Sochi Olympics: Let the Games Begin

After seven years of preparation, Sochi, Russia presents itself to the world Friday at the kick-off of the XXII Olympic Winter Games. The opening ceremony and lighting of the Olympic cauldron will mark the official start to what has already been a record-setting event.

Over the next 17 days, athletes from 88 nations--more than any other in the history of the Winter Games--will compete across 15 disciplines, including 12 events making their Olympic debut. 

While several events--figure skating, freestyle skiing and snowboarding--got an early start Thursday, the Games won't be fully underway until Saturday. Here's a glimpse at what's ahead:

COMPELLING STORIES
The pressure's on Shaun White: After dropping out of the new Olympic slopestyle event the day before its first qualifying run, America's most famous snowboarder is facing mounting pressure to defend his halfpipe title. 

Will the women's figure skating team shine again? Until the Vancouver Games, an American figure skater had made it to the Olympic podium in every women's singles event since 1968. This year, all eyes are on Gracie Gold, Ashley Wagner and 15-year-old Polina Edmunds as they attempt to restore glory to the U.S. women's team.

Women's ski jumping debuts: After years of pushing for the inclusion of women's ski jumping to the Olympic Games, its moment has finally arrived. Three women will compete for the U.S.: Jessica Jerome, Sarah Hendrickson and Lindsey Van, one of the leaders of a years-long battle to get the sport onto the most prestigious international stage. 

Glory for the host country: Viktor Ahn, a speed skater who has notched four medals for South Korea, now skates for Russia and could bring a victory to his new home team. Russia is also looking for historic golds from its hockey team, figure skater Yevgeny Plushenko and pairs Tatyana Volosozhar and Maksim Trankov.

"Cool Runnings" 2.0? Jamaica's bobsled team is back for its fifth appearance in the Winter Games and--as in the Disney movie inspired by the team's Oympic debut-- the team got off to a dubious start. After qualifying they lacked the funds to get both themselves and their equipment to Sochi, but managed to raise enough money at the 11th hour. Will they top their respectable 14th place performance at the 1994 Games?

Cross-overs: U.S. track and field stars and sumer Olympians Lolo Jones and Lauryn Williams trade in their shoes for bobsleds, with both Summer Olympians looking for their first winter medals. 

NOVELTY
New events, new formats: In addition to women's ski jumping, 12 new events have been added to the Olympic roster. They include team events in figure skating and luge, a biathlon relay, as well as men's and women's contests in halfpipe skiing, slopestyle skiing, slopestyle snowboarding and snowboarding parallel slalom.

New leadership: Sochi is the first Olympics for new International Olympic Committee President Thomas Bach. So far he has been tested with a politically charged lead-up to the Games that saw a strong push for sponsors, athletes and leaders to boycott the event over an anti-gay propaganda law recently passed in Russia. How will he do once the Games are underway?

New venues: Just seven years ago, Sochi was a domestic tourist destination known for its Soviet-era spas and Black Sea beaches. After its successful Olympic bid, however, an unprecedented $51 billion infusion helped the mid-sized city shed its old-world skin and get ready for its first international mega event. Everything from roads and buses to the venues at the coastal and mountain "clusters" where the Olympic events will be held, are out-of-the box brand new.  

Unprecedented spectacles:
Dmitry Chernyshenko, the head of Sochi's organizing committee, recently told Olympics.org that the 2014 Games "will really amaze the world." If Sochi's eye-popping price tag and record 40,000-mile long torch relay are any indication of what's to come, these Games certainly will.

Dog Hurt in Encinitas Coyote Attack

A North County family needs the public to help pay for their dog's medical care after he survived a coyote attack.

The Cavalier King Charles Spaniel fought off the coyote long enough for a neighbor to scare off the wild animal.

The dog named Tommy was attacked Tuesday around 5 p.m. in the Village Park community of Encinitas, according to The Foundation for Animal Care and Education (FACE).

The organization offers grants to pet owners who cannot afford medical care for their animals and they’re asking for donations in Tommy’s honor.

A neighbor coming home from work saw what he thought were two dogs playing but, once he realized what was going on, ran across the street to try and stop the attack.

Tommy had gotten out of the family’s fenced-in backyard and was in front of their home when the coyote grabbed him, according to the organization.

The breed weighs approximately 12 to 15 pounds and stands about one foot tall. In comparison, coyotes range in size from 15 to 40 pounds.

The California Department of Wildlife suggests keeping pets indoors overnight, installing motion-sensitive lighting and keeping garbage contained. Since coyotes feed on rodents, bird feeders can draw them into a yard.

If you encounter a coyote, make a loud noise to scare the animal off.

FACE recommends dog owners remove pet food from outside the home and avoid leaving pets outside unattended to try and protect their dogs from a coyote encounter.

U.S. Border Patrol Agent Injured in Crash

A federal agent patrolling the U.S.- Mexico border was injured Friday in a serious crash near San Diego.

The U.S. Border Patrol agent's truck collided with a tree just after 1 a.m. in the Campo area, a remote area that's approximately 55 miles from downtown San Diego.

California Highway Patrol officers found the truck with extensive front-end damage at Buckman Springs Road and Lake Morena Drive south of Interstate 8.

The agent driving the vehicle was rushed to Sharp Memorial Hospital in Kearny Mesa.

CHP officers said the agent, who they identified only as a 26-year-old man, suffered a broken right hand and some facial lacerations.

The cause of the crash is under investigation. CHP said the road was wet from ongoing rain at the time of the crash.

Lawmakers Push for "Kill Switch"

A bill intended to target smartphone theft by requiring a "kill switch" that would shut down the mobile device's essential features has gained the support of several California lawmakers and city officials.

State Sen. Mark Leno (D-San Francisco) and other lawmakers plan to introduce the bill this legislative session and conduct hearings on the subject in the spring. Supporters said a smartphone "kill switch" would deter smartphone theft, a crime that accounts for 30 to 40 percent of all robberies in the United States, according to the Federal Communications Commission.

In San Francisco, more than 50 percent of robberies involve a mobile device. In Los Angeles, cell phone thefts increased by 12 percent last year.

Industry officials have expressed reservations, saying the products already include safety features. John Doherty, a vice president of the industry group TechNet, told the Los Angeles Times government requirements could affect innovation and prices.

The bill would require protective features on new smartphones sold in California starting next year.

Leno's legislation does not specify what type of protective features should be installed on new devices, only that companies provide a way to render its essential features inoperable if the device is stolen. Customers would contact their providers to trigger the kill switch if a device is stolen. 

The bill has backing from family members of an Illinois woman who was killed in 2012 during a cell phone robbery attempt.

Trenton Mayor Found Guilty of Extortion, Bribery

Tony Mack, the mayor of Trenton, N.J., the state's capital city, has been found guilty of extortion, bribery and fraud after a month long federal corruption trial.

On Friday evening, jurors came back with guilty verdicts on all six counts levied against the 48-year-old. The trial started in January. Jurors only deliberated for one full day before delivering the verdict.

Mack didn't say a word as he walked from the federal courthouse in the capital city. His attorney, Mark Davis, said jurors made the wrong decision and that they're looking at an appeal.

"That was the wrong verdict that the jury reached," Davis said. "Clearly they believed testimony that they should have never believed."

Mack and his brother, Raphiel, were nabbed in a government sting where officials said the men conspired to accept $119,000 in cash and valuables in exchange for the development of an automated parking garage.

Prosecutors say the men were planning to direct $100,000 from the sale of a city-owned vacant lot on East State Street into their own cauffers.

Davis, the mayor's lawyer, had argued Mack was the victim of government investigators who used the fake land deal and a slick-talking middleman to ensnare him.

Raphiel Mack was also found guilty on three counts of extortion and accepting bribes.

Joseph Giorgianni, a sandwich shop owner who was also involved in the scheme, pled guilty to two counts of extortion in the months before the trial began. The 64-year-old told authorities he handled the bribes for Mack and gave him about $8,000 in cash.

Mack, a Democrat who was elected in 2010, has remained in office since his arrest more than two years ago.

With the conviction, Mack will be removed from office and Trenton City Council President George Muschal will replace him. He was sworn in on Friday night.

Muschal will remain as mayor for 30 days, but can stay on for the remainder of Mack's term if the city's council votes him into the post.

"This protracted case has resulted in an unfortunate and unfair distraction for the City of Trenton for far too long," Mercer County Executive Brian M. Hughes said in a statement. "It has put a dark cloud over Trenton, and frankly, the entire region. Justice has been served and now it is time to move on, and to look forward to a brighter future."

Both Tony and Raphiel Mack are currently out on bail. A sentencing hearing is scheduled for May 14. He faces up to 40 years in a federal prison.

Since 2000, mayors of Newark, Camden, Paterson, Perth Amboy, Hoboken, Passaic, Asbury Park, Orange and Hamilton have been convicted or pleaded guilty in corruption cases.

Cal Football Defensive Lineman Dies

California football player Ted Agu died Friday morning at age 21 after collapsing during a training run with his teammates.

“This is a very difficult time for our football family,” head football coach Sonny Dykes said in a statement. “Ted was a remarkable young man and a member of this family who was highly respected and loved by his teammates and coaching staff. He had an incredible passion for life and will be deeply missed.”  

Agu was on a training run near Memorial Stadium with his teammates early Friday morning that was supervised by multiple members of the team's medical staff.

Team physician Dr. Casey Batten said the medical staff saw he had difficulty completing the workout and he was transferred by cart about 150 yards to the stadium. 

He then collapsed when he got to the medical facility at the Simpson Center at the stadium around 7 a.m. and emergency medical personnel were alerted and Agu was given CPR. He was quickly taken to Alta Bates Medical Center, where he was pronounced dead.

Agu, a defensive lineman listed at 6-foot-1 and 240 pounds, was from Bakersfield, Calif. He was going to be a fifth-year senior next season. He played seven games last season for Cal, recording six tackles. He played five games the previous two seasons.

In high school, Agu earned  All-Southwest Yosemite League honors in his final two prep seasons, according to the Cal Bears website.

Athletics Director Sandy Barbour described Agu’s death as “painful time for the entire Cal family.”

“In the days and weeks ahead, my focus will be on providing every member of our community the support and information they need to get through this time,” Barbour said in a statement. “I would ask that media please respect and understand how this tragedy is impacting Ted’s family, his teammates, friends and the members of our campus community. We will get through this together.”

A medical examiner will determine the cause of death, a process that can take several weeks.
 
Batten said Agu never had any previous problems with workouts or practice during his time at Cal.

The school said it is providing counseling sessions for the other players.

Freshman defensive back Cameron Walker wrote on his Twitter account that he loved Agu and appreciated all he did to help ease his transition to college.

"You were a blessing to all of us and it hurts so bad to know that I'll never walk next to ur locker again and hear your voice speaking to me,'' Walker wrote. "You left too soon. But ur in a better place now & we all have another guardian angel watching over us. I love you, Ted. I miss you already. I'll never forget you, Pre-Med Ted. You and your family are in my prayers.''

Padres Fan Fest Hits Petco on Saturday

Last time we saw Petco Park, it was hosting last weekend's Davis Cup tennis tournament. Now it's back to baseball, as the park will welcome the usual crowd for Padres FanFest on Saturday.

The team has expanded the free event, which will give fans a chance to roam the ballpark, run the bases, catch fly balls in the outfield and pitch in the bullpen. Pitcher Tyson Ross will give a youth pitching clinic and Yonder Alonzo will assist youngsters in a batting clinic.

More than a dozen players will be on hand to sign autographs and plenty of rare memorabilia will be available at the team “garage sale.”

There will also be a tribute to legendary broadcaster Jerry Coleman, who passed away over the offseason. Fans can record their tributes to Coleman at the statue erected in his honor at the East Village gate.

Will the Padres be playoff contenders?

Also, FanFest will be the first chance for fans to guarantee their Opening Night tickets through the purchase of a Padres Pack, with options for three, six or nine games. The purchase of any Padres Pack at FanFest will come with first access to also purchase Opening Night tickets.

Fans can enter the fest through the home plate gate at Petco. The fest opens at 10 a.m. and runs to 4 p.m., but you can get tickets for early entry at the team’s website.

Free parking will be available in all Padres designated lots (Lexus Premier Lot, Parcel C Lot, Tailgate Lot and the Padres Parkade).

More Arrests in Case of Missing Man

A volunteer police reservist from Virginia, who had been reported missing a week ago, is dead, police said Friday.

Virginia State Police said a body that they found in connection with the case in a remote area along the Fluvanna and Louisa county lines Thursday had not yet been fully identified.

But police had enough information, and enough time had elapsed since his disappearance, to say that 45-year-old Kevin Quick had died, Virginia State Police spokeswoman Corinne Geller said.

Quick was a 25-year veteran of the volunteer reserve officers of Nelson County and had a 4-month-old daughter. Police offered a tribute to him before a news conference Friday and lowered flags to half-staff. His father was also a police officer.

"The Quick family has been an institution here for 30 years," Waynesboro Police Sgt. Brian Edwards said. "Kevin was an amazing, kind individual."

Thursday night, three people were taken into custody in Prince William County in connection with Quick's death, bringing the number of people behind bars in connection with the case to six.

Halisi Uhuru, Leslie Hope Casterlow and Anthony Darnell Stokes have been charged with principle in 2nd degree to the crime of murder. Geller said the suspects have not being charged with murder, "but in association with his death."

Uhuru, Casterlow and Stokes were taken into custody Thursday night after they were identified as persons of interest. They are being held in Henrico County, Va. and State Police say they were members of a street gang.

Quick had been missing since late Friday evening. He was last seen at his mother's Afton, Va. home. Police say Quick left the home around 10:15 p.m., and was reported missing when he never arrived at a friend's house for a surprise party in Albemarle County.

Earlier this week, a brother and sister from Albemarle County were arrested and charged in the theft of Quick’s silver 1999 Toyota 4Runner, which was found Monday.

Mersadies Shelton and Daniel Mathis, who is also known by the last name Shelton, are charged with possession of stolen property and grand larceny.

Another sibling, Shantai M. Shelton, 24, was arrested on an unrelated outstanding arrest warrant from Louisa County. Mathis was also arrested on four felony warrants and three misdemeanor warrants issued by the Louisa County in an on-going shooting investigation.

The three were arrested in a hotel in Alexandria, police said.

Quick’s SUV was recovered outside a home in Monday in Mineral, Va and found rubber gloves, swabs, a wallet and a green, leafy substance inside. 

The homeowner is not believed to be connected. 

All three siblings have been denied bond.

Hearing on Ex-Cop Victim's Notes

Attorneys for a former police officer who preyed on female drivers in San Diego’s Gaslamp Quarter argue witness notes kept from the defense could’ve made a difference in the officer’s trial.

Meanwhile, one victim's attorney claims the notes were held back by the police department as a way to get Arevalos off on a technicality.

Four pages of notes written by the victim in the Anthony Arevalos case were the subject of an evidentiary hearing Friday.

Arevalos was sentenced to eight years and eight months in prison after jurors convicted him on multiple counts of sexual battery and assault.

The former officer pulled over female drivers from 2009 to 2011 and asked for favors in exchange for letting them out of traffic citations.

However, it was the March 8, 2011 incident between Arevalos and the victim identified only as “Jane Doe” that led to his arrest and an investigation.

Timeline: Anthony Arevalos Case

Jane Doe used the written pages to tell police investigators what happened the night Arevalos followed her into a 7-Eleven bathroom.

The notes state that Arevalos asked her to turn over her bra and panties in the car or go to 7-Eleven and show him her breasts.

In the trial, Jane Doe testified that Arevalos touched her private parts.

Defense attorney Gretchen von Helms, who testified she saw the notes last night, said that had the notes been turned over, it could have changed the sentencing in the case.

“I would’ve used these notes to impeach her on the fact that any touching occurred,” Von Helms said.

Jane Doe's attorney said the San Diego Police Department knew about the notes.

He claims they failed to turn them over so that there would be grounds for an appeal and that Arevalos could get out of his prison sentence for this technicality.

The San Diego mayor’s office and District Attorney’s office would not comment regarding the allegations of corruption and cover-up because it’s all part of an appeal, as well as part of the ongoing civil litigation.

Aztecs Go for 20th Straight Win

It’s starting to become redundant, but San Diego State looks to extend a number of record-setting win streaks when the team hosts Nevada at Viejas Arena on Saturday night.

On the line for the 20-1 Aztecs: A 20th consecutive victory, second-longest in school history. Also on the line is a school-record nine-game conference win streak to start the season. Oh, and the No. 5 ranking, which is the second-highest the program has ever reached.

Standing in the way is a tough Nevada team, which is 12-11 overall but sits in third place in the Mountain West with a 7-3 conference record. Senior guard Deonte Burton is leading the conference with 21.1 points per game.

“They've got great players,” said senior guard Winston Thames. “They're playing better defense than they did last year. We knew they would have a good team this year.”

The Aztecs are coming off a thrilling win Wednesday night over Boise State. They rallied from a 14-point deficit for a 67-65 victory, their 10 straight road win (tied for longest streak in the nation). Dwayne Polee hit the game-winning shot with 4 seconds left to keep the win streaks alive.

"That's a moment as a kid you dream about,” Polee said. “All your life you wait for that final buzzer-beating shot to win the game or send the game into overtime. It's just the best feeling ever. It felt like I was in a dream."

Xavier Thames led the team with 23 points, and fed Polee with the game-winning assist.

"I had a pretty decent look, but I saw DP out of the corner of my eye," he said of passing up the potential winning shot.

Thames leads the team and is third in the conference with 18.1 points per game.

SDSU may be without forward Winston Shepard, who injured his wrist in the win.

“He's still pretty sore, so he will be a game-time decision depending on if he can move the wrist and if he's capable of using that left hand,” head coach Steve Fisher said. “But the good news is it should not be anything long term."

Fisher, who earned his 300th win with the school last Saturday, will be presented the game ball from the victory in a pregame ceremony.

'Suspicious' Fire Engulfs La Mesa Building

A fire that officials say seems suspicious in nature engulfed a vacant building in La Mesa Friday evening, causing heavy smoke and a second-alarm response from crews.

Officials said the blaze began around 5:50 p.m. at a building in the 4400-block of Palm Avenue. Crews could see smoke from miles away.

The fire caused a portion of the roof of the building to collapse as firefighters worked to tackle the flames. By 6:55 p.m., officials said they had contained the blaze, which burned near homes that are situated on a grassy hill nearby.

A fire official told NBC 7 the building was vacant and set to be demolished Monday. The cause of the blaze is under investigation, but a battalion chief did tell NBC 7 the fire is suspicious.

No one was injured.

Motorcyclist Seriously Injured in Borrero Springs Crash

A motorcyclist was seriously injured Friday afternoon while riding on Montezuma Valley Road near Borrero Springs.

According to California Highway Patrol, the driver lost control of his vehicle just west of Palm Canyon Drive at around 4:20 p.m., travelling across both lanes and hitting an embankment. The motorcycle was overturned and the driver was ejected.

He sustained major injuries and lost consciousness. He was airlifted to Desert Regional Hospital in Palm Desert.

New Victim in SDPD Officer Case?

A prominent San Diego lawyer said there may be a fifth alleged victim in an investigation involving a San Diego Police Department officer accused of sexual misconduct on the job involving female civilians.

On Friday, attorney Dan Gilleon told NBC 7 that he had heard from another possible victim claiming sexual advances at the hands of SDPD Officer Chris Hays. Gilleon said the woman’s allegations were very serious in nature.

On Thursday, SDPD Chief Lansdowne confirmed an SDPD officer was being investigated for sexual misconduct involving at least four women.

Though Chief Lansdowne would not confirm the officer’s name, he did say the officer is being investigated for getting “sexual gratification” from the improper “pat downs” of four women he detained while on duty.

Two separate law enforcement sources confirmed the officer under review is Hays.

Chief Lansdowne maintains there was no skin-to-skin contact between the officer and the victims, and no sexual favors were exchanged.

However, Gilleon said the latest victim’s claims against Hays are more severe than what the victims before her may have alleged.

As an attorney, Gilleon is no stranger to these types of cases.

He represented eight victims of former SDPD Officer Anthony Arevalos, who was convicted of preying and sexually assaulting female motorists in downtown San Diego’s Gaslamp area.

To date, the City of San Diego has spent $2.3 million on settlements involving Arevalos’ victims. In September 2013, the city agreed to pay $795,000 in a settlement involving a woman who said she was violently sexually assaulted by Arevalos.

Now, if the latest victim’s allegations in the Hays case turn out to be true, Gilleon said local taxpayers could be on the hook for much more.

“If what I’m hearing is true about Mr. Hays, this case may be much more than what we had to pay in Anthony Arevalos – much more,” he said.

Still, Chief Lansdowne maintains the accusations against Hays are not as serious as those against Arevalos.

Meanwhile, law enforcement sources said Hays is on paid leave and his case is now transitioning form the police department to the San Diego District Attorney’s office, which will now consider potential criminal charges against the officer.

On Thursday, a spokesperson for the DA’s office said they had no specific time frame just yet for making that decision on the criminal charges.

Law enforcement sources said allegations against Hays first came to light in December, when one of the alleged victims called the department to complain about the officer’s behavior during a pat down. At least one of the alleged victims was intoxicated during an alleged encounter with Hays.


Man Shot on Street in Stockton Neighborhood

Police are responding to a shooting victim Friday night in the Stockton neighborhood.

Just before 9 p.m., a man was reported in the middle of the road on 3300 Imperial Avenue at L Street with apparent gunshot wounds.

There’s no word if it is a gang-related incident.

San Diego Athletes to Watch: Sat

Every day NBC 7 will provide a quick look at the key events of the day as well as the local athletes who will be competing. Here’s our “San Diego Athletes to Watch” for Saturday, Feb. 8:

Special Section: Sochi 2014

Night owls can take advantage of the live streaming of the men’s snowboarding semi-finals in slopestyle boarding. The event begins at 9:30 p.m. Friday with the finals beginning just before 1 a.m. Saturday.

Chas Guldemond just missed a spot in the finals in the first qualifying round and will be trying for a shot at the medal.

Guldemond is no stranger to San Diego having stayed at the Olympic Training Center in Chula Vista as part of his training and preparation for the Olympics.

Also competing in the event will be Seamus O’Connor, 16, of Ramona. O’Connor, who will be competing in both the slopestyle and halfpipe events, is representing his father’s home country of Ireland.

Enjoy your morning coffee with women’s moguls qualifying rounds and American Hannah Kearny who's is leading the pack. At 10 a.m., the women will compete for the medal.

Watch for other Olympic Training Center athletes in the luge event at 6:30 a.m. with Christian Niccum and Chris Mazdzer competing.

At 8:30 a.m. watch the live stream of the ski jumping competition for men’s individual normal hill qualifying rounds. Nick Fairall, Peter Frenette and Anders Johnson all spent time training in San Diego County as part of their journey to Sochi.

Then, things get rolling for the U.S. Women’s Hockey Team as they face Finland in their first game beginning at midnight PT.

Team USA has medaled in all four appearances since the sport was first introduced to female competitors at the 1998 Winter Olympics. However, 1998 was the only time they’ve reached the top of the podium.

The team took advantage of a trip to the beach in San Diego last year to help them prepare for the competition on the ice.

In figure skating, the Americans will try and improve their standings in the Ice Dancing Short program beginning at 6:30 a.m. PT online.

Then, at 8:10 a.m. PT the live stream begins for the ladies’ short program followed by the pairs free skate at 10:05 a.m. PT.

Other Saturday events include cross-country women’s skiathlon, biathlon men’s 10km sprint , men’s speed skating and alpine skiing training runs for the men’s downhill and women’s super-combined.

UCSD Arson Suspect Sought

A woman accused of helping another suspect start two fires at UC San Diego’s crowded Price Center building is being sought by officials for arson. She was captured on surveillance tape just moments before setting the fires.

According to San Diego Crime Stoppers and the Metro Arson Strike Team (MAST), the unknown female suspect and another woman intentionally set two fires at the Price Center on campus on Dec. 3, 2013.

At the time of the fires, the Price Center – a busy, popular hub where UC San Diego students gather daily – was occupied by several hundred students, investigators said.

The women were captured on surveillance tape entering the Price Center. Shortly thereafter, the suspects allegedly started a fire on the first level of the building and then fled the scene, according to investigators.

After that, another camera captured the women re-entering the Price Center on the second level wearing different clothing. Once again, the women allegedly started another blaze with an open flame and fled the scene.

Investigators said the two fires were quickly extinguished by UCSD staff. No one was injured in the arsons.

Detectives launched an investigation in search of the suspects and identified one of the women as UC San Diego student Hoai Vi Holly Thuy Nguyen.

Nguyen was arrested in connection with the arson case on campus on Feb. 4.

As of Friday, police said the second suspect has yet to be identified and remains outstanding. She's pictured on the left in the photograph below.

Lawsuit Filed Against SDG&E Over Fatal Crash

A lawsuit was filed Friday in the deadly crash involving an SDG&E employee in Shelltown.

The lawyer for the family of Jaslene Arias filed a negligence lawsuit claiming the utility company failed to implement a no cell phone policy.

It is still unknown if the employee was on his cell phone when he allegedly ran a stop sign and hit and killed Ana Herrera Rodriguez and injured Rodriguez’s daughter and Jaslene Arias.

The Arias family's lawyer says he hopes the lawsuit will get to the bottom of what caused the accident.

The utility company sent a statement on Friday: "SDG&E continues to cooperate with the police on their investigation which we understand is not concluded."

3rd Homicide Victim Shot in Head

The third victim of an unsolved triple-homicide case that has gripped San Diego since Christmas Eve died as a result of fatal gunshot wound(s) to the head, the San Diego Police Department confirmed Friday.

The SDPD said San Diego resident-turned-missing-person Gianni Belvedere, 24, was not able to survive injuries sustained in some sort of shooting, according to preliminary findings from the Riverside Medical Examiner’s office. His final autopsy report has not yet been completed, but San Diego police said this gives new insight into how he died.

TIMELINE: Triple-Homicide Mystery

However, investigators still do not know why he was killed or who is responsible for his death, along with the slayings of his fiancée, Ilona Flint, 22, and younger brother, Salvatore Belvedere, 22.

On Dec. 24, 2013, at around 1:15 a.m., Flint and Salvatore were found critically shot in a parking lot outside the Macy’s department store at Westfield Mission Valley mall in San Diego’s Mission Valley area. Flint was pronounced dead at the scene of the Christmas Eve shooting. Salvatore died at the hospital a few days later.

A couple days after the shooting, the Belvedere family and San Diego police announced that Gianni Belvedere had gone missing. He was last seen at his home in Tierrasanta on Dec. 23, 2013, around 10 p.m. – just hours before the fatal shooting of his fiancée and brother.

For the next three weeks, police searched extensively for Gianni while his family pleaded for his safe return. The family said Gianni may have also been at the Mission Valley mall at the time of shootings of Flint and Salvatore.

The SDPD issued a missing person bulletin for Gianni, complete with a description of the Toyota Camry with Utah license plates he could have been traveling in.

On Jan. 17, the decomposed body of Gianni was found in the trunk of his Toyota Camry in Riverside, Calif., about an hour-and-a-half north of San Diego County. His car was parked in the 19500-block of Van Buren Boulevard. A passerby noticed a foul odor coming from the vehicle’s trunk area and alerted police.

Though the grim discovery brought an end to Gianni's missing person case, it also brought mounting, unanswered questions surrounding the now-triple homicide case.

On Jan. 24, SDPD Lt. Mike Hastings revealed some new details on the case, including more information about a possible suspect.

Lt. Hastings said a man wearing a black hoodie with white bands in the biceps area of the sweatshirt, tan pants and white tennis shoes is believed to have been at the Mission Valley mall on Dec. 23, 2013, at around 11:15 p.m. -- about two hours before the shooting of Flint and Salvatore. Investigators believe that same man returned to the mall at 12:15 a.m. on Christmas Eve, about an hour before the shooting. Police described the suspect as an unknown race, standing 5-foot-10 to 6-foot.

At that same briefing, Lt. Hastings went on to say that San Diego police have spent hundreds of hours on this case.

“If this case can be solved, this case will be solved,” he assured.

To date, police have not arrested a suspect in connection to the slayings. Information about a possible motive for the crimes has also not been released by investigators.

Friday’s update on Gianni’s manner of death was the first bit of new information released in two weeks.

At this point, San Diego police said there would be no further details released regarding Gianni’s death until the final autopsy report is completed. A time frame for that was not disclosed.
