SUV Smashes Through Miramar Restaurant

A Miramar restaurant was left in shambles after an SUV smashed through the front window Saturday night, San Diego Police Department said.

The owner of Soto's Mexican Food in the Miramar Village Shopping Center told SDPD a 2015 Mercedes SUV crashed into the restaurant just before 7 p.m. The impact also broke the glass from the store next to the restaurant.

Police believe the driver may have accidentally stepped on the gas pedal.

Employees were inside at the time but no one was injured. The driver stayed at the scene and was not arrested, SDPD said.


Police Search for Person Who Crashed Stolen Van

Escondido police are searching for the person who crashed a stolen van into a carport early Sunday morning.

Witnesses reported seeing a man run away from the 1000 block of West El Norte Drive shortly after 1 a.m. right after the crash, according to Escondido PD. No description of the driver was given.

No injuries were reported.

Victim IDed in Jenner Crash

As the investigation into Saturday's fatal four-vehicle crash on Pacific Coast Highway focused in on whether there was any criminal intent, authorities Sunday released the victim's name.

Kim Howe, 69, of Calabasas, died when her Lexus veered or was pushed into oncoming traffic just after noon on Saturday, Feb. 7, in Malibu near Corral Canyon Road, Los Angeles County Sheriff's Department Sgt. Philip Brooks said.

The department is investigating the fatal traffic collision, gathering cell phone records and conducting interviews, Brooks said.

Howe rear-ended a Toyota Prius, and was then hit herself by reality TV star Bruce Jenner's SUV after Howe's car hit a Prius, Brooks said. For a reason that's still under investigation, Howe's car was pushed into the southbound lane of PCH, where it was hit by a fast-moving Hummer.

If any of the drivers, including Jenner, are found to have acted with "criminal intent," they could be charged with vehicular manslaughter, according to Brooks.

None of the drivers are being investigated for vehicular manslaughter so far, he said.

Deputies have asked for the drivers to turn over cell phone records to detectives, Brooks said. If they don't comply, they may seek a warrant for the records.

Jenner was cooperative with the investigation, taking and passing a field sobriety test as well as voluntarily giving blood for more testing, deputies have said.

San Diego Woman Falls Off Maui Cliff

A San Diego woman visiting Hawaii was airlifted to a hospital after falling about 25 feet off a cliff in Maui Saturday afternoon.

The 68-year-old woman had been hiking with friends when she fell onto the rocks below, according to the County of Maui's Department of Fire and Public Safety. Firefighters found her laying on the shoreline below a trail that leads to Red Sands beach.

Firefighters placed the woman in a rescue basket and used a Maui Fire Department helicopter to airlift her to Maui Memorial Medical Center. The woman had serious injuries to her head, arms and hips, according to officials.

About an hour later, that same helicopter was redirected to Waihee to assist in the rescue of a local man who was found exhausted on the shoreline off of Kahekeli Highway.

Three divers who were spearfishing spotted the man waving for help. The 41-year-old man was found at the bottom of an estimated 100 foot sheer cliff. The divers were able to call 911 with a cell phone they had with them in the water.

Two rescue firefighters were sent by long line from the helicopter to get to the man. He was placed in a rescue blanket and airlifted to a landing zone set up on Kahekili Highway. He was then taken to Maui Memorial Medical Center via ambulance.

The man only had minor injuries but he told firefighters he had been stuck at the bottom of the cliff since Friday.

The names of the two victims have not been released.

Suspect in SF Body Parts Case Dead

Mark Andrus, the 59-year-old man arrested and later released on suspicion of murder in the grisly case of a dismembered body found in a suitcase in San Francisco, died Saturday, the San Francisco Public Defender's Office confirmed Sunday.

On Saturday, the San Francisco Police Department would not comment on the death, stating only that "Mr. Andrus is a free man," and is "not in police custody."

However, Adachi was aware of his death, which has yet to be explained, saying in a statement that in the short time he know Andrus, he found him to be a nice and "engaging" man.

The San Francisco District Attorney's Office said last week there was insufficient evidence to charge Andrus on suspicion of murder in the case.

Andrus was arrested on Jan. 30 and booked at the San Francisco County Jail. After his release from jail Tuesday, he was escorted by Jeff Adachi, his public defender. Adachi said that since Andrus did not have a place to live, his office would be helping him find a place to stay. "We will help place him in a hotel," Adachi said. "We will assist him with re-entry — he's been in jail three to four days."

Officers detained Andrus last month at the Sala Burton Manor apartment building, located at 430 Turk Street, less than a mile from where the suitcase with a headless human torso was found Police said they received a tip from an anonymous caller reporting that the person of interest in a photo SFPD released Friday was staying at the apartment building.

The suitcase was found on 11th Street near Market, just one block from Twitter's headquarters. Police then made another gruesome discovery shortly after when they uncovered more body parts within a three-block radius.

The San Francisco Chief Medical Examiner's office confirmed the human body parts were those of an unidentified light-skinned male. The medical examiner is still working to identify the victim.

Police and the District Attorney's Office said last week they would continue to investigate the case and work to find information that proves a link between Andrus and the body in the suitcase.

Business Buries Woman's Car in Snow

As if nature hadn't dropped enough snow on New England so far this year, one Boston resident says that a local business is making a difficult winter much worse for her.

Amanda Duquette says that multiple times this season, the owner of South Boston Auto Car & Truck Repair has moved the snow from its lot onto her car, completely burying it.

Living in South Boston, Duquette is used to battling the snow and parking problems. But after leaving her car parked on East 2nd Street before the first storm, she says she returned a few days later to find her car gone.

"You couldn't even see it," she said. "I thought I'd been towed."

Duquette says the car was buried under a snow bank about eight feet high, left there, she says, by the business owner.

She says she has since cleared her car out multiple times, each time returning to find it reburied.

"He shouldn't be able to just do this and have people suffer through it," said Duquette.

Other neighbors say they have also witnessed the business owner repeatedly dumping snow from his property onto city streets, sidewalks and cars.

"Every storm, he does this," said Heather Ward. "It's not anything different."

A video taken by a neighbor purportedly shows someone snowblowing the snow onto the cars and sidewalks. Another video even apparently shows a shoveler moving snow neighbors say the company threw into the street. That shoveler appears to be moving the snow into a shoveled-out parking space.

Initial attempts to reach the business owner were unsuccessful. NECN eventually got in touch with him, and he denies the allegations.

Boston Public Works Commissioner Mike Dennehy says the city is aware of the situation.

"I'm familiar with the address," he said. "It's blatantly being pushed."

Dennehy says code enforcement has visited the business at least twice this winter, each time issuing a $200 fine. But he says, right now, that is the only action they can take.

"Barring parking an officer there and waiting for them to try tomorrow when it happens again, I don't know if there's any recourse that we can do."

Mayor Walsh tells NECN that it is the first station to be made aware that he is looking to address the situation. He says he met with his policy committee this week and is trying to figure out ways to increase those fines.

Hernandez Trial Delayed Due to Snow

Court proceedings in the murder trial against former Patriots tight end Aaron Hernandez were cancelled Monday and delayed until 1030 a.m. Tuesday, the Massachusetts Supreme Judicial Court confirmed.

Approximately two feet of snow blanketed New England from Sunday to Monday.

Hernandez is charged with the murder of Odin Lloyd back in 2013.

3 SoCal Lotto Tickets Worth Millions, But Not $380M

A $14 million lotto ticket was sold Saturday, one of three big winners across Southern California on a day where many played the lottery looking to win many millions of dollars, according to the California Lottery.

While no one hit the $380 million jackpot available in Powerball, three tickets were sold that were worth at least $1.3 million, Lottery officials said.

Two players in Los Angeles and Norco came close to splitting the jackpot, matching five of six Powerball numbers. Their tickets, which haven't yet been claimed, have a pretax value of $1,388,464.

The next Powerball drawing is Wednesday night. The pot is estimated at $450 million, making it the fifth largest jackpot in U.S. history and the third largest in Powerball history.

Those two winning tickets pale in comparison to the $14 million Super Lotto Plus winner sold Saturday at a Glendale doughnut shop, according to the lottery. They matched six numbers in the game, making whoever claims the ticket eligible for $9.5 million in a lump-sum payment or the entire amount over 30 years.

The $14 million payout was a boom for the shop that sold the winning ticket, which wins a small bonus payout for itself.

When lottery officials broke the news to Hovik Cholakian, the shop's owner, he screamed with excitement, according to the lottery news release.

"This is my first big win. I'm very excited," Cholakian told the lottery. "We work very hard, 12-13 hours a day, seven days a week. Having $70,000 (come in) is a lot of money for us!"

Local Artists Get Big News on Grammy Night

Three San Diego musicians took home awards at the 57th Annual Grammy Awards in Los Angeles at the Nokia Theatre Sunday evening.

The Recording Academy started to release the winners of nearly 70 non-televised categories at 12:30 p.m., hours before the awards ceremony was set to begin.

Nominated for three awards, Nickel Creek mandolinist Chris Thile was up for Best Contemporary Instrumental Album and Best Engineered Album Non-Classical for his recent collaborative album with bassist Edgar Meyer, "Bass & Mandolin." The duo were also nominated for Best Instrumental Composition for their song, "Tarnation." They lost that category to John Williams for "The Book Thief," and lost to Beck in the Best Engineered Album Non-Classical category for his 2014 album, "Morning Phase." However, Thile and Meyer didn't go home emptyhanded -- they took home the trophy for Best Contemporary Instrumental Album.

Thile and Meyer's win unforunately shut out a couple other San Diego artists also in the running in that category: World-renowned bassist Nathan East -- who holds a Bachelor of Arts degree in Music from UCSD and has recorded or performed with Eric Clapton, Michael Jackson, Phil Collins, Stevie Wonder, George Harrison and Daft Punk (among others) -- was up for the award for his 2014 solo self-titled debut full-length, as well as Mindi Abair for her "Wild Heart" album -- on which San Diego drummer extraordinaire Jake Najor performed [read our SoundDiego interview with Najor]. 

Also getting in on the winner's podium on Sunday was former San Diegan Gregory Porter, who guested on Dianne Reeves' "Beautiful Life" album -- which won the award for Best Jazz Vocal Album. SoundDiego jazz blogger Robert Bush also noted that guitarist/composer Peter Sprague contributed to Reeves's album as well, with a co-writing credit on one of the songs on "Beautiful Life."

Nickel Creek, who originally hail from North County, were in the running for Best Americana/Roots Performance for their single, "Destination," and Best Americana Album for "A Dotted Line." They lost to Roseanne Cash for both: Her song, "A Feather's Not a Bird" took Best Americana/Roots Performance, and her album, "The River & the Thread" won Best Americana Album.

The category for Best World Music Album was also rich with artists with local ties. Anoushka Shankar, Ravi Shankar's daughter and half-sister to Norah Jones who grew up in Encinitas, was nominated for her 2013 release, "Traces of You," and Carlsbad resident Wu Man was nominated for "Our World in Song" for her collaboration with Luis conte and Daniel Ho. Both lost to Angelique Kidjo and her album, "Eve." 

"Juke Joint Chapel," the most recent album by famed blues harmonica player Charlie Musselwhite was up for Best Blues Album -- but lost Sunday to Johnny Winter's "Step Back." Musselwhite's album was produced by Chris Goldsmith, who works at the Belly Up and is already a multiple Grammy Award-winning record producer. He's also worked with Blind Boys of Alabama, Aaron Neville, Chrissie Hynde and Ben Harper -- and spearheaded the Belly Up's recent foray into the online music merchant market, with their Belly Up Live series [read our article about it here].

Artists with local ties were also recognized in some of the jazz categories, including 2013 San Diego Music Awards Artist of the Year Gilbert Castellanos, who, as part of the Clayton-Hamilton Jazz Orchestra, was nominated for "LA Treasures Project" in the Best Large Jazz Ensemble Album category. They lost to Gordon Goodwin's Big Phat Band and their album, "Life In the Bubble."

Man in Custody After Running From Police

A suspect is in custody after he ran from officers in Tierrasanta, police said.

An officer was conducting a field interview around 10:30 a.m. Monday on the 10200 block of Sample Street with an adult male, officials from the San Diego Police Department said, when a man fled from the officer on foot.

A search on air and on foot was launched for the man, who was found hiding in the area.

No schools were on lock down and there was no word on why he was wanted. There were no reported injuries.

Man Holds Hotel Employees Hostage With Steak Knife

Two suspects were held at knife point for a brief period of time early Monday at a Best Western Lodge, police said.

Around 8:30 a.m., Carlsbad Police Department officers received a report of a man who had tried to burglarize a motel room at the Carlsbad Inn on Carlsbad Boulevard.

The suspect, later identified as 29-year-old Abraham Ledesma-Gomez from San Diego, fled on foot across the street to the Best Western Lodge before officers arrived at the Inn.

He entered the Lodge and confronted two of their employees, ordering them into a back office as he held a steak knife with a four inch blade at them, police said.

The man threatened to kill the employees if they made any noise while held at the back office adjacent to the lobby.

Gomez exited the office and walking into the lobby shortly after, where police detained him at gunpoint.

"He did yell at the officers that he wanted them to shoot him but the officers quickly took him into custody and he was uninjured," said Jodee Sasway, Public Information Officer for the Carlsbad Police Department.

Police took him into custody after he physically resisted arrest and recovered the knife he used to threaten the employees.

Gomez was on state parole at the time of this offense. He is in custody and will be booked into the Vista Detention Facility Monday for kidnapping, assault with a deadly weapon, burglary and a parole violation.

There were no injuries to the victims, officers or the suspect.

The investigation into the incident is ongoing, though the police department does not believe there are any outstanding suspects related to the incident.

Avoid Drinking Mount Laguna-Area Water

If you live in the Mount Laguna area, you might want to avoid drinking the water.

Water in the Mount Laguna area tested positive for E.Coli, which means it might be contaminated with human or animal waste, The County of San Diego, Department of Environmental Health said.

The county issued a boil water order for the Mount Laguna water system located on the Sunrise Highway. The boil water order will remain in effect until lab tests confirm the bacteria is gone.

The water system affected serves the Desert View Picnic Ground, Red Tailed Roost, Sierra Club Lodge, Camp Ole Fire Station, and the Visitor Information Center with public restrooms and the Wooded Hill, Horse Heaven, El Prado, Yerba Santa, Laguna, and Burnt Rancheria campgrounds.

SeaWorld Penguins Part of Proposed Dive Study

Several penguins at SeaWorld are acting as test swimmers for a dive study proposed by a San Diego penguin expert.

Dr. Paul Ponganis, a penguin expert at the Scripps Institution of Oceanography at UC San Diego, has been attaching cameras to emperor penguins living at SeaWorld’s Penguin Encounter.

The study Ponganis is proposing would strap similar cameras to the ones SeaWorld penguins have now to wild emperor penguins in Antarctica.

The proposal is awaiting a grant from the National Science Foundation. If approved, Ponganis would attach backpack cameras to emperor penguins in the wild and collect data from that footage.

To prepare for the experiment in the wild, he is attaching similar cameras to emperor penguins at SeaWorld and examining how he swims with the cameras and making sure the footage captured is useful. The footage captured so far, SeaWorld said, has been successful and Ponganis plans to include the footage in his grant proposal.

The emperor penguins Ponganis wants to study are the largest of the 18 penguin species. They weigh up to 90 pounds and measure up to nearly 4 feet tall. They can dive for 10 minutes and stay under water for almost 30 minutes, longer than any other bird.

In frigid water, they can dive up to 1,500 feet deep in frigid artic waters. SeaWorld has the only emperor breeding colony in the western hemisphere.

V-Day Sale: Newark, NJ Lots for $10

The city of Newark is offering couples who want to build homes municipally-owned lots for $1,000 in a "Valentine's Land Sale Day."

Buyers will be required to make a $500 down payment and pay the additional $500 at closing. They are responsible for all closing costs and must submit a site plan approved by the City Planning Board.

Couples interested in buying one of the lots in Newark's two Model Neighborhood initiative areas, a 20-block part of the Lower West Ward and a 30-block section of the South Ward. Both areas were granted additional police presence and other city resources as part of a crime reduction-initiative announced in November.

Prospective buyers must show a commitment letter from a financial institution and/or proof of cash to cover the cost of the new home construction before they can close, and that construction must be completed within 18 months after closing, the city said.

The couple also has to live on the property for five years after getting an occupancy certificate.

Newark Mayor Ras Baraka said the Valentine's Day land sale is a unique way to promote home ownership while benefiting the city.

"We are observing Valentine’s Day with creativity and a commitment to Newark’s couples, by offering them opportunities to achieve their American dream of home ownership," Baraka said in a statement. "At the same time, we are turning vacant lots into homes that strengthen our communities, replacing blight with development. Out-of-the-box steps like these are how we will transform Newark into a City we can all believe in."

Police Chase Through Logan Heights

The San Diego Police Department Gang Units are in pursuit of a suspect vehicle, police said.

Police are pursuing the suspect through Southcrest. The pursuit started shortly before 4 p.m.

The vehicle is driving up to 60 miles per hour in residential neighborhoods.

The chase began East of Interstate 15 in Central San Diego and is heading into Logan Heights.


Calif. Domino's Delivery Woman Kidnapped, Raped: Police

A 17-year-old boy has been arrested by Antioch police after a Domino's delivery woman said she was kidnapped and raped at gunpoint Sunday morning while on her route.

Antioch Police Capt. Tammany Brooks said he can't remember in all his time with the department ever handling a case where a delivery person had been sexually assaulted. He added that the 22-year-old woman also had been robbed during the brutal attack. He said the teen, whose name is not being released because he is a minor, and the woman did not know each other.

Domino's reacted swiftly to the news.

"We are shocked and horrified by what happened," Domino's vice president of communications Tim McIntyre said in an email early Monday morning. "We couldn't conceive of something like this happening, especially on a Sunday morning."

According to Antioch Police Sgt. Dimitri Barakos, the woman was making a delivery on the 2800 block of Blue Bell Circle at 11:20 a.m. when she was robbed at gunpoint. She was then forced back into her vehicle by the teen who made her drive to an undisclosed location where he proceeded to sexually assault her.

Afterward, the delivery woman called police, and the teen was arrested near the area where the original robbery happened.

The teen was booked into juvenile Hall in Martinez. Despite his being a juvenile, there are a series of violent crimes under California penal code 707 (b) that allow prosecutors to charge offenders as adults. However, by Monday afternoon, the Contra Costa District Attorney's Office had not yet received the case.

As for Domino's, McIntyre said his company stood behind his employee.

"We will be working with the franchise owner to provide the victim with whatever kind of support she needs," he said in his email. "It is unthinkable that something like this could happen to an innocent woman, simply trying to earning a living. We hope the person who committed this heinous crime is prosecuted and punished to the fullest extent of the law."

Chula Vista PD Kill Dog After Attack Sends 2 Men to Hospital

Two men were sent to the hospital after they were bitten by a dog Sunday afternoon, according to Chula Vista Police Department.

Police and firefighters arrived to the 2400 block of La Costa Avenue around 2 p.m. after reports of two men being attacked by their dog in their own yard, Chula Vista PD said. The dog had began to attack one of the men. The second man tried to pull the dog away and was also bitten.

Both men repeatedly attemped to pull the dog away, police said. Firefighters then stepped in to attempt and restrain the dog with emergency equipment.

The dog was then killed after police said it looked badly injured and in pain.

Both men were taken to a nearby hospital with several injuries from the dog bites.

High Surf Prompt Rescues Along San Diego Beaches

A high surf advisory was in effect for San Diego through Tuesday and lifeguards suggest swimmers and surfers use caution before getting into the water.

The high surf and tide prompted several rescues along San Diego County's beaches Sunday.

Around 2 p.m., a Good Samaritan in a nearby boat rescued two men who almost drowned near Bonita Cove in Mission Bay. The two men were in the water when they began to have trouble staying up, according to San Diego Lifeguards. The Good Samaritan spotted them and pushed over an inflatable boat towards the men. They were taken to UCSD Medical Center.

Hours earlier, around 9 a.m., San Diego lifeguards successfully rescued a surfer who was trapped in a cove at Sunset Cliffs due to the large surf. There were no injuries reported.

San Diego Lifeguards wanted to remind the public to only get in the water in areas with lifeguard supervision. As of now, Mission Bay, Sunset Cliffs, Windandsea are not supervised by lifeguards. They also advised parents to teach their young kids how to swim early on.

Newborn Girl Found Behind Wall

A homeless man is being credited with saving the life of an hours-old infant who was found crying in a patch of grass at dawn Sunday in Lakewood.

Mark Blevins said he heard a baby crying while he was scavenging for cans and food in a shopping center at Lakewood Boulevard and Hardwick Street.

When he found the girl, wrapped in a blanket, he didn't know what to do as the streets were empty at that the time of the morning.

"I was scared," Blevins said.

He went to his friends at their homeless encampment for advice. He hopped on his bike, cradling the newborn in his arm as he rode to a nearby fire station. Firefighters took the girl to Long Beach Memorial Hospital to be checked, deputies said.

Detectives went to the area where Blevins found the baby and that's where they met the infant's mom, who told detectives she helped deliver the baby.

"She appeared to be coming back to check on the baby," said Victoria Virosteck, who is also homeless in the area and has seen the woman who deputies believe is the mother.

The 35-year-old mother is now receiving medical and psychiatric care.

"Maybe she didn't even realize she was pregnant and then she started to give birth," Virosteck said.

Man Burned When E-Cig Explodes: Officials

A San Diego man was rushed to a nearby burn unit after his electronic cigarette exploded Saturday, Cal Fire officials confirmed.

The man was inside Stage Stop Liquor store in Ramona when his e-cigarette exploded.

The blast not only injured the man but also shattered glass inside the store according to a Cal Fire spokesperson.

He was taken to UCSD Burn Center. No word on his condition.

Cal Fire officials say they don't know what caused his e-cigarette to explode.

However this isn’t the first time an e-cigarette user has been injured in an explosion.

E-cigarettes heat liquid nicotine into inhalable vapor without the tar and other chemicals found in traditional cigarettes.

Two weeks ago, the FAA issued a safety bulletin suggesting airlines ban passengers from putting e-cigs in their checked baggage after two recent incidents where it's believed the devices sparked fires in the baggage holds of airplanes.

Part of the FAA statement blamed the potential risk from a growing trend of users using after-market batteries or other components on their heating elements. So the agency suggests passengers pack e-cigarettes in their carry-on baggage.

One local vape shop owner told NBC 7 he’s never seen the products injure anyone and often tests the electronic cigarettes for safety.

“I like to run my things at very extreme temperatures to make sure that like if something does go wrong we don't put it on the market,” said Marlow Younan, owner of Vape Lounge. “I've had zero problems and nothing but great reviews."

“I've never seen a situation like that where something has exploded I mean it is an electronic device. If you don't take care of your electronic devices things can happen,” said Younan.
