Truck Clips Wires, Temporarily Closing 405 Fwy

Traffic was temporarily diverted off the 405 Freeway in Long Beach after a truck carrying an oversized load clipped cables on an overpass.

The lanes were closed on both sides of the freeway near Temple Avenue as a precaution. The freeway reopened around 11:30 a.m.

Crews continued to work on removing the cables from the Temple Avenue bridge over the freeway. The truck clipped either the wires or a utility pole as the driver was exiting the freeway.

I-5 Closures Scheduled for Sunday

Intermittent closures on Interstate 5 (I-5) are scheduled for Sunday as construction continues for the Mid-Coast Trolley Extension Project, Caltrans said in a statement.

The I-5 off ramp to eastbound Balboa Avenue will be closed from 3 a.m. to 10 a.m.

Motorists will be detoured in advance of the closure to the northbound I-5 exit at Clairemont Drive/Mission Bay Drive.

Caltrans also stated all north and southbound lanes on the I-5 near Balboa Avenue will be closed several times for about 10 minutes from 6 a.m. to 8:30 a.m., although closure times may be longer as needed for public safety. 

Motorists are reminded to be “work zone alert” and slow down when nearing construction areas.

Construction for the Mid-Coast Trolley Project began in 2016, and will extend the Blue Line service from Old Town up to the University City area. Service is anticipated to run in 2021, according to Caltrans.

Police: Williams Legally Entered Intersection Before Crash

Police released a surveillance video Friday which shows the collision involving tennis star Venus Williams and an elderly couple in Palm Beach Gardens. Police also released a statement Friday saying Williams "lawfully entered" the intersection when Linda Barson’s car collided into Williams' SUV on June 9.

Barson’s car approached the intersection westbound after a green light, at which point the vehicle collided with the right front of Williams’ SUV, police said in a statement. It was previously reported by police that the tennis star caused the crash. She has not been cited or charged.

Jerome Barson, 78, succumbed to his injuries two weeks after the crash. His estate filed a wrongful death lawsuit against the tennis star, seeking damages in excess of $15,000. Attorneys for Barson’s estate accused Williams of running a red light, failing to yield the right of way, inattentive driving and negligent operation of a motor vehicle.

A judge ruled at a protective order hearing Friday that both parties should have their vehicles examined by Aug. 2. Williams’ attorney filed the emergency protective order one day before to ensure that the data from both vehicles are collected and preserved consistently.

Williams, 37, is now in England competing at Wimbledon, a tournament she has won five times. The 10th-seeded Williams, who has won her first three matches, broke down in tears Monday when asked at a press conference about the crash.

Michael Steinger, the attorney for the Barson family, said the video shows Williams caused the crash by "violating the Barsons' right of way. "

"There is nothing that disputes Ms. Williams' was in the intersection on a red light, and the witnesses clearly confirm the Barsons had a green light and lawfully entered the intersection," Steinger said in a statement.

Williams' attorney, Malcolm Cunningham, disagreed, saying in a statement that Linda Barson was at fault.

Williams "had the right to proceed through the intersection and other vehicles including those with a red light changing to green, were obligated to yield the right-of-way," Cunningham said, adding, "she remains deeply saddened by the loss suffered by the Barson family and continues to keep them in her thoughts and prayers."

Parents of Boy Found Chained in Mexico Battle for Custody

A boy found beaten, and starved last week in Mexico City is at the center of an international custody battle.

The 5-year-old boy found in chains at a relative’s house was born in Escondido and has dual citizenship.

Now, his parents say they want to care for him when he returns to the U.S.

An anonymous tip on June 28 led officers to the starving, injured boy and with chains wrapped around his legs in a neighborhood outside of Mexico City.

The boy’s father told NBC 7 he would send $500 a month to his sister and brother-in-law in Mexico City to care for the boy.

Pascual Castro, who is a Mexican national, says the last few weeks have been a nightmare.

“An innocent child of 5 years,” the father said in Spanish. “He cannot defend himself.”

Dawn Sanderson, who is estranged from Castro, said she lost custody of her son when he was only 11 months old.

Sanderson, who lives in Escondido, is a U.S. citizen. She’s also seeking custody.

"I'm going to do what I have to do without stopping until the day I have him with me," she said in Spanish to NBC News.

Castro is waiting for the boy to return to San Diego in the next few weeks. He said U.S. Congressman Darrell Issa is helping him with the paperwork.

The sister and brother-in-law face child abuse charges according to Mexican law enforcement authorities.

Now the child may be reunited with his family in the United States or placed in foster care in Mexico City.

Telemundo20 confirmed with Marcela Celorio, the Mexican Consul General in San Diego, that the boy may be placed in foster care at least temporarily.

What ultimately happens depends on the special prosecutor for the rights of children in Mexico City.

La Mesa Psychiatrist Accused of Prescribed Controlled Drugs

The Medical Board of California wants to revoke the license of an East County doctor who allegedly wrote hundreds of controlled-substance prescriptions for drug-addicted patients, without proper examinations and medical need.

In a detailed, 94-page document filed on June 29, the Medical Board accused Dr. Harry Henderson III of gross negligence, repeated acts of clearly excessive prescribing, failure to maintain adequate and accurate medical records, and other licensing violations.

The accusation alleges Henderson has a history of negligence involving six patients over the past seven years.

Medical Board investigators said Henderson failed to get medical records, information, or test results for a 27-year-old female patient whom Henderson first treated in 2012. Investigators said Henderson’s treatment notes are “...illegible and incomplete, lack adequate detail, and fail to provide a clear rationale for any medical decisions.”

According to the accusation, Henderson allegedly gave that patient dozens of prescriptions for thousands of pills, including amphetamines, sedatives, narcotic painkillers and other controlled substances.

The Medical Board documents reveal the agency based its investigation on an anonymous tip from a health provider who treats inmates and the homeless. That provider complained of seeing “again and again, inmates who are on high doses of (anti-anxiety medications) during active substance abuse use, also being prescribed pain medications by Dr. Harry Henderson...I have great concern that he is known by the inmates as someone who will ‘give them what they want.’”

Investigators also allege Henderson failed to routinely check the state’s prescription drug database, which helps doctors identify drug-abusing patients. He is also accused of ignoring “...red-flags of misuse, abuse and/or diversion of controlled substances” by that young female patient.

The Medical Board is accusing Henderson of similar negligence in his treatment of a 52-year-old male, who also obtained dozens of prescriptions for amphetamines, narcotic pain relievers, and sedatives.

Investigators said Henderson ignored warnings from a physician’s assistant who expressed concerns about that patient’s truthfulness and apparent drug abuse. The physician’s assistant cautioned the patient was “... highly predisposed to [the] negative outcomes of addiction and death.” According to investigators, Henderson continued to supply that patient with powerful narcotics, including Fentanyl and Oxycodone, despite that warning.

The accusation states Henderson recorded just one office visit with the patient during 2016, but that billing records obtained by investigators indicate the doctor billed insurance companies for 11 visits that year and gave that patient prescriptions for approximately 4,000 controlled-substance pills.

Dr. Henderson has not returned messages left by NBC 7 Investigates at his La Mesa office. A response to the accusation has also not been filed.

Another allegation involves a 56-year-old female patient who Henderson first treated in 2010. According to the accusation, Henderson negligently prescribed several medications, including Xanax (an anti-anxiety medication), hydrocodone (a narcotic pain reliever) and Soma (a muscle relaxer). The accusation states those three drugs, taken together, are a powerful and dangerous combination “sought out by those who abuse controlled substances, known as the “Houston cocktail,” “trio” and/or “the holy trinity.”

In addition to revoking or suspending Henderson’s license, the Medical Board wants the administrative law court to strip Henderson of his authority to supervise physician assistants and nurse practitioners.

15-Year-Old Reports Man Spying on her in Park Bathroom

The parents of a 15-year-old girl reported a man spying on their daughter and possibly taking pictures or video as she was using a public restroom in Eastlake, Thursday.

The parents said she was on her way to meet friends after summer school when she stopped to use the restroom at All Seasons Park next to Wolf Canyon Elementary School.

In an interview, the parents said their daughter did see the suspect because he was in the restroom before her.

They said as she was using the restroom, she looked up she saw a cell phone at the window overlooking her stall. She screamed and the suspect took off.

When the victim left the bathroom, she told her parents the man she had seen leaving the bathroom earlier was the suspect. She saw him run away, get into a car and leave.

"I think he was waiting for the right opportunity," said one of the parents in an interview. "It was empty, not too many people in the park. She was by herself; she walked into the bathroom by herself."

A father who was in the park said he did not see the suspect but did see the car. The teenager waited with him until police and her mother arrived on scene.

The parents filed a police report but no arrest has been made so far.

The victim's uncle, who has a daughter attending a nearby high school, said he and other parents in the area are concerned about the incident.

Chula Vista police said they are investigating but have received no similar complaints or reports.

The suspect is described to be in his 20s, around five-feet five-inches in heights, 125 pounds with a full beard. He had been driving a black car.

Residents in the area are asked to remain vigilant and report any additional information to the Chula Vista Police.

All Charges Dropped in Alleged Jumpstart Kidnapping Case

Police say a man suspected of trying to kidnap a 6-year-old boy in City Heights on Fourth of July never touched the child and will not face any kidnapping charges.

The family told San Diego police, Michael Mahurin tried to take their son away in his truck in front of their home.

But police told NBC 7 Friday, they believe the boy got in the wrong truck.

According to police, the boy saw Mahurin’s truck and apparently confused it with his family’s truck because it looked similar.

Mahurin’s truck would not start and he went to ask the family for help jumpstarting it. They discovered the boy inside.

Police said there is no evidence Mahurin touched the child or knew he was in the truck. They do not believe Mahurin was attempting to kidnap the child.

Mahurin is still in jail after he was arrested on an outstanding warrant.

New Bikeway to Mission Valley Set To Open

A new bikeway is set to open connecting Mission Valley to Kensington.

The path will start at Adams Avenue in Kensington near Normal Heights. Then it will follow Highway 15 on the northbound side, ending at Camino Del Rio South in Mission Valley.

Bicyclists in San Diego are applauding the new paved path as one of the only bicycle-safe routes to Mission Valley.

“Getting into Mission Valley [on a bicycle] is more of a struggle than people think sometimes," said Kevin Baross, a bicyclist and resident of San Diego. "When you’re in a car, you don’t notice the hills."

The path will be 12 feet wide in most places and 18 feet wide in others.

But some drivers said Friday more bicyclists in the area could mean the potential for more collisions.

“It’s always on the vehicle driver to make sure everyone’s safe," said Patrick Cremeens, a driver and resident of San Diego. "Some of those bikers don’t feel like they have that obligation.”

The project costs about $15.6 million.

Caltrans said the bike path will be fully opened in early September.

Handicap Placard Crack Down

The California Department of Motor Vehicles (DMV) has been cracking down on people who have been trying to take advantage of Disabled Person Parking Placards (DPPP).

Investigators with DMV caught 195 people fraudulently using DPPP during 28 enforcement operations carried out in June 2017.

In San Diego, 34 drivers were contacted and one citation was issued.

Those issued misdemeanor citations must appear in court, face possible fines that range from $250 to $1,000, and will have the offense recorded on their driver record.  Investigators also confiscate the misused DPPP. The cases are forwarded to the local jurisdiction for prosecution.

The statewide crackdown is part of the DMV’s continuous efforts to ensure handicap parking spots are used by individuals who have legitimately obtained disabled parking placards to assist them with their mobility.

From April 1 to June 30, 2017, DMV investigators have issued 747 citations during 49 enforcement operations throughout the state. 

Individuals who suspect possible Disabled Person Parking Placard misuse are urged to submit a written complaint using form INV172A Record of Complaint, which can be found online or send an email to placard.misuse@dmv.ca.gov.

Submissions are kept confidential.  

It is helpful to include the vehicle information associated with the suspected placard misuse, as well as the placard number (if possible), the location where the vehicle was parked and the date it occurred.

The DMV wants to remind you that not all disabilities are visible and allegations of abuse may be unfounded.

Truck Rolls Backward, Crashed Into Pool in Allied Gardens

A pickup truck began rolling backward with a grandmother still inside, went down a hill and crashed into a pool of an Allied Gardens home.

A bystander heard the crash and jumped into the pool. He broke the window with a brick and took the woman out of the truck, according to San Diego police.

The incident occurred at approximately 4:30 p.m. on the 7300 block of Conestoga Court near Fontaine Street, according to the San Diego-Fire Rescue Department (SDFD).

Police said the grandparents were at the home of on of their children. While the grandfather was unloading the Ford pickup truck, it started rolling backward.

The grandmother was still inside the vehicle, police said. The truck rolled down a hill, crashed through a fence and landed in a pool.

It was completely submerged in the pool. 

She was transported to a local hospital but there is no word on her injuries.

The homeowner was not home at the time of the crash.

No other information was available.

BP: Narcotics Seized from Smart Car Driver in Oceanside

San Clemente Border Patrol seized 75 bundles of methamphetamine from a 25-year-old man’s smart car on Wednesday.

Around 8:45 p.m. agents pulled over the man and his 60-year-old female passenger in a 2008 Mercedes Smart car, off Interstate 5 near San Clemente, according to Border Patrol.

The two indicated they were on their way to La Puente, according to a statement.

After a positive K-9 sniff search, agents found the packages of methamphetamine and two other packages of an unknown substance inside the vehicle’s cargo area.

The two packages were sent to a laboratory to be identified, while the methamphetamine weighed 75.51 pounds and has an estimated street value of $256,734.

The narcotics were turned over to the Drug Enforcement Administration, along with the man and his passenger after they were arrested for narcotics smuggling, according to a Border Patrol statement.

The vehicle was seized by the U.S. Border Patrol.

Border Patrol said suspicious activity can be reported through the San Diego Sector at (619) 498-9900.

SDSU Raises Pride Flag in 10th Annual Ceremony

San Diego State University (SDSU) hosted its 10th annual Pride Flag Raising Ceremony Friday.

The university celebrated the accomplishments of its LGBTQ students at the ceremony. Students waved the rainbow flags to symbolize the diverse sexual orientations and gender identities at SDSU.

“Part of our stance at SDSU is to be inclusive to all of our students on campus. I think we have done a great job on this campus, building this inclusivity,” said Christopher Lujan, SDSU Pride Center Coordinator.

SDSU also ranked No. 7 on the Best Colleges for LGBT Students list and appeared on a College Choice ranking listing the 50 best colleges for LGBTQ students.

“It’s great to come here today and celebrate all the great things we have done on this campus and to connect with our community," said Lujan.

SDSU has offered an LGBT studies minor since 2009, and an LGBT studies major for five years.

The university has been nationally recognized as one of the most LGBTQ-friendly universities in the nation by the Campus Pride Index.

National City Settles Lawsuit Over Accidental Shooting

National City paid more than $1 million to a man accidentally shot in the arm by a police officer during a 2015 traffic stop.

According to court documents obtained by NBC 7 Investigates, Jesus Flores was driving on F Street when police tried to pull him over for a missing license plate. In the court documents, Flores admitted he kept driving because he said he didn’t have his driver’s license and feared his car would be impounded and he would be taken to jail.

Three blocks later, the 22-year-old decided not to evade police and pulled over.

Then, according to court documents, National City Police Corporal Darren Pierson approached Flores with his gun drawn and Flores put his arms outside his car window, as directed by police.

Gene Iredale, Flores’ attorney said this is when Corporal Pierson lost his grip on his gun, and accidentally pulled the trigger while trying to regain control of his weapon. A single bullet hit Flores in in the elbow, causing permanent damage.

"This was a rather unique case because this was a good cop who made a mistake and he owned up to it," Iredale said. "This a case where a good cop, one with no history of discipline, extremely active in civic causes, made a mistake like we all so often do."

Pierson has since been promoted to detective. A National City police spokesman said he couldn’t discuss whether Pierson was disciplined for the accidental shooting.

Iredale told NBC 7 Investigates National City paid $1.5 million to settle the federal lawsuit, which lists excessive force, failure to properly train, battery and negligence, among other causes of action against Pierson, National City, and other defendants.

The lawsuit was dismissed on March 8.

Twin Toucan Chicks Spread Their Wings at the San Diego Zoo

Visitors to the San Diego Zoo are getting their first glimpse of two toco toucan chicks, which are now actively exploring their habitat in the Zoo’s Parker Aviary, with mom close by.

After spending nearly two months tucked away in a nest cavity, the pair flew from their nest last weekend. This is the first time in 32 years this species has hatched at the San Diego Zoo.    

"It’s really great to see all the nuances of mom raising her chicks," said Eric Arntzen, senior bird keeper at the San Diego Zoo. "At this age, the chicks are very playful, especially when it comes to feeding. So, it’s great to see them interacting with their mom in this way."

Following a 17-day incubation period, the chicks hatched May 11 and 12. Their mother has been very attentive and protective of her chicks, often feeding them in the morning and sporadically throughout the day.

The birds’ diet consists of a variety of fruit, including papaya and blueberries. Toco toucans reach maturity between one and two years of age, but keepers expect the chicks to begin sampling food items on their own in the next week.

Toco toucans (Ramphastos toco) are native to the rain forests of South America. They have a distinctive bill and are the largest and most recognizable toucan species. Toco toucans are listed as a species of Least Concern on the International Union for Conservation of Nature’s (IUCN) Red List of Threatened Species, stated the San Diego Zoo Global.

The most pressing threats to current populations include habitat loss, hunting and the removal of chicks for the pet trade. The San Diego Zoo participates in the toco toucan Species Survival Plan (SSP) managed by the Association of Zoos and Aquariums (AZA).

Visitors to the San Diego Zoo can observe the young birds in the Zoo’s Parker Aviary, from 9 a.m. until 30 minutes before sunset.

Man Accused of Brutal Attack in Del Cerro Changes Plea

A man accused of brutally attacking two women and killing one of them in a Del Cerro home last year changed his plea to guilty Friday.

Eduardo Torres plead guilty to one count of murder during forced oral copulation and murder during a first-degree burglary and one count of forced oral copulation with all charged allegations including torture and use of a weapon.

According to San Diego police, Torres attempted to break into a home on Mill Peak Road near College Avenue in June 2016 but was chased away by residents. He then smashed a glass door and broke into another home nearby.

Torres fatally stabbed a 74-year-old woman and raped a 50-year-old woman who were inside that home.

When officers entered the locked bedroom where Torres was holding one of the woman hostage, he surrendered.

Torres had pleaded not guilty to the charges last year.

He will be sentenced to life without parole on August 4.

Padres Win Series Opener Against Phillies

The Padres kicked off their final series before the all-star break in Philadelphia. Catcher Austin Hedges made his return after dealing with a neck strain for a the last few days, but his two home runs on the way to a 4-3 Friars victory makes us think he’s doing just fine.

It was a team effort against Philadelphia on Friday as several Friars showed us their power at the plate. Jose Pirela set the tone with a home run which gave the Padres an early 1-0 in the first inning. Hedge’s first dinger of the night came in the third inning. His solo shot to left field put San Diego up 2-0.

The Phillies cut the deficit in the fourth inning off of a Tommy Joseph homer to right field. Luckily, Hedges was back to make things right again. The Friars catcher sent his 13th home run of the season and second of the night to the right field seats.

Right before the seventh inning stretch a storm rolled in and delayed the game for nearly two hours. The rain must have reenergized the Phillies because once the game resumed Philadelphia notched two more runs to tie things up at three.

Hedges came to the rescue one last time in the ninth inning with a sacrifice fly to center field which scored Cory Spangenberg and the game winning run.

The second of three games against the Phillies is on Saturday, July 8, at 1:05 p.m. from Citizens Ban Park.

US Bombers Conduct Exercise Near N. Korea in Show of Force

Two U.S. B-1 bombers and American and South Korean fighter jets on Friday conducted an exercise near the demilitarized zone separating North and South Korea, in a show of force days after the North tested an intercontinental ballistic missile.

The Lancer bombers took off from an air base in Guam and "practiced attack capabilities by releasing inert weapons at the Pilsung Range" near the DMZ, U.S. Pacific Command told NBC News.

"North Korea's actions are a threat to our allies, partners and homeland," Pacific Air Forces Commander Gen. Terrence O’ Shaughnessy said in a statement. "Let me be clear, if called upon we are trained, equipped and ready to unleash the full lethal capability of our allied air forces."

Two U.S. officials told NBC News the show of force was intended to "send a clear message" to North Korea, ruled by the dictator Kim Jong Un.

NASA Says Pence Was OK to Touch Hardware Despite Sign

A photo of Vice President Mike Pence touching NASA hardware clearly marked "Do Not Touch" took off on social media Friday, inspiring scores of gags and memes.

The "Do Not Touch" signs in the vicinity at the Kennedy Space Flight Center "are there as a day-to-day reminder," but the "Critical Space Flight Hardware" in question was "absolutely okay" to touch, NASA told NBC News.

"Procedures require the hardware to be cleaned before tiles are bonded to the spacecraft, so touching the surface is absolutely okay," said NASA spokeswoman Jen Rae Wang. "Otherwise, the hardware would have had a protective cover over it like the thermal heat shield, which was nearby."

Pence played along with the viral moment, joking on Twitter that Sen. Marco Rubio, R-Florida, "dared" him to do it.

Two Separate Cases of Teens Robbed at Gunpoint in La Mesa

There have been two separate cases of teenagers being robbed at gunpoint in just a matter of weeks in La Mesa. The teens' parents understandably want the suspects caught.

It's a memory Jacob Patreo, and Brandon Green, both 17, won't forget anytime soon.

"One of them was just like, 'Alright, this is how it's going to go.' Then he showed the gun and he was like, 'You guys are going to empty your pockets and give us everything,'" said Green.

The two were waiting for friends in the afternoon on June 19 at Harry Griffin Park in La Mesa.

"Three guys came up to us and two we could see and then one was in a hood. They came up to us all friendly and stuff," said Green.

The three then circled the teens and one threatened them with a gun.

"My heart just dropped," said Patreo.

Both boys emptied their pockets and then they ran. Two of the suspects chased after Patreo. 

"They all followed me and held me down and started kicking me in the head and were kicking me and punching me on the ground," he told NBC 7.

This is one of two similar incidents in La Mesa over the last couple of weeks.  The other occurred Wednesday on the trolley near the Amaya Station where a 16-year-old was the target.

Green’s father said he is afraid if the suspects are not stopped, it may happen again.

"I would like to find these guys and catch them. Prosecute them if we can; get them off the street," said John Green.

All three victims describe the suspects as possibly in their teens or early 20's.  One had braids in his hair and another was significantly shorter than the other two.

The La Mesa Police Department is actively investigating both cases. Anyone with information is asked to call (619)667-1400.
