Che Cafe Eviction Suspended

The Che Cafe, the UCSD club with nine lives, has managed to elude closure again -- at least temporarily -- confirms both a university official and a member of the Che Cafe Collective.

The two organizations were engaged -- legally and otherwise -- since May 2014 over the site’s future. The school served an eviction notice on the collective on March 17, 2015. UCSD had 180 days to enforce the notice posted five days later. Members of the collective have been occupying the site around the clock since then.

The news on Thursday afternoon came after a pair of meetings in as many days between UCSD Chancellor Pradeep Khosla and members of the collective.

“The chancellor and vice chancellor agreed to suspend the eviction for 45 days while members of the collective and the university worked together to address the maintenance issues of the space,” said Che Café Collective member Susan Wingfield-Ritter, “and that’s also tied in to our historical site designation – we are going for recognition from the National Historical Register…. We are continuing to meet and will release a joint press release next week, the collective and the university together.”

UCSD spokeswoman Christine Clark confirmed that the eviction had been suspended for a period of 45 days.

The Che Cafe has been located at the venue for 35 years, but the iconic, mural-bedecked building was built in the early 1940s. Over the years, the Che has been the location of performance by such artists as Nirvana, Jimmy Eat World, Billy Corgan, Bon Iver, Bright Eyes and Green Day.

The school cited safety hazards and imminent, extensive repairs ordered by the campus fire marshal and an overall lack of current student interest in the club as primary reasons for putting the collective under the gun. For its part, the co-op went on the offensive in July of last year and sued the school for the "unlawful" termination of its lease and alleged collusion between the Graduate Students Association and UCSD to decertify the club.

Since the notice was posted back in March, several prominent artists came to the Che’s defense, including Pinback’s Rob Crow, EDM superstar Steve Aoki and former Rage Against the Machine frontman Zach de la Rocha.

Thursday’s news was welcomed by the students and other collective members.

“We’ll be meeting to talk about it on Monday – my understanding is that we don’t need to occupy the space,” said Wingfield-Ritter, who added that she thought the occupation would continue till the meeting next week.

The Che Cafe has seemingly always been a hot-button issue at UCSD and has faced existential crises before -- most recently in 2012, when the club fell behind on insurance payments and, in order to remain open, had to quickly raise $12,000, a story covered by San Diego CityBeat and the San Diego Union-Tribune.

Man Tries to Kidnap Ex, Bystanders Step in: PD

Witnesses to an attempted kidnapping stepped in to save a woman being pushed into a her ex-boyfriend’s car, according to the San Diego County Crime Stoppers.

National City police investigators are searching for Daniel Aguirre, 19, the lead suspect in the kidnapping attempt.

Police say the evening of July 1, Aguirre drove up alongside his ex-girlfriend as she walked in the 2200 block of Highland Avenue in National City.

The suspect got out, grabbed the woman, punched her in the face, and started to drag her toward his car, according to investigators,

Seeing in the woman in distress, many bystanders intervened and helped get the woman away from Aguirre, Crime Stoppers says.

That’s when Aguirre fled in his vehicle. While the car has been recovered by police, Aguirre is still at large.

He is described as a Hispanic man standing 5-feet-4-inches tall and weighing 135 pounds. He has black hair and brown eyes, and a tattoo of “M Street” sits on his right arm. Officials say he is known to frequent the Mid-City area.

Video of Deadly Gas Station Shooting Released

Surveillance video from inside a Clairemont convenience store shows the deadly confrontation between a concealed gunman and a customer shot during an April robbery.

The video, played in court, was part of the case brought against Ahmed Hassan Mumin, 30, by the district attorney in a preliminary hearing Tuesday. A judge determined there was enough evidence to bring Mumin to trial. 

In the video, 48-year-old Eric Schade is seen standing at the check-out counter of the AM/PM at Balboa and Mount Abernathy avenues, talking with clerk Jose Aguilar when a man walks in with a bandana covering his face.

Aguilar immediately puts his hands in the air and then puts the cash register drawer on the counter before ducking behind it, out of view. Schade and the intruder stand face-to-face for about 30 seconds.

“He was yelling, 'Get down!'” said Aguilar, the first witness to take the stand Tuesday.

Schade appears to try and grab the gun or swat it away moments before the gunman pulls the trigger.

“I stayed down," said Aguilar. "Periodically I’d look up to see what was happening. I hear a struggle, then a gunshot. I look up again and see the male is reaching for the money. I look down, and then I hear him leave the store.”

Aguilar identified Mumin as the shooter in court, saying even though he had a bandana covering his mouth and nose, it dropped during the robbery, allowing the clerk to get a look at the defendant's face.

Mumin, arrested two days later in a City Heights apartment complex, is charged with murder with a special circumstance allegation that the killing happened during the course of a robbery. He is also charged with burglary, robbery, possession of a firearm and ammunition by a felon and attempted murder of a police officer.

The last count stems from his April 18th arrest, when he allegedly shot at SDPD officers from inside a community room at the apartment complex where several family members lived. 

Two police officers fired back, and one bullet injured Mumin, who then surrendered. Several SDPD officers and detectives also took the stand Tuesday to talk about the details of the case and the arrest.

Chattanooga Gunman Was Not on Terrorism Radar: Officials

The gunman who opened fire on two military centers in Chattanooga, Tennessee, Thursday, killing four Marines and critically wounding a Navy sailor, was not in any federal terrorism database and was not under investigation before he carried out the rampage, several officials told NBC News.

Mohammad Youssuf Abdulazeez, 24, was killed after a shootout with police during the assault which began at a Marine recruiting station and ended at a Marine and Naval reserve center seven miles away, where the soldiers were slain, authorities said. It is unclear if the Kuwait-born Abdulazeez was killed by police or if he killed himself.

Federal authorities said they were investigating the possibility it was an act of terrorism, but have no evidence yet that anyone but a lone gunman was involved. Law enforcement officials say there are "indications" it may have been ISIS-inspired, but declined to be specific.

Thursday evening, law enforcement surrounded a home believed to be connected to Abdulazeez, and two females were seen being placed in handcuffs, The Associated Press reported. FBI Special Agent in Charge Edward W. Reinhold said they were not arrested, and it is common practice to secure bystanders when conducting searches.

Caitlyn Jenner Spotted at Del Mar Opening Day

Fresh off her ESPY win, Caitlyn Jenner donned a wide-brimmed hat to enjoy a day at the races at Del Mar's Opening Day, according to social media posts.

Visitors snapped pictures of Jenner dressed in a red and white wrap dress, hob-knobbing around the paddock Thursday afternoon. By her side was Joe Harper, the president and CEO of the Del Mar Thoroughbred Club.

She was part of the pomp and circumstance that kicked off the racetrack's 76th season.

Jenner came down to San Diego County from Los Angeles, where she was honored with the Arthur Ashe Courage Award at the ESPYs Wednesday night.

Her emotional, 10-minute acceptance speech, urging inclusion for all transgender people, received a standing ovation from the world's biggest sports stars.

Thursday marked the beginning of the Del Mar Thoroughbred Club's horse racing season, which runs through Sept. 7. The track is about 20 minutes north of downtown San Diego.

UCSD to Pay $30M for Trolley Naming Rights

University of California, San Diego is entering into a $30 million deal with the Metropolitan Transit System to dub the Mid-Coast Trolley Line the “UC San Diego Blue Line.”

The name change is a nod to the school’s campuses, medical center and facilities that all sit alongside the proposed mass transit route.

Along with naming the line, the school will get to name two new stations on its campus in La Jolla and one station in Old Town.

UC San Diego will pay MTS $675,000 for naming rights while the line is under construction. On the first year of trolley service, the fee will increase to $945,000. After that, the annual cost will increase with the local inflation rate with UC San Diego paying a total of $30 million over a 30-year period.

The Mid-Coast Trolley Line is a nine-stop extension to the Blue Line. Construction is expected to begin early next year, and rail service on the route will stretch from Santa Fe Depot downtown northward to University City. Along the way, it will stop at Old Town, two stops at UC San Diego, and the Veterans Affairs Medical Center, among other new stations. The route ends at the University Town Center Transit transit center. Rail service is expected to start four years after construction begins.

All funding for the sponsorship is from non-state sources.

U.S. Investigating Tenn. Shooting as 'Act of Terrorism'

The Chattanooga shooting is being investigated by the joint terrorism task force as an act of terrorism, U.S. Attorney Killian said at a press conference held Friday.

While it may be premature to speculate the shooter's motive, the FBI is still investigating whether the shooter acted alone, FBI said Friday. 

FBI also confirmed the shooter, Mohammad Youssuf Abdulazeez, had two "long guns" and one handgun and at least one of them were purchased legally.

"The suspected was not wearing body armor but he was wearing a load-bearing best to carry magazines of ammunition while moving on foot," Ed Reinhold with the FBI said. In addition, Reinhold confirmed Abdulazeez never left the fenced-in area of the military base where all four marines were killed.

At this time, officials have no indication that the shooter was inspired by or directed by "anyone other than himself" and while they will not confirm this was an ISIS-inspired motive, they will be exploring that option.

U.S. authorities are looking into a trip to the Middle East last year made by the gunman who killed four Marines in attacks on military centers in Chattanooga, Tennessee, NBC News reported.

Abdulazeez left the United States in April, returned in November and traveled through Jordan.

Consumer Reports is warning parents that laundry detergent pods should never be used in homes where young children live of visit. 

Over the last several years, Poison Control Centers have fielded an increased number of calls about children eating, inhaling, or getting the laundry detergent serum on their skin.

However, Proctor and Gamble, the maker of the Tide, Gain, and Ariel laundry pods, has said the number of reports involving its pods is falling relative to sales and that most calls resulted in minor to no medical treatment actually, according to "Today."

N.H. Sisters on a Presidential Selfie Mission

Taking a selfie with @PrezSelfieGirls has become a must-do for candidates campaigning in New Hampshire.

Take Thursday at Donald Trump’s rally in Laconia, when his staff shepherded Addy and Emma Nozell over and introduced the sisters from Merrimack with, “These are the girls.” 

“He knew about us,” said 17-year-old Addy. “He was ready to take that selfie.”

Since the first spur-of-the moment photo with New Jersey Gov. Chris Christie at the beginning of the month, the girls have collected 15. Their goal: all of the presidential candidates. 

“We started off as a joke,” Emma, 15, said, “and then Addy decided why not get everyone.”

Next up: Marco Rubio on Monday when he will be in their hometown. Still to come are Hillary Clinton, Jim Webb and Bernie Sanders among the Democrats and Ted Cruz, Mike Huckabee, Rick Santorum and Rand Paul among the Republicans.

Sanders might be tough because of the crowds, said their mother, Wendy Thomas, the executive director of The New Hampshire Challenge, an organization for families with disabilities.

The girls listen to the candidates’ speeches either before or afterward, and they are particularly interested in their views on education and on the Middle East. One of their brothers is at Norwich University, a military school in Vermont.

“The girls are really paying attention when they hear the candidates talk about increasing the military,” their mother said.

Addy will turn 18 in time to vote in the general election, and the girls said they are often the only young people at the candidates’ events. Their friends do not pay as much attention to politics as they do.

Thomas said she and her husband, Marc Nozell, have been taking the girls to candidate events since they were babies. Nozell, who works at HP, takes photographs as a hobby, lots of political ones among them.

“If you live in New Hampshire what a fabulous, fabulous opportunity to see these people and listen to them,” Thomas said.

Now, she said, “Kids are getting involved because of these selfies.”

Marine Killed in Tennessee Attacks Was Iraq War Vet

One of the four Marines killed in Thursday's attacks on two military centers in Chattanooga, Tennessee, has been identified as a decorated Iraq War veteran from Massachusetts.

Forty-year-old Sgt. Thomas Sullivan grew up in the East Forest Park section of Springfield. His brother and grandmother confirmed Sullivan's death in posts to their Facebook pages, NBC News reported.

Sullivan's family told The Springfield Republican that he served two tours of duty in Iraq and earned a Purple Heart. According to his Facebook profile, Sullivan had served in the Marines since 1997 after graduating from high school.

His parents live in Hamden.

In a statement, Springfield Mayor Domenic Sarno said Sullivan's death "is a tragic loss not just for the Springfield community, but for our entire nation."

Nathan Bill's Bar & Restaurant, which is owned by Sullivan's brother, paid tribute to the Marine on its Facebook page.

"He was our hero and he will never be forgotten. Please keep his family & friends in your thoughts & prayers. Thank you Tommy for protecting us," the post said.

John Bobrowski, a professional window washer in Springfield, stopped by the restaurant Friday to clean the windows of the business.

He did not know the family but said he wanted "in my own way" to give his condolences to them over their tragic loss.

"I was on my way to the next job site and I felt that I wanted to come in and pay it forward," he told necn.

Sullivan and three other Marines killed in the attack were identified Friday afternoon by the Marines as Staff Sgt. David A. Wyatt of Burke, North Carolina; Sgt. Carson A. Holmquist of Polk, Wisconsin; and Lance Cpl. Squire K. "Skip" Wells of Cobb County, Georgia. 

A Navy sailor was critically injured in the attacks. 

The gunman, 24-year-old Mohammad Youssuf Abdulazeez, was killed in a shootout with law enforcement during the attacks, which started at a Marine recruiting station and ended seven miles away at a Marine and Naval reserve center, where the soldiers were killed, according to authorities.

A motive in the attack was unclear but the FBI is investigating a blog that may provide some clues. According to the SITE Intelligence Group, Abdulazeez posted three days before the rampage that "life is short and bitter" and the Muslims should not let "the opportunity to submit to Allah ... pass you by." The blog has not been confirmed by NBC News. Law enforcement officials said there are "indications" it may have been ISIS-inspired, but declined to be specific.

Massachusetts Gov. Charlie Baker has ordered all flags at half staff beginning at sunrise Friday.

In a statement, Baker said, "The senseless violence that occurred in Tennessee is a terrible tragedy made worse by the fact that the brave individuals whose lives were taken answered the call to serve and protect our nation. Today, our hearts and prayers are with the wounded as we wish them a full recovery and our hearts are with the loved ones left behind by the heart breaking loss of four American patriots."

NECN was able to confirm that Sullivan spent time as a Marine recruiter in South Boston.

Meanwhile, the Department of Homeland Security is stepping up patrols at certain federal facilities. In Massachusetts, according to The Boston Herald, local and state police as well as the National Guard are remaining alert to any threats.

However, the National Guard tells necn protection measures remain in effect following standard procedures at this time.

The Herald says Boston police officers are being reminded to be vigilant while going about their work.

A Massachusetts National Guard spokesperson told the paper they are reminding their staff to be aware of their surroundings at all times. There are more than a dozen recruitment centers in the state and they are open to the public.

As for state police, they tell the Herald troopers are looking at all intelligence for possible or credible threats here and have not detected any at this time.

This Command Can Cause Siri to Call 911

If you need to charge your iPhone, it's probably best not to ask Siri.

Some users have discovered that asking Siri to "charge my phone 100 percent" will result in a five second delay before automatically calling 911 services, according to CNBC.

While this could cause problems to users who simply want their phone on full power, others have said the feature may come in handy during times of trouble.

It is unclear whether the function is intentional by Apple or a glitch in the system, according to NBC News.

Sandy Bland's Family Disputes 'Depression' Reasoning

The family of the woman found dead in a Texas jail said Friday that a video from March in which she talked about battling depression does not tell the whole story. 

On Thursday, a prosecutor said that the video from earlier in the year suggest Bland "may have been suffering from some sort of mental illness" which, lead to her apparent suicide. 

But the 28-year-old's family claims Bland "may have used the term 'depression,' but that statement in March had very little to do with her mindset" before she died, the family's attorney, Cannon Lambert Sr., said on MSNBC on Friday. 

Bland was found hanging in her jail cell on Monday, days after she was arrested for allegedly assaulting a police officer during a traffic stop. An autopsy on Bland's body on Tuesday ruled her death a suicide by hanging, a spokeswoman told the Chicago Tribune.

She was upbeat and looking forward to her new future in Houston, where she had just moved for a new job at A&M University, her sister, Sharon Cooper, told MSNBC on Friday.  

Lambert told MSNBC that authorities are trying to conflate the circumstances of Bland's death with what she may ahve said about depression in her past. In the video, which was uploaded to Facebook and confirmed by her family, Bland says: "I want you guys to know that I am a human, and so if there are any of you that are dealing with those same things, depression and post-traumatic stress disorder— it's OK."

Dolores Brings Muggy Weather to San Diego

Hurricane Dolores will bring a swath of humid air and cloud coverage to Southern California this weekend.

Saturday, it will be cloudy and feel muggy, but with much warmer temperatures.

Coastlines will climb into the 80s, with inland areas into the 90s.

Humidity will make it feel even warmer, and may increase the risk of heat related illness, primarily in the inland areas.

We have a 30% chance of scattered showers and thunderstorms across the county, with a 50% chance in our local mountains. With the exception of a pop up thunderstorm, most rainfall totals will be below a tenth of an inch.

A thunderstorm could produce heavier rainfall rates and runoff.

Because of the chance along the coast, the National Weather Service has issued a Beach Hazards Statement for elevated surf, strong rip currents and the possibility of lightning strikes.

Beachgoers are encouraged to swim near lifeguards, and be extra cautious of incoming storms.

“Keep your eye to the sky. Head indoors, if thunder roars,” said Meteorologist Jodi Kodesh.

It will be like this all weekend. We retain a slight chance of a shower or thunderstorm, Monday morning.

Weather returns to a more normal pattern next Tuesday.

Padres Unveil New All-Star Game Logo

Next year will mark the first time Petco Park will host the MLB All-Star Game, and the Padres unveiled the new All-Star Game Logo Friday morning to a lot of enthusiasm.

An all-star crowd turned out for the unveiling, including San Diego Mayor Kevin Faulconer, Padres Executive Chairman Ron Fowler, Padres President & Chief Executive Officer Mike Dee, Padres legend Randy Jones, and Baseball Commissioner Robert D. Manfred, Jr.

“We’re excited to welcome fans and players alike to Petco Park for the first time in All-Star Game history. San Diego has a long history of hosting premier sporting events, and working together with the Padres and Major League Baseball. We’re ready to showcase San Diego to the world,” Faulconer said Friday morning.

The logo’s diamond shape represents Petco Park’s central location in East Village, and includes the historic Gaslamp Quarter Archway with palm trees and a blue sky. The Padres blue and white includes bits of grey and yellow to reflect the Navy and San Diego’s sunny weather.

This will mark the third time the Padres have hosted the All-Star game to be held on July 12, 2016 in Petco Park. The Padres previously hosted the event in 1978 and 1992, but not at Petco Park, as the current ballpark opened in 2004.

“Major League Baseball is excited to work with the Padres and local officials as we bring the fans of San Diego our 87th All-Star Game next July 12th at Petco Park. San Diego is one of our game’s most spectacular cities, and as such, it promises to be an outstanding host of the summer’s greatest sporting event,” Commissioner Manfred said.

Padres officials said they believed the event will be "impactful" for the city of San Diego.

“As we begin the countdown to the 2016 All-Star Game here in America’s Finest City, we look forward to working with Major League Baseball and the city to create an unforgettable All-Star experience for baseball fans and for the entire community. The next year promises to be not only exciting, highlighting San Diego on a national and international stage, but also impactful, as MLB’s community legacy projects will leave a lasting impression here," Padres Executive Chairman Ron Fowler said during the event.
 

PD: Man Steals High-End Watch From Macy’s Store

The San Diego Police Department released surveillance photos Friday of a man accused of stealing a high-end wristwatch from a department store after posing as an interested customer and trying on the watch.

According to police, the heist happened at around 8:45 p.m. on July 6 at the Macy’s department store at Westfield University Towne Center (UTC). The suspect acted like he was interested in purchasing a Gucci watch and a sales clerk in the jewelry department allowed him to try it on.

Once he had the watch on his wrist, the suspect ran out of the store before the clerk could stop him.

Police said it appears the suspect had been casing out the store’s watch display before the robbery. Investigators said the unknown man was caught on surveillance video the day before the crime looking at the watches.

Anyone with information on the identify of this suspect should contact the police department.

Probe Into Sandra Bland's Death

As investigations continue into the death of a suburban Chicago woman inside a Texas jail, the district attorney in Waller County, Texas, said her death "will not be swept under the rug."

Sandra Bland, 28, of Villa Park, was found hanged in a cell in the Waller County Jail in Hempstead, Texas, on Monday. Bland traveled from Chicago to Texas last week and was scheduled to begin a new job at a local college. 

Three days before her death, Bland was charged with assaulting a peace officer after an altercation during a routine traffic stop, which landed her in jail.

During a press conference Friday, Waller County District Attorney Elton Mathis said video footage of the hallway outside of Bland's cell did not show anyone entering her cell before her death. There is no video footage taken inside the cell, however.

It took jail officials about an hour and a half to find Bland after she died in the cell, Mathis said.

The videos showing the hallway outside Bland's cell and footage of the traffic stop that led to her arrest will not be released until the FBI inspects them.

As Mathis addressed the press, more than 100 people gathered outside the Waller County Jail on Friday as friends and family of Bland's questioned the official account of how she died. Family members said they were shocked by her death and do not believe Bland would commit suicide.

"There is nothing we are going to hide, we are going to get justice for Sandra Bland," Mathis said.

California Leads U.S. in Campaign Donations

California leads the nation in the amount of money being contributed to the 2016 presidential election according to official filings released this week.

California outranks New York and Florida and leads the states with $12.7 million in contributions made between January 1 and June 30.

The total cost of the 2016 presidential election is expected to reach an unprecedented $5 billion, according to MapLight, a nonpartisan research organization that tracks money’s influence on politics.

In the July 15 filings, candidates had to report to the Federal Election Commission (FEC) how much money their campaigns have raised.

The outside donor groups, like single-candidate super-PACs, will be filing with the FEC on July 30.

1 Arrest as Protesters Mark Year Since Death of Eric Garner

At least one protester was arrested Friday amid several demonstrations that were planned for the one-year anniversary of the death of Eric Garner -- the Staten Island man whose death after being placed in a chokehold by police was recorded on amateur video and spurred protests nationwide.

Hundreds of people were at a protest near Columbus Circle Friday evening. At least one person was arrested outside Central Park as protesters chanted, "Shame! Shame! Shame!" News 4 New York video of the arrest shows a man being handcuffed and taken away by police as protesters surround them.

"The one's responsible for Eric Garner's death are free, walking the streets, and there was the non-indictment," one protester said. "That is wrong." 

Demonstrators planned to march again to mark the anniversary, with marches, rallies and vigils planned on Staten Island and in other parts of the city.

The solemn day began with Garner's youngest daughter, Legacy Miller, and her mother, Jewel Miller, releasing doves in front of the Tompkinsville store where Garner had his fatal confrontation with officer Daniel Pantaleo on July 17, 2014. Video of the altercation showed the heavyset Garner shouting "I can't breathe!" repeatedly after being brought to the ground in front of the store. He lost consciousness and was pronounced dead a short time later. 

One group rode the Staten Island Ferry to mark the anniversary, while another announced plans to block off traffic in Columbus Circle -- a common practice across the city during the intense protests in the days following a grand jury's decision in December not to charge Pantaleo with a crime in Garner's death. Pantaleo had no comment Friday. 

The anniversary comes days after New York City settled a civil suit filed by Garner's family for nearly $6 million. Garner's family said that the civil agreement wasn't a victory and they will continue pressing for federal civil rights charges. 

The U.S. Justice Department and the U.S. attorney's office in Brooklyn are investigating whether there is evidence to warrant charges that the officer deliberately violated Garner's civil rights. Such cases are rare after grand jury inaction or acquittal at state level.

Pantaleo, meanwhile, has not been on active duty in the year since Garner's death and remains under an internal affairs review. The NYPD is refraining from making any decisions on Pantaleo's future with the department until after the federal probe has been completed. 

Pantaleo's attorney declined to comment on the anniversary.
