincolnwood, Illinois, fatally shot himself on the building’s west front, triggering an hourslong lockdown.

A dental hygienist from Connecticut, Miriam Carey, 34, was shot and killed outside the Capitol Oct. 3, 2013, after police said she tried to ram a temporary security barrier outside the White House with her car and then struck a Secret Service uniformed division officer. She then fled the scene, leading police on a chase.

According to subsequent investigation by the News4 I-team, U.S. Capitol police stopped at least 13 people from carrying guns on or near Capitol grounds from 2012 to 2015.

On July 24, 1998, two U.S. Capitol Police officers were killed after a gunman stormed past a Capitol security checkpoint and opened fire. Officer Jacob J. Chestnut Jr. was fatally shot at the checkpoint, and a tourist was injured in the initial crossfire between the gunman and police. Detective John M. Gibson then told congressional aides to seek cover before exchanging gunfire with the shooter. Gibson was fatally wounded, but police say his actions allowed other officers to subdue the gunman.

Sometimes the people who help us out need our help. This is one of those times.

Kurt Nagel is a Marine Interdiction Agent who works with U.S. Customs and Border Protection. That basically means he patrols the waters off San Diego. He’s also a defensive back for the San Diego Enforcers.

If you’re unaware, the Enforcers are one of the most successful teams in the National Public Safety Football League. All the players are members of public safety entities. In their Salute To Service game on Saturday night against the U.S. Marine Corps, Nagel was severely injured on a play late in the fourth quarter.

Nagel suffered two broken vertebrae. He underwent surgery on Easter Sunday but had some complications that led to a fever. As of Monday afternoon Nagel was on a breathing tube and his prognosis is unknown.

Spring Cleaning? Try a Local Pawn Shop

Moris Adato says his pawn shop is a perfect place for people doing Spring cleaning around the house.

"We get it all the time," said Adato the owner of CashCo Pawn Shop. "We have people come in with carts of merchandise that they just want out of the house."

While pawn shops are know for short term loans, where people bring in a valuable item and use it as collateral, they also buy items directly from customers.

"The people selling are cleaning up," said Palace Pawn Shop owner Jeff Bernard. He says sometimes it's about downsizing, other times it's about clearing things out of the garage or bedroom.

The most popular items to sell are things like jewelry, power tools, high end electronics and musical instruments. But there's another reasons pawn shops are popular: both owners say they often benefit when there is a break up.

"Old boyfriend, husband stuff, wife stuff, they just want to get rid of and move on," said Moris Adato.

Jeff Bernard agrees: "The more personal jewelry, a wedding ring, a wedding band, a watch, something that has a significant tie to the other individual."

About 20 percent of the items coming into a pawn shop are from people looking to sell. Bernard says they could sell on eBay or Craigslist, but sometimes, that's too personal. This way, they can walk in with their items and walk out with the money.

Moris Adato says while 80 percent of their items are pawned, he says more than 90 percent of the loans are paid off and people get their item back.

"People are on such a tight edge financially," said Jeff Bernard. "that it doesn't take much to rock the boat and when the boat rocks we are there to help balance it."

'She's Family': Sailor Saves Stabbing Victims

Jacklyn Place, 30, was doing homework in her Oceanside home late one night last November when she heard screams coming from her neighbor’s house.

“The volume was escalating,” Place said. “That’s when I decided to go outside and noticed [my neighbor] was calling for me. As soon as I opened the door I saw her -- then a flash-- it was him running. She was screaming ‘he stabbed me,’ and as she turned I saw blood all the way down her back. I had a fight or flight second, and then went to work.”

Her neighbor, Jennifer Barela, was referring to her husband who had just viciously attacked her with a knife.

Place, a chief petty officer at Camp Pendleton and hospital corpsman, began assessing Barela’s condition. She also called another neighbor, Staff Sgt. Thomas McDonald with the 13th Marine Expeditionary Unit, instructing him to bring his first aid medical bag.

A third neighbor, Staff Sgt. Vincent Bryan, came upon the scene and called 911.

Place explained Barela’s radial artery (on the forearm) was severed.

“The cut was very, very deep,” she said. “By the time I got her to lie down and put a compression bandage on, the grandmother came up and was screaming that he was stabbing her granddaughter.”

Place then ran after the attacker to save Barela’s daughter.

“I was just thinking she was a baby and he was chasing her. It was awful,” said Place. “I think your mom instincts kick in. Her [mother’s] last words before she fell unconscious were ‘go get my baby’. I think anyone would have done the same thing. When I got there [her daughter] was almost unconscious. Her whole face was cut up.”

By the time Place got to Barela’s daughter another neighbor had restrained the attacker.

The 14-year-old girl was lying in a pool of blood with a severe chest wound. As the girl struggled to breathe, Place began to administer first aid.

With neighbors’ help she repositioned the girl to maintain her airway and instructed them to apply pressure to her stab wounds.

“Luckily I had a great team,” said Place. “It wouldn’t have happened without [the Marines]. That corpsman- Marine team was amazing. That dynamic is so sacred. We all knew what to do and worked off each other. If it wasn’t for them, I wouldn’t have been able to do what I did. They were calm, cool, and collected. I love our corpsman and Marine relationship.”

Both Barela and her daughter survived the attack and were home from the hospital within weeks.

“I’m indebted to her. She’s the reason why I have my daughter here still. She is family now,” said Barela. “All I can say is thank you and I love you, and if it wasn’t for you I wouldn’t have my daughter here. You know, you love your kids, but then you really realize how deeply you love your children when they are almost taken from you.”

Place was awarded an Impact Navy and Marine Corps Commendation Medal for her selfless and decisive actions. McDonald and Bryan were both also awarded Navy and Marine Corps Achievement Medals.

"I was surprisingly calm and I was just thinking back to the basics training wise, what's bleeding the worst, keeping the patient comfortable," Place told NBC 7.

She said that night her training kicked in but so did her motherly instincts.

"Now they're my family. Might as well be blood," she said.

Flames Shoot 40 Feet in El Cajon Rooftop Fire

A fire broke out on the rooftop of a home in El Cajon Monday night El Cajon police and Heartland Fire officials said.

The fire started at approximately 8:41 p.m. in the 1370 block of El Rey Avenue.

The Heartland Chief said the fire appears to have begun in the chimney then quickly spread to the shake shingle roof.

The man living in the house was able to get out on his own, but there were several obstacles
working against firefighters.

The narrow streets with cars parked on either side made maneuvering difficult. The heavy vegetation, limited space between homes, and high wind warnings made containing the fire difficult.

"Any type of wind event will create more issue from fire suppression due to fire travel. We were fortunate in this respect. Firefighters jumped on it quickly and protected the surrounding jurisdiction and contained the fire to the house of origin," Chief Rick Sitta of Heartland Fire said.

Crews said at one point flames shot 40 feet above the house, but they were able to contain the fire to just one house.

As of 9:18 p.m., no evacuations were issued, and there were no reported injuries.

A high wind warning is in effect for the desert areas east of San Diego with the possibility of wind gusts of up to 90 mph. The warning will be in effect from until 3 a.m. Tuesday, according to the National Weather Service.

A hijacker who diverted a commercial jet and took dozens of hostages was arrested and all of the passengers and crew had been safely freed, the Ministry of Foreign Affairs for Cyprus said in a tweet Tuesday.

The hijacker, who claimed to have an explosive belt, ordered the EgyptAir Flight MS181 to be diverted to either Turkey or Cyprus, according to officials. The plane was en route from the Egyptian city of Alexandria to Cairo and landed in the Cypriot port city of Larnaca where negotiations got underway, EgyptAir said.

The majority of the passengers were soon released. The hijacker spent the first three hours of the standoff demanding to speak to his Cypriot ex-wife or give her a letter, Cyprus government spokesman Nikos Christodoulides told NBC News.

The hijacker — who was identified by the Cyprus Ministry of Foreign Affairs as Seif Eldin Mustafa — then shifted his demands.

"He asked for asylum, he wanted to talk with someone from the European Union ... It seems that he was an unstable personality," the spokesman explained.

Sexual Harassment Training Takes Stage in Filner Trial

Closing arguments will be heard tomorrow morning in the trial of the civil case against the city of San Diego and its former Mayor, Bob Filner.

The suit was filed by Stacy McKenzie, a manager for the City Parks and Recreation department. She claims in April 2013, Filner grabbed her from behind at a parks event and touched her inappropriately.

Tuesday the defense wrapped up its side of the case. Jurors heard testimony Tuesday detailing a change made to the City of San Diego’s sexual harassment prevention training in the wake of allegations against the former mayor.

Former Director of Human Services Scott Chadwick testified that he personally informed Filner about taking the city’s sexual harassment prevention training within the first six months of his administration.

Chadwick said he followed up with Filner about the training and received no response.

Stacy McKenzie, a manager for the City Parks and Recreation department, claims that in April 2013, Filner grabbed her from behind and touched her inappropriately.

Chadwick testified he was called to a meeting with another city employee who had complained Filner belittled her, yelled at her, screamed at her and threatened to remove her from her position.

Under cross-examination, he was again asked about training.

“At that time, I did not realize the mayor had not taken sexual harassment training,” Chadwick said.

“The city really doesn’t have a procedure in place to determine if new employees take sexual harassment training,” he added.

Jurors also heard Filner never took the training, even though witnesses from the city’s Human Resources Department said they told him to take it. Judy Von Kalinowski testified the HR department was told the Mayor’s office would be the one to schedule the training, not anyone else.

Now the city does have a way to determine whether new employees took the training.

Illinois' Kirk Meets With Garland

Sen. Mark Kirk became the first Republican senator to meet with President Obama’s Supreme Court nominee Merrick Garland Tuesday afternoon in the Hart Senate Office Building in Washington, D.C.

Details remain scarce about the meeting between Kirk and Garland, which lasted just under a half hour. Prior to the meeting, Kirk addressed the press in his D.C. office.

The senator said he was leading by example by meeting with Garland, but also noted he hadn’t lobbied for other Republican senators to meet with the nominee. Kirk also said he would consider voting for Garland if the opportunity presented itself, NBC News' Alex Moe reports.

“We need open-minded, rational, responsible people to… make sure the process works,” Kirk told reporters in his Senate office prior to Tuesday’s meeting.

A group of senators, led by Senate Majority Leader Mitch McConnell, is looking to stifle Obama’s appointment by not holding confirmation hearings for the Chicago native.

Kirk tweeted a photo with Garland Tuesday captioned with a message to fellow Republican lawmakers.

“As the first #GOP Senator to meet with #MerrickGarland, I urge my colleagues in the #Senate to do the same,” Kirk wrote.

Earlier this month, Kirk called on fellow Republican legislators to “man up and cast a vote” on Garland. Two other Republican senators, Susan Collins of Maine and Jerry Moran of Kansas, have also called for a hearing for Garland in front of the Senate Judiciary Committee.

“We should go through the process the Constitution has already laid out,” Kirk said. “The president has already laid out a nominee who is from Chicagoland and for me, I’m open to see him, to talk to him, and ask him his views on the Constitution.”

Rep. Tammy Duckworth, the Democratic nominee in the race for Kirk’s Senate seat, addressed the meeting in a statement provided to Ward Room.

"Senator Kirk seems to expect extra credit for doing the bare minimum- in this case his job,” Duckworth spokesman Matt McGrath said in a statement. “While it’s nice that he’s meeting with Judge Garland, Kirk’s cynicism was revealed when he told a conservative talk radio host that he didn’t expect Mitch McConnell to allow the nomination to proceed, and he’s done absolutely nothing in the meantime that would make McConnell feel the least bit inconvenienced for his obstruction.”

"Instead of going through the motions, Senator Kirk should show leadership by putting pressure on McConnell and urge him to give an eminently qualified Illinois native a fair hearing followed by an up-or-down vote,” McGrath added.

In that release, McGrath alluded to statements Kirk made earlier this month on the Big john Howell Show.

“I think that given Mitch’s view, I don’t see his view changing too much,” Kirk said. “You know, eventually, we’ll have an election and we will have a new President. The new President will obviously come forward with a nomination. And that’s all for the politics of a new time.”

A vacancy on the country's highest court was left after Supreme Court Justice Antonin Scalia died in February.

Aztecs in NYC: Scouting The GW Colonials

$

0

NBC7’s Ben Rosehart provides a scouting report of San Diego State’s opponent - George Washington - in their NIT semifinal

Don’t know much about the George Washington Colonials? You’ve come to the right place.

The Colonials hail from the Atlantic-10 conference and are led by head coach Mike Lonergan who is in his 5th season with the team. GW went 11-7 in conference play and enters Tuesday 26-10 overall.

Lonergan has been coaching for 23 years - almost as long as Steve Fisher (25 seasons). So these guys know how to coach.

Tyler Cavanaugh leads the Colonials in scoring and averages 16.8 points per game. Much like Winston Shepard, he has raised his level of play in the NIT to 21.7 points per game.

He is shooting a sizzling 54 percent from the field and you better not leave him open from downtown either.

Cavanaugh nailed 8 of his 15 attempts from 3-point land in GW’s first 3 NIT games.

He is also hauling in more than 9 rebounds per contest in the tournament.

The other forward to keep an eye on is Kevin Larsen.

The senior stands 6-foot 10-inches and was 4th in the A-10 in rebounding so you know he cleans the glass.

Larsen is actually in the Top 10 of the school’s all-time rebounding list.

Translation: The Aztecs better box out on Larsen or they could be one-and-done on the offensive end.

Colonials senior Patricio Garino is also a streaky shooter from the outside.

Garino scores at a 16.7 point clip but more importantly led his entire conference in 3-point shooting and made 44 percent of his treys this season.

As Mark Jackson would say, "Hand Down?, Man Down!" against this sharpshooter. SDSU needs to identify the shooter every possession on the defensive end.

The Aztecs have won their first 3 NIT contests by an average of 18.3 points.

This is the first time SDSU has ever played GW in men’s basketball.

But even though the two schools have never met before on the hardwood, the Colonials do have history against Fisher.

GW made its deepest NCAA tournament run in 1993, reaching the Sweet 16 that year before losing to Fisher’s Michigan Wolverines 72-64.

If San Diego State can defend the perimeter and limit second-chance opportunities by minimizing the damage that Larsen can do on the boards, the Aztecs should be able to advance.

The winner of this NIT semifinal will face either BYU or Valparaiso Thursday evening for the NIT championship.

Suspected Human Smuggler Killed 2 Immigrants in Crash: Atty.

A suspected human smuggler appeared in federal court for the first time Tuesday, facing charges for a crash that killed two undocumented immigrants and left another brain dead, according to the U.S. Attorney's office.

Lydiana Castro, a 30-year-old U.S. citizen from Calexico, is facing one count of illegally transporting aliens, U.S. Attorney Laura Duffy said. At her Tuesday hearing, she chose to forgo a detention hearing and remain in custody, Duffy said.

Castro was arrested on March 23 near Andrade, Calif., Duffy said.

According to a federal complaint, a Border Patrol agent spotted several people running into a Dodge Durango stopped at a gas station at Sidewinder Road and Interstate 8. At the time, the Dodge was driven by Castro, the complaint alleges.

Castro later told a Homeland Security Investigations agent she picked up the undocumented immigrants at the gas station and started driving to Yuma, according to the complaint.

When an agent tried to pull the car over, it first slowed down and then sped off, according to the complaint. The complaint alleges Castro later told investigators she panicked and hit the gas pedal, not knowing what to do when agents signaled for her to pull over.

As Castro accelerated, she lost control of the car, crashing into a semi-truck going down Interstate 8, the complaint alleges. As a result, the car became entangled in the truck's frame, and the truck driver had to pull onto the shoulder, according to the complaint.

When BP agents approached the car, they found five undocumented Mexican nationals inside, the U.S. Attorney said. Two of the men in the car, Gustavo Sanchez-Orta and Jose Magdiel May-Gonzalez, were pronounced dead at the scene. Castro was taken to a Yuma hospital and the three remaining men were taken to a Phoenix hospital.

One of the undocumented immigrants is brain dead as a result of the crash, Assistant U.S. Attorney Kyle Martin told U.S. Magistrate Judge Peter Lewis in court Tuesday. Another man is paralyzed from the waist down and the third has been in and out of consciousness since the crash.

Castro could face 10 years in prison.

A status hearing is scheduled in El Centro federal court at 10 a.m. Friday.

Medics got quite a surprise during an emergency call in the Midway District Tuesday morning when a man jumped off the second-story of a hotel and onto the top of ambulance.

The San Diego Police Department (SDPD) said the bizarre incident happened around 5:30 a.m. at the Heritage Inn located at 3333 Channel Way.

Medics were called out to the hotel to treat a woman suspected of an overdose. When the ambulance arrived, police say a man jumped off the second floor of the building, landing on top of the ambulance. Police say the man claimed he did this to get the attention of the medics.

An altercation ensued between the man and the medics at the scene, and police officers were called. Minutes later, the incident was cleared up and everything was under control, police said.

No arrests were made.

An SDPD officer told NBC 7 the woman who prompted the medical call ultimately died, likely from an overdose. No one else was harmed.

No further details were immediately released.

Wells Fargo Bank to Pay $8.5M In Civil Complaint Settlement

Wells Fargo Bank will pay $8.5 million in a settlement reached with six California counties over the bank’s practices of recording phone conversations.

The settlement announced Tuesday was the result of a civil complaint filed against the bank for failing to timely and adequately disclose automatic recording of phone calls, according to a news release from the San Diego County District Attorney’s Office.

California law states that anyone on the line must be told a conversation is being recorded at the beginning of a phone call.

Wells Fargo has agreed to change its policies and pay civil penalties totaling $7.6 million. The company will also reimburse $384,000, the amount the counties spent investigating the issue.

San Diego County will receive one-sixth of the civil penalties or $1,269,333.33 and $64,000 of the costs, according to the DA’s office.

By law, those funds must be used for future consumer investigations.

Wells Fargo will also give $500,000 to two statewide consumer protection and privacy rights organizations, the DA’s office stated.

Fire Damages Pacific Beach Apartment Building

A man kicked in his neighbor's door to rescue pets after fire broke out Tuesday in a Pacific Beach apartment building.

San Diego Fire-Rescue crews were called to Figueroa Boulevard at 9:15 a.m.

The chaos was captured on mobile phone video by Trevor McManus who was just visiting the neighborhood. McManus saw the black smoke and went to warn people.

He said residents went door-to-door, knocking and yelling to neighbors to get out.

They knew one person wasn't home, but had dogs inside so they kicked open the door to let them out.

"It was kinda scary for a second, because it was white smoke then became darker and darker," said neighbor Ashley White. "Then a bunch of neighbors came out of nowhere, pounding on everyone's door and got the dogs out."

The fire department said the fire started in the laundry room. The exact cause is still being investigated.

Shortly after 10 a.m., residents were allowed to go back to their homes.

The apartment building is located west of Interstate 5 and south of Garnet Avenue.

GW Ends San Diego State’s Season

This was not how the Aztecs planned on finishing their season.

But unfortunately they cannot hit the reset button after a dismal showing against George Washington in the NIT semifinals.

San Diego State fell 65-46 Tuesday night and never really threatened to comeback in the second half. Seniors Angelo Chol, Winston Shepard and Skylar Spencer were taken out in the final minutes and given an ovation as they closed their playing careers at Madison Square Garden.

SDSU trailed by double digits for the majority of the game and was down by 15 at halftime.

Dakarai Allen led SDSU in scoring with 13 points but was the only player on the team in double figures. The Aztecs wound up shooting just 28.8 percent from the field and managed only 20 points by intermission.

SDSU’s shooting woes and GW’s ability to dominate the glass on the defensive end resulted in lots of frustrating single-shot possessions for the Aztecs.

The Colonials stayed in a zone for a large part of the second half after seeing SDSU struggle to shoot the ball.

Tyler Cavanaugh was a beast for GW and collected 20 points and 11 rebounds to pave the way for GW.

What was really disappointing was that the Aztecs struggled to come up with the loose balls.

Lots of those “coin-flip” plays seemed to go GW’s way.

San Diego State finished the season 26-10.

GW will face Valparaiso (coached by former NCAA Tournament darling Bryce Drew) Thursday night in the NIT championship game. Valpo defeated BYU 72-70 in the other NIT semifinal.

Trump Reneges From Pledge to Back GOP Nominee

Through all of the animosity within the GOP presidential race between Donald Trump and Ted Cruz, the two have always begrudgingly agreed on one thing: to support the GOP nominee no matter who would be representing the party come November.

At a CNN town hall event on Tuesday night Trump reversed on that promise, telling CNN moderator Anderson Cooper he no longer respects the so-called loyalty pledge a stage full of then-candidates agreed to during the very first GOP debate in Cleveland last August.

Cruz has been slowly backing away from the pledge and on Tuesday reiterated his hesitation, telling Cooper "I'm not in the habit of supporting someone who attacks my wife and attacks my family."

John Kasich gave a string of noncommittal responses. When pressed by Cooper about whether he'd respect the pledge, the Ohio governor said, "If the nominee is somebody that I think is really hurting the country and dividing the country, I can’t stand behind them.”
