Woman Dies In Collision with Border Patrol Vehicle

A woman died after her vehicle collided with a U.S. Customs and Border Protection vehicle at a South Bay intersection Tuesday night.

Officials say the woman ran a red light around 9:10 p.m. at the intersection of Olympic Parkway and Brandywine Avenue in Chula Vista.

The woman’s 1996 Toyota RAV-4 traveling northbound on Brandywine collided with a U.S. Border Patrol agent who was making a left turn.

Emergency crews had to cut the roof off the woman’s SUV to pull her from the wreckage. She was taken to Scripps Mercy Hospital with what was described as major injuries.

She was later pronounced dead. Officials have identified her only as a 53-year-old woman from San Diego.

The Border Patrol agent was taken to the hospital for observation with minor injuries.

Investigators say they do not believe alcohol was a factor in the collision.
 


1-Year-Old Boy, Father Killed by Gunfire in Oakland

Three weeks after an 8-year-old Oakland girl was shot to death at a slumber party, a 1-year-old boy was gunned down Wednesday morning, earning him the newest, and most unfortunate, ranking of becoming the city's youngest homicide victim of the year.

The 1-year-old, who relatives were calling "Baby Drew," was pronounced dead at Children's Hospital, and his 20-year-old father died at the scene. No one was arrested and why the two were killed was unclear.

Konya Baylis, 33, the boy's great aunt, told NBC Bay Area off-camera the toddler's name was Drew Jackson and his father was Andrew Thomas of Fresno. Relatives said that  Thomas was in town for the funeral service a few days ago of another homicide victim - his cousin, 18-year-old Alquino Rivera, killed Saturday in the 800 block of Ney Avenue. Bey wondered aloud if the double homicide was related to Rivera's death.

Police have not commented on this possible connection.

Oakland police spokeswoman Johnna Watson said police were called out about 2:45 a.m. in the 400 block of Ghormley Avenue in the Brookfield Village neighborhood of East Oakland after hearing reports of gunfire. They found the young father and baby suffering from gunshot wounds inside the house. Paramedics rushed in to try to save them, to no avail.

“This is incredulous that people are shooting and killing kids in their sleep,” Watson said.

Witnesses on scene told NBC Bay Area they heard six to eight bullets fired from the back of the house, which is near the 98th Street exit of Interstate Highway 880. Relatives said there was a house full of other people, including children when the gunfire rang out.

One relative was overheard saying that this killing was "intentional." But police did not confirm this.

Later in the morning, a stuffed teddy bear and dog lay at the base of a tree in front of the home, while police searched the home for clues.

Drew is the youngest of the 61 homicide victims iin Oakland this year. And his killing came hours after National Night Out celebrations wrapped up, where neighborhoods held block parties to get to know each other better and prevent violence.

Community members say they are fed up.

“The tipping point was a year ago when the first child got murdered,” Oakland Pastor Billy Dixon said. “The tipping point was 10 years ago when the murdering was out of control.”

On July 17, 8-year-old Alaysha Carradine of Oakland had earned the dubious title of being the city's youngest homicide victim.

The would-be third-grader was gunned down in the city's Dimond district, killed about 11 p.m. when she and her friend opened the door to a hail of gunfire. She had been sleeping over at her best friend's house that night and became Oakland's 54th homicide of the year at the time.

No one has been arrested in her death, either.

Obstacle Course Racers Deal With "Spartan Rash"

A number of amateur athletes who participated in an extreme obstacle course race in Marseilles, Ill., more than two weeks ago continue to deal with a severe rash that has spread across their bodies since the event.

Dubbed the "Spartan Rash," because the athletes appear to have contracted it during an event called The Spartan Race, it presents as blistering, red patches described as being very itchy and uncomfortable. Officials said they were continuing to investigate whether the rash was poison ivy, swimmer's itch or chiggers.

The Spartan Race is an obstacle course race. Obstacles have participants traversing through water and mud. The events are held around the country and around the globe throughout the year. The event in Marseilles was July 20.

"It sucks for those that are dealing with it," race director Mike Morris said in a statement released last week. "I think every racer understands the inherent risk of crawling through mud, swimming through swamp, and running through the woods but we still never want to see our racers leave the event and have the event stay with them like this."

On a Facebook page dedicated to the "Spartan Rash" that's collected nearly 200 followers, users have been sharing details of their experience and attempts at remedies.

"Training with this rash has been next to impossible as it causes me to sweat and itch like crazy," user Jesse Valdez wrote on the public group. "I did try the rubbing alcohol, witch hazel, oatmeal baths, tea tree oil but no help my rash spread over the weekend so my doctor sent me to the dermatologist. I can't wait for this to finally stop spreading and start to heal."

Officials with the Illinois Department of Health confirmed they're aware of the rashes but said they weren't in a position to offer guidance on the topic as of Tuesday afternoon. An official said the agency is still putting together a questionnaire to be completed by race participants.

UPDATE: The Illinois Department of Health's survey is now live. IDPH officials ask that everyone who participated in the race complete the survey, whether or not they're showing rash symptoms.

Yahoo! is Getting a New Logo

Yahoo! is changing its iconic logo for the first time in almost two decades.

For the next 30 days, until its unveiling on Sept. 4, the Internet search giant will feature a different logo on its home page. One of them will replace the current purple Y and exclamation mark.

Here is day one's logo:

The move is part of a makeover that has swept the company since former Google exec Marissa Mayer took the helm as CEO. Yahoo! has bought up more than 20 companies -- including Tumblr -- and revamped its existing lineup like Flickr and email.

A notorious workaholic, Mayer took the job when she was five months pregnant and took only a two  week maternity leave. She put an end to the company's lenient telecommuting policy, a move that was slammed by parents who wanted flexible working arrangements. 

In May, NBC Bay Area reported that the company expanded its company perks, giving parents more time off each time they have a child.

"Over the past year, there’s been a renewed sense of purpose and progress at Yahoo!, and we want everything we do to reflect this spirit of innovation," chief marketing officer Kathy Savitt wrote in a blog post. "While the company is rapidly evolving, our logo — the essence of our brand — should too."

Doc's Note Delays Depo in Filner Scandal

NBC 7 has obtained a note signed by an unidentified psychologist notifying the City Attorney’s Office that Robert Filner would not be available for a scheduled deposition in a pending sexual harassment case.

Special Section: Mayor Under Fire

The note explains that Filner is currently under the care of an intensive treatment program and will not be able to be questioned in the lawsuit filed by former employee Irene McCormack Jackson as scheduled on August 9.

“Obviously, Mr. Filner does not want to testify under penalty of perjury and will use every means to avoid having to do that,” San Diego City Attorney Jan Goldsmith said in a written statement. “He can delay it, but he can't stop it.”

The name of the doctor was redacted on the note however the illegible signature remains. It’s a flimsy clue into where Mayor Filner has entered a two-week behavioral therapy program.

NBC 7 has been told by several sources that the undisclosed location of the mayor’s rehab is in Los Angeles.

The mayor’s office has refused to divulge where the mayor is or what disorder he suffers from but has assured citizens the business of the city will continue despite his absence.

According to Goldsmith and the plaintiff’s attorney Gloria Allred the deposition has been rescheduled for Sept. 17.

Dead Shark Mysteriously Ends Up on Subway

A dead shark that mysteriously ended up on a subway train caused a stir among New Yorkers and forced an evacuation of the car early Wednesday.

A witness told NBC 4 New York that she boarded an empty car on the Queens-bound N train just after midnight at the Eighth Street stop in Manhattan.

Isvett Verde said the car "smelled extremely fishy," and when she looked down, she saw the sand shark.

"I mean, I thought I'd seen it all, but even that was a bit much," she said. "I have no idea how it got there or how long it had been there."

Verde said the shark continued to surprise passengers boarding the train as it rolled uptown.

The MTA said the conductor ordered riders out of the car at Queensboro Plaza, and when the train arrived at the end of the line, the shark was placed in a garbage bag and put in the trash.

The MTA said the car was inspected and returned to service.

There was no word on how the shark ended up on the train, which originated on Surf Avenue, in Coney Island.

"We don't know where it came from. We don't know how it got there," said Adam Lisberg, an MTA spokesman. "We assume it didn't get on on its own, it needed to be brought on by a human. Something's fishy about this." 

It is illegal in New York to own a sand shark as a pet or to bring it on a train, unless it's in a tank or proper container. But they are legal to eat, which is why they can be found at some city fish stores.

Subway riders remained both skeptical and shocked Wednesday about the unexpected commuter that took social media by storm. 

"It had to be a prank," speculated one man.

"It's crazy, man," said one young tourist. "It's the craziest thing I've ever seen."

Woman Says She Was Harassed on Flight for Breastfeeding

Breastfeeding advocates are rallying around a Laurel, Md. mom who said she was harassed on an American Airlines flight last month because she refused to cover her son while breastfeeding him.

A group of mothers held a "nurse-in" at BWI Marshall Airport Wednesday morning in support of the woman, an Anne Arundel County public school teacher who has asked to remain anonymous in order to avoid harsh reactions from her students' parents.

But a friend of hers posted the woman’s story on her Facebook page Sunday, along with a letter from American Airlines in response to the woman's formal complaint to the company after the incident.

As of Wednesday afternoon, the letter has been shared on Facebook more than 7,500 times.

"I feel sorry for all the nursing mothers and babies who have experienced this kind of shaming and discrimination," the woman wrote. "I worry that some other moms may have stopped nursing their babies just to appease another adult who has no business making them feel ashamed of nourishing their babies."

According to Hanna Butta's post, the incident occurred July 21. The woman and her husband were flying home with their five-month-old child.

After lift-off, the woman began nursing her son in order to keep his ears from hurting and stop him from crying during the flight.

"[A flight attendant] shook her head at me and gave me a very unpleasant look, like I was doing something very obscene," the woman told News4 Washington.

The flight attendant came back and asked the woman to put a blanket over her son because there were children on the flight, the post read. The woman’s husband said they preferred not using a blanket and the woman continued to nurse her son.

A few minutes later, the flight attendant returned again and told a young girl in the aisle seat next to the woman and her husband that she was going to move her back because she could have been feeling uncomfortable, according to the post.

The woman stressed in the post that it appeared the young girl didn't even notice the nursing. The flight attendant allegedly avoided her and her husband for the rest of the flight and never offered them drinks.

The woman filed a complaint on the American Airlines website, describing the flight attendant’s behavior as "inappropriate" and "harassment-style."

In its letter, American Airlines apologized but said they ask that anyone breastfeeding on an American Airlines flight to show "certain discretion and a sense of modesty."

"I think an appropriate response from American Airlines to my written concern would have been a sincere apology and a promise to address that employee’s behavior," she said. "Instead, I received a letter claiming to be an apology but was more like a justification for the flight attendant’s unprofessional actions."

In a statement to NBC Washington, American Airlines spokeswoman Andrea Huguely said,
"To clear up a misunderstanding, American Airlines has always allowed mothers to breastfeed during flight. The approach our flight attendants take is to ensure breastfeeding mothers have the privacy they wish to have, while also ensuring the comfort of our other passengers.

"We apologize to the breastfeeding mother who was offered a blanket during a recent flight by a well-intentioned flight attendant. The intent was to make everyone onboard comfortable, including the unrelated 12-year-old sitting in the same row."

Huguely also acknowledged that the company's letter should have used language closer to that in flight attendant manuals, which state that the "breastfeeding of infants is permitted during all phases of flight" and "F/A’s should not place restrictions or requirements on the mother of the infant."

American Airlines representatives also sent the woman a travel voucher.

Man Fatally Shot in Front of Apartment

A man was fatally shot in front of an apartment in San Diego’s Lincoln Park area Tuesday night, the San Diego Police Department confirmed.

Police responded to a call of shots fired at an apartment complex in the 4700 block of Solola Avenue at around 7:15 p.m. When officers arrived, they found a 34-year-old man suffering from at least one gunshot wound.

The victim was taken to a hospital, where he was later pronounced dead. His name has not yet been released.

Investigators believe the victim was sitting in front of the apartment in the complex when he was shot by an unknown suspect.

Witnesses told police they saw a man in dark clothing running westbound on Solola Avenue, away from the scene, following the shooting.

Teen Admits to Choking Autumn Pasquale, Takes Plea Deal

Justin Robinson admitted in court Wednesday that he murdered 12-year-old Autumn Pasquale inside his family's home in Clayton, N.J.

Robinson was 15 years old when he was arrested for her murder along with his older brother Dante, who was 17 at the time.

Police say Autumn was riding her bike on her way to a friend's house on Oct. 20, 2012, when the Robinson brothers allegedly lured the girl into their home with the promise of trading bike parts.

Two days after her disappearance, the girl's body was found stuffed into a recycling bin a few blocks away from her home.

In court Wednesday, the now 16-year-old Justin Robinson pleaded guilty to aggravated manslaughter and took sole responsibility for her murder.

Camden County Prosecutor Warren W. Faulk said about 25 members of Autumn's family were in Superior Court today, as Justin admitted to choking Autumn in the basement of his family's home.

Prosecutors say Robinson's mother and stepfather were not home at the time.

"Autumn's death was senseless and it shook the community to its core. There will never be punishment commensurate with her brutal killing," said Faulk.

The 16-year-old entered his plea today as an adult. "In our opinion, the nature of the crime demanded that Justin Robinson be sentenced as a adult and face adult penalties," said Faulk.

Robinson's plea carries a 17-year sentence, Faulk said, and requires that he serves at least 85 percent of that time before he's eligible for parole.

The case against his brother, Dante, is still pending in Juvenile Court. Faulk couldn't comment on that case.

Philly Plane Threat Unfounded

A plane from Ireland landed in Philadelphia after an "unsubstantiated" threat, according to Philadelphia police. But after investigating, federal agents and local police said the threat was unfounded.

As a precaution, the plane was taken to a remote area of the airport so that Philadelphia police and Homeland Security could search passengers and luggage.

"Once we landed, all of a sudden we saw all these cop cars," said Molly Cross, one of the passengers. "An FBI agent got on the plane and told us that someone made a bomb threat or something like that."

A bomb threat was called in to the Philadelphia Airport by an unknown male, according to sources close to the investigation who did not want to be named because they were not authorized to speak publicly about the case.

This was not an emergency landing. US Air Flight #777 took off this morning from Shannon, Ireland and was scheduled to arrive at Philadelphia International at 2:05 p.m. According to the airline's website, the flight landed at 1:58 p.m.

"We were aware of a possible security issue with the flight and out of an abundance of caution taxied the aircraft to a remote location, where it was met by law enforcement and emergency personnel," said Davien Anderson, a spokesperson for U.S. Airways.

All 171 passengers and 8 crew members were escorted off the plane and loaded onto buses. They were taken to a secure area and screened as well as interviewed. Luggage was also removed and screened. Bomb-sniffing dogs went through the plane, which is standard procedure.

"They got everyone off," Cross said. "They got buses and everything and the dog sniffed our bags. We got interviewed. They just asked basic questions, like how long I was there."

All inbound flights were temporarily delayed during the investigation, according to Victoria Lupica, a spokeswoman for the airport.

When a threat like this occurs, Transportation Security Administration (TSA) workers alert the FBI and Homeland Security first. The FBI then calls in the Joint Terrorism Task Force, which is made up of multiple government agencies as well as local and state police, to help with the investigation.

The last time federal agents responded like this at Philly International Airport was in September of 2012 when a Philadelphia man called in a fake report about explosives on a flight headed to Texas. The plane was turned around and brought back to Philadelphia. Kenneth Smith eventually pleaded guilty to charges including giving malicious, false information about an explosive. He had to write a letter of apology to every person on the plane.

Wildfire Destroys Homes, Burns 5,000 Acres Near Banning

Several structures, including homes, have been demolished, one firefighter injured and residents forced to evacuate as a fast-moving wildfire consumed a wide swath of land between Banning and Idyllwild, Calif., on Wednesday afternoon, officials said.

Dubbed the “Silver Fire,” the blaze had grown to 5,000 acres just before 6 p.m., according to Cal Fire Capt. Lucas Spelman.

Aerial video showed multiple structures burning, including homes with vehicles still in the carport and driveway, pictured below.

It was first reported about 2:05 p.m. in the area of Poppet Flats Road and Highway 243 (map), which was closed to traffic between Banning and Azalea Trail, according to the Riverside County Fire Department.

The mountain communities of Poppet Flats, Twin Pines and Silent Valley were under mandatory evacuation order due the blaze, which the department said was "burning at a critical rate."

Spelman said one firefighter had been injured, but the extent of his or her injuries was not known.

Firefighter's "No. 1 priority" is to "protect life," Spelman said.

"The biggest challenge for us is the people who are in their homes, and when we try to evacuate them, them moving on the same streets as the fire engines," Spelman said.

An evacuation center had been set up at Hemet High School 41701 East Stetson Ave. in Hemet.

Air quality warnings have been issued for a large portion of Riverside County. In addition to the Silver Fire, the 1,400-acre Falls Fire continued to burn Wednesday about 5 miles west of Lake Elsinore.

Residents in the following areas are being told to avoid unnecessary outdoor activities: Lake Elsinore, Perris Valley, Hemet/San Jacinto Valley, Banning Pass, Coachella Valley and Temecula Valley.

Anywhere that residents can see or smell smoke from the wildfires is also included in the warning, according to the South Coast Air Quality Management District.

An NBC4 viewer in Palm Springs -- 25 miles away from the Silver Fire -- said remnants of the fire were present in the resort town.

"The smoke is so thick here in Palm springs, the ashes are coming down like snow, and the air quality is really bad!!" Michelle Renee Robinson-Scruggs wrote on NBC4's Facebook page.

The Silver Fire broke out in an area about 20 miles north-northwest of the origin of the Mountain Fire, which burned 43 square miles last month. In that blaze, which prompted the evacuation of thousands of area residents, fire officials had warned of extremely flammable fuels due in part to a dry winter.

The Silver Fire had scorched more than 300 acres within its first hour, according to the fire department’s online incident report.

Four air tankers, five helicopters, 450 firefighters and 71 engine companies have been assigned to the firefight so far.

Temperatures in the area were in the high 80s Wednesday afternoon with wind gusts up to 17 mph, according to the National Weather Service. Humidity was about 17 percent.

On the other side of the San Jacinto Mountains, on the edge of Palm Springs, a fire broke out Tuesday and grew to 60 acres in the extremely steep, rocky terrain near the base of the popular Palm Springs Aerial Tramway. The tram had reopened by Wednesday.

Police Investigate Homicide in Carlsbad

Police were called to a home in Carlsbad Wednesday to investigate reports of a homicide, officials confirmed.

Police officers arrived to a home in the 3500 block of Sierra Morena Avenue at around 5:40 p.m. after receiving a 911 call from a resident who said he heard a gunshot.

When police arrived at the scene, they discovered a man in his 20s dead inside the house. The victim's death was pronounced at the scene.

One other person was transported to a hospital with minor injuries, police said.

Investigators say they were originally looking for a red Porsche that may have been used as a getaway car, but as of 8 p.m., police said they're not sure if that car is connected to the homicide.

At this point, no further details have been released regarding the killing, a motive or a suspect description.

Man Arrested in 1977 Cold Case

A man wanted in connection with a murder that happened in San Diego County in 1977 was arrested Wednesday in Arizona, more than 36 years after the crime.

The San Diego County Sheriff’s Department says cold case suspect Carmen Aguilar, 60, was arrested around 11:45 a.m. near Phoenix for an outstanding murder warrant issued in San Diego County in 1977.

Aguilar is accused of shooting and killing victim Eriberto Landeros during an argument in the Santa Ysabel area, near Julian, on June 19, 1977.

He has remained at large ever since, living and working in Arizona for the past several years, investigators said.

The San Diego County Sheriff’s Cold Case Unit, the San Diego District Attorney’s Cold Case Unit and the U.S. Marshal’s Service (USMS) have been working together on the case.

The USMS tracked Aguilar to Arizona and arrested him on Wednesday, cracking open the decades-long search.

Officials say the case will now be turned over to the San Diego County District Attorney’s Office.

Amber Alert Expands for Missing Lakeside Children

An Amber Alert was extended to Oregon Wednesday as the search continued for two missing children from San Diego’s East County believed to be traveling with a 40-year-old suspect.

At the request of the San Diego County Sheriff’s Department, the Amber Alert for Lakeside residents Hannah Anderson, 16, and her little brother, Ethan Anderson, 8, has been extended to Oregon.

Hannah and Ethan were last seen on Saturday. Their mother, Christina Anderson, 44, was found dead inside a burned out home in the rural community of Boulevard, near the Mexico border.

Officials determined the mother was murdered, but have not yet released details of her death due to the ongoing investigation.

The San Diego County Sheriff’s Department said a child’s remains were also found on the scorched property in the 2000 block of Ross Avenue.

The child’s identity has not been released, but on Wednesday investigators said the size of the child’s body is consistent with that of an 8-year-old.

“We still don’t have a positive ID,” said San Diego County Sheriff’s Department Lt. Glenn Giannantonio.

Officials are searching for suspect James “Jim” Lee DiMaggio (pictured above, right) in connection with the incident. He owned the home that burned to the ground, and had a “close platonic relationship” with Anderson, according to officials.

Investigators believe DiMaggio abducted Hannah and possibly Ethan. All three may be traveling together in a 2013 Nissan Versa with the license plate 6WCU986.

On Wednesday, officials from the National Center for Missing and Exploited Children said a vehicle resembling the 2013 Nissan Versa was believed to have been spotted in northern California along Highway 395/299 from Alturas northbound, possibly heading toward Oregon or Nevada.

At around 2 p.m., a possible sighting of the suspect vehicle was reported in southern Oregon near Lakeview. Law enforcement officers from multiple agencies across states are on the lookout for the car.

Meanwhile, in San Diego, friends of the missing Anderson children are holding out hope that they’re both still alive.

Outside the family’s apartment in Lakeside, candles burn for Hannah and Ethan.

Neighbors, including Lakeside resident Robyn Nolin, tell NBC 7 they’re shocked.

“How could this happen? What happened? How is this so close to home?” said Nolin.

Three close friends of the Anderson family gathered Wednesday at El Capitan High School, where Hannah is a popular student. The friends said Ethan is also a great kid, beloved by his older friends.

“I mean he had so much ahead of him. It’s crazy,” friend Alan McNabb said.

Hayley Wilcock, a close friend of Hannah’s, said the Anderson siblings really love one another.
"With my brother, we're always fighting, but I've just never seen that with them. They're just always so nice to each other,” said Wilcock, “It was just a really good relationship between them."

Family friend Hannah Darby said they all spent time at the Anderson home, and said Christina Anderson treated them like her own children.

"She was like a second mom to me. She did everything for Hannah and Ethan. And every time they had friends over she would always try to do everything for them as well,” Darby told NBC 7.

"She was just so funny. Always cracking jokes, always smiling; she was a really good mom. She was always nice to her kids. I mean no trouble -- they had the strongest connection I've ever seen," added Wilcock.

Suspect May Have Robbed Woman Showering: Police

Police are searching for a suspect who pretended to perform maintenance on an apartment building downtown.

The incident happened on July 28 just before 8 a.m. in an apartment complex, according to police.

A man went to a woman’s door on the 400-block of 13th Street and said he was going to shut off the water to her building. The woman then went back to sleep and the man knocked on her door again, repeating he was just about to shut off the water.

The woman then decided to take a shower before the water was supposed to be turned off. Afterward she fell asleep and later awoke to found her tablet, purse, cell phone, credit cards and two laptops missing.

Management from the apartment complex said the building was not receiving maintenance that day and they did not know the man. Police said the theft may have happened while the victim was showering.

Officials are now looking for the suspect, pictured below. Police described him as 5-foot-6 or 5-foot-7, between 20-30 years old with black spiky hair and brown eyes. He was also wearing plug earrings that were meant to stretch the earlobe.

Mom Who Left Baby in Car While Shopping Pleads Guilty

A woman accused of leaving her 4-month-old baby girl inside a hot car while she went shopping in National City pleaded guilty to felony child endangerment in court on Wednesday.

Starley Cristal Geart, 26, will now be sentenced on a charge of felony child abuse with great bodily injury in connection with an incident that happened last summer.

On July 24, 2012, Geart left her baby inside a hot, parked car while she shopped at a clothing store in a strip mall on East Plaza Boulevard.

A maintenance worker noticed the infant inside the car and alerted police.

When emergency crews arrived, they discovered the baby girl unconscious and soaked in sweat from sitting in the direct sunlight, National City Police Sgt. Julian Villagomez told NBC 7 at the time of the incident.

Crews broke a window to rescue the baby and revived her. She was taken to Rady Children’s Hospital where she was treated and later released into protective custody.

Surveillance footage from the shopping center showed that Geart left the baby in the car for about 10 minutes while shopping. The high temperature in National City that day reached 75-degrees, but firefighters said the temperature inside the car could have reached as high as 140-degrees.

Geart was booked into jail on child endangerment charges following the incident.

Now, more than one year later, the local mother awaits her sentencing, which is scheduled for Nov. 5 in the South Bay. Geart will be sentenced to probation and up to one year in jail.

This case is similar to another recent incident in El Cajon also involving a 4-month-old baby left inside a hot car.

On Jul. 27, 4-month-old Giovanni Soto died after his parents allegedly left him unattended inside a hot, parked car for 15 hours overnight.

The baby boy’s parents, Jessica Quezada, 23, and Israel Soto, 30, pleaded not guilty to child endangerment charges in court on Tuesday.

Prosecutors said little Giovanni had an internal temperature of 107 degrees when a family member discovered the infant inside the car and called police.

Three Winners for $448 Million Powerball Jackpot

Three winning Powerball tickets were sold - two in New Jersey and one in Minnesota - for the $448 million Powerball jackpot. The winning numbers were drawn Wednesday night at 10:59 p.m. ET.

The winning numbers were 05, 25, 30, 58, 59 and Powerball 32. None of the winners have come forward yet. 

Just before the Wednesday night drawing, Powerball officials announced that the jackpot had increased from $425 million to $448 million.  

This jackpot started as a $40 million prize on June 26 and is the result of 12 draws without a jackpot winner.

The jackpot is the current largest jackpot available and the third largest jackpot in history for any lottery game.

The biggest jackpot in American history was $656 million, divided among three winners last year in Illinois, Kansas and Maryland, according to NBC News. That was a Mega Millions win, which is also played in 43 states.

The largest Powerball payout was in May, when an 84-year-old Florida widow named Gloria McKenzie hit the $590 million jackpot.

In November 2012, winners in Missouri and Arizona split a $587 million Powerball prize.

Powerball is played in 43 states plus Washington, D.C., and the U.S. Virgin Islands.

Odds of winning the jackpot prize are one in 175,223,510, and overall odds of winning any prize are one in 32.

Earlier this year, the Powerball jackpot reached a record $600 million.

Veteran's Group Claims Filner Sexually Harassed Rape Victims

A women’s veterans group has claimed San Diego Mayor Bob Filner has sexually harassed victims of rape and is launching a “Please Resign” campaign.

President of the National Women Veteran's Association of America (NWVAA) Tara Jones, whose organization reaches out to veteran women who have been sexually assaulted, said in a press conference Wednesday that members of her group have experienced inappropriate behavior from Filner at one of their own events.

Shortly after multiple accusations surfaced claiming Filner had sexually harassed women, the group rescinded an offer for the mayor to speak at a benefit for sexual assault victims.

The mayor is currently participating in two-week intensive behavioral treatment at an undisclosed location.

Jones, wearing a bright blue shirt that said “Please Resign,” called Filner “a wolf in sheep's clothing." She claimed the mayor re-victimizes women who have already been traumatized, and her organization is ashamed.

Jones did not detail what allegedly happened between the women and Filner. She said she personally was not harassed by him, but his actions toward other women is astounding.

“Save yourself honor and resign," Jones said.

San Diego’s Mayor Bob Filner may have asked the citizens of San Diego to be patient while he undergoes behavioral therapy for the undiagnosed illness that causes him to disrespect women but he doesn’t want them to serve on a jury of his peers.

Through his attorney, San Diego’s Mayor Bob Filner has asked for a change of venue in the sexual harassment lawsuit from an ex-employee who accuses him of treating women like “sexual objects or stupid idiots.”

Filner’s attorney Harvey Berger filed the motion asking the case be moved to Imperial County on the same day that Filner's former communications director filed a lawsuit suing him and the City of San Diego for "numerous instances of sexual harassment".

Berger claims Filner cannot get a fair trial in San Diego due to the "intense, unrelenting and widespread" news coverage of allegations involving unwanted sexual advances committed by his client.

Local television stations provided live coverage of the July 22 news conference announcing the McCormack Jackson lawsuit.

She made a statement detailing her allegations. Among them, a meeting with Filner in June that ended with the mayor telling her “I am infatuated with you. When you are you going to get naked?”

When she insisted the mayor leave her office, he allegedly told her that she could not ask him to leave because he was the mayor according to court documents.

Her attorney Gloria Allred issued a statement on Wednesday saying the Mayor of San Diego should be judged by the people of San Diego.

Filner gave several television interviews after the filing of the McCormack Jackson lawsuit and released a videotaped statement in which he admitted to disrespecting women and at times intimidating them.

"I only ask that you give me an opportunity to prove I am capable of change, so that the vision I have for our city’s future can be realized," he said at the time.

On July 26, he announced he would seek behavioral therapy to work on the issues brought up by his former employee and more than 10 other women in San Diego.

The women including a university dean, a school psychologist, a former campaign worker and a retired Navy admiral have come forward with stories of unwanted sexual advances.

The mayor's office has not disclosed the location of the treatment center or what disorder or behavior for which Filner is seeking treatment.

When NBC 7 posed the fair-trial issue Wednesday to more than a dozen people serving jury duty and passersby at downtown Hall of Justice , there was general agreement that a change of venue would be in order -- with men taking the opposite point of view to a greater extent than women.

"Everybody knows what's going on with him -- how can anybody be fair and just?" North Park resident Jennifer Nicola asked, rhetorically. "News travels. So we have the internet, we have the TV, and we have newspapers so I'm pretty sure everybody's heard of him in the state of California."

Said Ocean Beach resident Ron Herndon: “I have opinion, but I would listen to everything that's said in court -- objectively."

Asked if he thought it more likely that more impartial jurors would be found in Imperial than San Diego County, Herndon replied: "Well, there's so much news here in San Diego about it, it could be tainting the pool. More so than there, I would assume."

Mike Keough, who counts Filner among his neighbors at a residential high-rise downtown, said it’s not impossible that a fair trial could be held in San Diego.

"If they can find an unbiased jury for the Zimmerman trial or something like that, they could definitely do it for Bob Filner,” he reasoned. “I don't think it's going to go to court, though. But we'll see."

Jackie Robinson Statue Vandalized With Racial Slur

A statue of Jackie Robinson outside Brooklyn's minor league baseball stadium in Coney Island was vandalized with a racial slur and a swastika, police said.

The NYPD hate crimes task force is investigating after the vandalism was discovered on the statue outside the Brooklyn Cyclones stadium Wednesday.

Police say someone wrote in black marker "die n-----" and had a swastika and the word "Hitler."

It also said "F--- Jackie Robinson."

The monument, dedicated in 2005, shows former Brooklyn Dodger Pee Wee Reese with his arm around Robinson, depicting their historic friendship.

It was a symbol of courage and conviction of which even 10-year-old Lou Orlando of Fort Greene understood the significance.

"The heroic meoments of Jackie Robinson, and Pee Wee put his arm around him when the crowd was booing him," said Orlando. 

"It's really mean to vandalize that," he said. "It not only affects Jackie Robinson but affects people who like him. It's like an insult."

Other fans leaving the Brooklyn Cyclones game Wednesday were equally upset to see the statue defaced. 

"It's disgusting," said Julie Toro of Staten Island. "How far have we really come if people are going to do things like this?"

Michael Klebanow said, "The bottom line is that you can't have that, especially nowadays. I'm just kind of speechless." 

When Patrick Jabour heard what happened, he was prepared to grab his graffiti cleaners, anxious to get rid of the ugly words and symbols. 

"A lot of people went through hell and back, especially Jackie Robinson," he said. "That's why it bothered me."

The Parks Department did the cleaning instead, power washing the statue and working to restore it. 

Police are scanning more than three dozen cameras posted around the ball park, looking for possible suspects.

Sen. Charles Schumer said in a statement that "defacing the Jackie Robinson statue is a dagger in the heart to everything America stands for, and I hope those who are responsible are caught, punished and taught why what they did is so disgusting and offensive."
