DUI Suspect in Vista Jogger's Death Due in Court

A man suspected of driving drunk when he crashed into a couple jogging in Vista -- killing a husband and father of five -- will appear in court for the first time Tuesday.

Abraham Juarez Perea, 24, of Oceanside, was behind the wheel of an SUV on June 2, allegedly driving under the influence of alcohol and speeding, when he lost control of his vehicle along the 1500 block of South Melrose and Shadowridge drives.

His SUV hopped a curb, plowing into a couple out for a jog, husband and wife Nanglee and Molly Vang. 

Nanglee, 40, a beloved stay-at-home father of five, was killed in the suspected DUI crash. He was one day shy of his birthday.

According to the victim's family, in those terrifying moments when Perea's SUV was heading for the couple, Nanglee pushed his wife out of the way, taking the deadly brunt of the impact.

Molly was seriously hurt in the crash, suffering a broken collarbone, broken ribs, wound to her head and a punctured lung. She remains hospitalized.

The couple has five children, ages 2 to 16.

Perea's mangled SUV wound up on its roof, the bumper and other pieces of the wreckage strewn about the roadway. Perea had to be pulled out of his car by emergency crews and was also seriously injured in the crash.

The suspect is scheduled to be arraigned Tuesday afternoon.

California Gov. Brown Says US Will Stay in Climate Fight

California Gov. Jerry Brown predicts that President Donald Trump's decision to pull the U.S. out of the Paris climate accord will prove temporary because of the urgency of the issue.

Brown told The Associated Press on the sidelines of a clean energy conference in Beijing on Tuesday that China, Europe and U.S. state governors will for now fill the gap left by the federal government's move to abdicate leadership on the issue.

Brown said science, facts and international pressure will eventually bring the United States back into the fold in cooperative efforts to reduce greenhouse gas emissions.

Brown also signed agreements with China's central government and two provinces to collaborate on countering climate change.

Trump's decision to leave the accord has drawn heavy criticism within the U.S. and internationally.

Nurse Killed in London Bridge Attack 'Ran Towards Danger'

Authorities have identified a second victim in the deadly London Bridge terror attack, and her family said Tuesday said she died "as she ran towards danger," NBC News reported.

Australian Kirsty Boden, 28, was living and working in the British capital when three people began a rampage on London Bridge Saturday, driving into a crowd before getting out and stabbing at bystanders in a nearby market. Boden worked at a hospital nearby.

"As she ran towards danger, in an effort to help people on the bridge, Kirsty sadly lost her life," her family said in a statement released by the London Metropolitan Police.

They said they were proud of her selfless actions, while the chief nurse at Guy’s and St Thomas' NHS Foundation Trust, which runs her hospital, called Boden an "outstanding nurse" and a "one in a million" member of staff "who always went the extra mile for the patients in her care."

City of Temecula Broke Ground on I-15 Project

The City of Temecula broke ground Tuesday on a traffic project along Interstate 15, which, once completed, will improve traffic on the busy freeway.

During the groundbreaking, Mark Macarro, Chairman of the Pechanga Band of Luiseño Indians stated, “Our tribe is proud to contribute $14 million for the project… hopeful to make the commute on 1000s of families easier and faster.”

The 18-month project will reconfigure the on and off ramps to and from the southbound I-15 and State Route 79 south (Temecula Parkway). It is expected to be completed by December 2018.

In order to allow traffic to continue moving through the project site, the improvements will be constructed in phases. Officials say to expect delays and plan accordingly.

Once completed, the project will improve traffic flow entering and exiting the freeway by eliminating the line of vehicles waiting to exit southbound I-15 and by controlling traffic entering the freeway with ramp meters and HOV lanes added to the on ramps.

Man Flashes Woman While Asking for Directions: Police

San Diego police are investigating an incident involving a man accused of exposing himself to a woman in Carmel Valley while he asked her for directions.

According to the San Diego Police Department (SDPD), the suspect was driving a white Toyota Rav4 along 10880 West Ocean Air Dr. just after 8 a.m. Monday when he approached a woman to ask for directions.

As he spoke to her, he flashed her, police said, and then took off.

Police said the suspect is described as being between 25 and 30 years old, with a medium to heavy build, black hair, brown eyes and a black goatee. He was wearing a light-colored shirt and orange or red pants at the time of the indecent exposure incident.

On Tuesday, SDPD Officer Billy Hernandez said officers had detained one person for questioning on Carmel Mountain Road, but it is unclear, at this point, if that person is the suspect in this case.

The woman flashed by the man was not hurt.

Mass Firings at Uber After Sexual Harassment Probe: Source

Ride-sharing company Uber has fired at least 20 people after the tech giant investigated claims of sexual harassment within its ranks, NBC News reported.

The law firm Perkins Coie investigated 215 claims in its probe into the allegations. One hundred resulted in no action, according to a source. It was not immediately known who was among the at least 20 people fired.

NBC Bay Area has reached out to the company for comment.

Former U.S. Attorney General Eric Holder was investigating claims of sexual harassment at Uber in a separate probe.

That investigation was sparked by a blog post written by a former Uber engineer, Susan Fowler, who said the company's human resources department ignored her complaints about her boss' advances because was a high performer, dooming her prospects at the company.

Tourists Shot While Using GPS in Lincoln Park

Three men visiting San Diego from Chicago were shot at in Lincoln Park Monday night as they used their GPS in the unfamiliar neighborhood, authorities confirmed.

The San Diego Police Department (SDPD) said the victims had pulled their car over along the 4700 block of Logan Avenue at around 10 p.m. so they could enter an address into their GPS device.

Suddenly, two unknown men flanked the car – one man coming up to the driver’s side and the other to the passenger’s side – and allegedly pointed guns at the trio, demanding money from them.

Police said the victims gave the suspects cash. Then, both suspects fired one shot each into the car.

The gunfire struck one of the passengers on his index finger and the driver on his arm. Police said the victims drove themselves to a hospital and were treated for their wounds, which were not life-threatening.

The investigation is ongoing; as of Tuesday, no arrests had been made in this case. Anyone with information can reach out to San Diego County Crime Stoppers at (888) 580-8477.

20-Year-Old to Learn Fate After Hitting, Killing Teen Boy

A young driver convicted of hitting and killing a teenage pedestrian in San Diego's Tierrasanta will learn her fate in court on Tuesday. 

Jessica Medsker, 20, previously pleaded guilty to leaving the scene after hitting and killing 16-year-old Alex M. Funk. 

According to prosecutors, Medsker struck Funk as he walked with a friend along Santo Road near Antigua Boulevard just before midnight. The impact killed the high school sophomore and Medsker fled the scene.

Medsker was later arrested. She admitted to investigators that she drank alcohol from her boyfriend's drink the night of the crash. She, however, was not charged with driving under the influence. Her boyfriend was a passenger in her car that night. Prosecutors said Medsker had been driving 60 mph in a 45 mph zone.

At the young woman's arraignment in late March, prosecutors revealed a shocking detail: Medsker's sister is currently also in custody in Riverside, California, charged with the same type of crime.

Medsker had no prior criminal record.

She could face a maximum of four years in custody at her sentencing.

San Diego’s Fraud Hotline Receives 1,000th Tip

The San Diego City Auditor's Fraud Hotline reached a major milestone Tuesday by receiving its 1,000th call reporting fraud, waste or abuse related to City operations and programs.

"This milestone is proof that the City and its employees are committed to addressing wrongdoing across all functions of the City," stated City Auditor Eduardo Luna, in a statement.

"The Fraud Hotline team has earned a reputation of trust and effectiveness within the City as illustrated by the sheer volume of calls."

Several high profile cases, including a probe into a former mayor, have come from tips to the Fraud Hotline. These tips have also led to multiple successful convictions.

Since the Hotline was created nine years ago, it has offered City employees a method to place anonymous tips to stop fraud, waste and abuse. Through this program, those who bring matters to the Office of the City Auditor are protected by the state Whistleblower Protection Act.

Luna says 33 public Fraud Hotline reports have been issued related to substantiated investigations. The City Auditor has made 89 recommendations related to those reports.

Fraud Hotline activity reports are published and presented to the City Council's Audit Committee each quarter.

Whistleblowers can call the City's Fraud Hotline at 866-809-3500. A specially-trained operator is available 24 hours a day who will confidentially document their concerns and make sure all the important details are included. Reports can be made anonymously.

It's a Beautiful Day: U2 Announce SD Show

Bono and the boys may have skipped over San Diego in Round 1 of their US tour, but they made good with a Tuesday morning announcement.

U2, hailed by some as the best live band in the world, will bring the Joshua Tree Tour to Qualcomm Stadium on Sept. 22. It's a return ticket for the band, who played the site, then known as Jack Murphy Stadium, way back in 1997.

Fans in Southern California traveled to the Rose Bowl last month to see the band celebrate the 30th anniversary of the "Joshua Tree" album, but hopes for a local show rapidly faded till U2 announced the tour extension, which will also take the band to Detroit, St. Louis and four other US cities prior to heading south to Mexico and South America.

Now, San Diego fans can expect to hear that album in its entirety, plus many other iconic songs from the Irish hit factory, all delivered from an enormous, eyepopping stage show. 

Amazingly, tickets will start at just $35, with general admission floor tickets at $70. U2.com subscribers will be able to buy tickets from 10 a.m on Thursday, June 8, through 5 p.m. on Saturday, June 10, with purchasers limited to 4 tickets. Once seats go on sale to the general public on Monday, June 12, at 10 a.m., fans can snatch up a maximum of six at time.


Armed Man Kidnapped Girlfriend, Leading to SWAT Standoff: PD

A six-hour SWAT standoff in Rancho Bernardo Sunday afternoon started earlier that day when an armed man forced his girlfriend into his car and drove her around San Diego County for hours, sexually assaulting her at knife point, San Diego Police Lieutenant Misty Cedrun said. 

The two 19-year-olds, in a dating relationship, were at a hotel Saturday evening when they had a discussion that did not go well, Cedrun said. 

The man, later identified as Anthony Brewer, became upset as the night went on and later forced her against her will into a car, Cedrun said. 

The suspect allegedly drove her across San Diego County for hours, pulling over at least two or three times and allegedly sexually assaulting the victim, police said. At the time, he was brandishing a knife. 

Sometime during her time in the car, Brewer allowed the victim to make a call to her family, and he agreed to take her back home, Cedrun said. 

When they got back home, a family friend decided to intervene - the friend somehow got into the car.

Police believe the suspect then intentionally crashed the car at the intersection of Pomerado Rd. and Springfield Dr. The suspect slammed into a passerby's car as well. 

People who saw the crash rushed to help.

"My dad got out of the car [and] ran towards them. I got out to see if they were okay," one witness said. "I saw him in the car but once they said he had a knife they told everyone to back away."

Another witness said a woman in the back was crying and yelling, “Please help me! I’m being kidnapped.”

The witness said he pulled the woman out of the car while a passenger in the front seat restrained the driver. The passenger in the front seat also said the driver was trying to kidnap the woman. The passenger tried to leave, but police intervened.

The intersection was shut down for hours while police negotiated with the man. They also employed flash bangs to try to get him out.

Six hours later, at 6 p.m., the suspect got out of the car. 

The suspect, the woman he allegedly kidnapped, and the woman in an SUV who was hit by the suspect were all taken to a hospital. 

Brewer is charged with three counts of rape, one count of kidnapping with intent to rape, one count of terroristic threats, one count of felony spousal abuse, one count of false imprisonment and one count of assault with a deadly weapon. 

The investigation is underway. Anyone with information is asked to call police.

How to Protect Children From Recreational Pot Use

New laws regarding the recreational use of marijuana have left many parents wondering how to address the issue of cannabis use with their children and other minors.

Several San Diego agencies held a public meeting in City Heights to educate parents about this on Tuesday. There were also members of advocacy groups present, trying to understand how to speak to their clients about marijuana use.

Recent campaigns advocating for the legalization of marijuana and the lax legal consequences have made some parents feel like they can't compete.

"There are consequences for the minors. Of course, they're not allowed to smoke it in school, they're not allowed to smoke it in work," said Jesse Navaro, the Community Relations Representative for the San Diego County District Attorney's Office.

"There's consequences -- legal consequences -- and for the parents there could be not only legal consequences but also some financial consequences," said Navaro.

Representatives from the San Diego County District Attorney's office spoke to the public about the possible legal consequences for minors involving cannabis use.

Many parents who attended the event were deeply concerned about the new marijuana laws, especially now that recreational use is legal. 

One parent, Gabriella Durazno, told NBC 7 it's difficult to convince your kids to stay away from marijuana, especially when there's a lack of education and easy access to the drug.

"Well my concern with kids is that they get easy access and then the lack of education, it could affect them," said Durazno.

Although the new laws limit recreational use to adults who are age 21 and older, minors can gain access through a doctor's recommendation letter.

The consequences for violating marijuana laws for minors is relatively minimal. Minors or adults under age 21 who are caught in possession of marijuana will face a drug class, a few dozen hours of community service or a $100 fine at most.

Hackers Using Kids to Get to Parents' Financial Information

In an age of heightened online security awareness, parents have a right to be worried about their data.

But their children may be making them vulnerable online, experts say. 

“I think many times in families, the weak link is their children,” said Kristen Amicone, Director of Education and Technology for the San Diego Police Foundation. 

Most children are not thinking about their parents' savings accounts, mutual funds and investments, Amicone said. When hackers are looking to breach your online security, they may try to use your kids. 

“Unfortunately kids aren’t as discriminating about where they share information, where they get it from and who they’re giving it to,” Amicone said. “If a child is using a computer for instance, and they download a virus, the parent might have no idea until their data is stolen.” 

Some parents may assume their kids already know all about online security, Amicone said.

Oftentimes, knowing how to work on a computer and what to click can differ, she added. 

“Children are native but still naive,” Amicone said. 

Amicone said it is important to use different usernames and passwords for children and parents. Parents also need to keep important financial information in places their kids cannot access. 

“They need to be taught what a spam email looks like, what a spam text message looks like and they also need to be taught to go to the source of whatever scary thing came to you,” Amicone said.

Man Who Hijacked San Diego Airport Shuttle Sentenced

A man who posed as a passenger and stole a San Diego International Airport employee shuttle filled with workers was sentenced Monday for related charges.

Norberto Eaton, 46, of Arizona, was sentenced to three years in jail followed by three years and eight months of mandatory supervision. He will be monitored by the court, according to his defense attorney Patrick McCoy.

Eaton was charged with eight felony counts of false imprisonment by force, one count of vehicle theft and one count of resisting an executive officer by force. 

The judge also dismissed eight counts of kidnapping and three counts of battery on an officer, confirmed McCoy.

Eaton stole the shuttle on April 19, 2016 in what one man testified was a wild ride. He previously pleaded not guilty. 

Video footage of the shuttle hijacking shows Eaton jump up from the back of the shuttle, hop in the driver’s seat and speed off from Terminal 2 at Lindbergh Field with the door open.

A woman in the front seat with a cane can be seen looking for something to hold onto so she won’t fall as she and others are tossed around.

“The rate of speed was excessive,” testified Randal Snyder during Eaton’s preliminary hearing. “I was thrown up against the window which I thought was odd. I became concerned. I started looking for my seat belt.”

Investigators say that at one point, Eaton was racing 55 miles per hour down a 25-miles speed zone on Harbor Drive. He careened around stopped cars and raced through a red light near the U.S. Coast Guard station.

One officer who testified about the April hijacking said the accident could have been catastrophic.

During the ordeal, which lasted more than two minutes, Snyder, one of the two men on board the shuttle, testified that he and the other man looked at each other and decided they were going to do something.

When the shuttle hit traffic near Hawthorne and came to a stop, they jumped the driver and grabbed him.

Snyder says Eaton escaped, but he and the other man were able to shout down a parking enforcement officer, who arrested Eaton.

Woman's Lawsuit Against SDPD Over K-9 Bite Rejected: Court

A federal appeals court ruled that San Diego police did not use excessive force when they released a police dog that bit a woman who had fallen asleep at her office.

In a ruling on Tuesday, a majority of an 11-judge panel of the 9th U.S. Circuit Court of Appeal rejected Sara Lowry's lawsuit against the city of San Diego.

Lowry triggered the burglar alarm when she fell asleep at her office one night in 2010. Responding police released the dog, which bit Lowry's lip.

The 9th Circuit said police followed the dog closely and quickly called her off, limiting Lowry's injury. It also said the officers reasonably concluded that a burglary might be in progress.

An email to Lowry's attorney was not immediately returned.

A smaller 9th Circuit panel last year sided with Lowry.

Consider Trump's Tweets 'Official Statements,' Spicer Says

It's official — the president's tweets, that is.

White House Press Secretary Sean Spicer said Tuesday that Trump's tweets should be taken as official statements, NBC News reported. This contradicts other White House officials who have recently dialed back on this importance of the tweets.

"The president is president of the United States," Spicer said. "So they are considered official statements by the president of the United States."

Trump's Twitter usage has been a cornerstone of his presidency, offering a window into his thinking, sometimes at the expense of his administration's messaging. Despite bipartisan complaints about his continued 140-character habit, Trump has persisted in making his views known on social media.

2 New Eateries Join Liberty Public Market

Pizza AND breakfast sandwiches? Where do we sign up?

Liberty Public Market – the popular food emporium located in the heart of Liberty Station – announced Tuesday that two new eateries will be joining its extensive lineup of vendors this summer: Doughballs, a pizzeria specializing in wood-fired pies, and Crackheads, a restaurant whipping up an all-day menu of breakfast sandwiches.

Both fast-casual eateries come from restaurateur James Markham’s company, JM Concepts (MOD Pizza, Pieology, Project Pie) and are slated to open in late July.

They will take over the spaces in the marketplace that previously housed Pi Bar and Grape Smuggler Bar, right inside Mess Hall.

According to JM Concepts, the menu at Doughballs includes nearly 10 signature pizzas, plus create-your-own pie options. The eatery uses high-protein flour that cooks in 90 seconds so that pizza will come out piping hot in a flash.

Menu items include the “Cheesus Christ,” which is topped with mozzarella, ricotta, parmesan, taleggio, extra virgin olive oil and cracked black pepper, and the “Stinky,” a mozzarella and parmesan pie topped with prosciutto, roasted Brussels Sprouts, caramelized onions, and garlic.

Doughballs has another location in Pacific Beach – a novel drive-thru pizza shop – and this pizzeria at Liberty Public Market will be the restaurant’s second location.

As for Crackheads, the vintage diner will serve a variety of gourmet breakfast sandwiches, including the eatery’s namesake “Crackhead” sandwich made with Applewood smoked bacon and cheddar cheese and topped with an over medium egg that's drizzled with a secret “crack sauce.” The sandwiches are made on fresh brioche buns made daily at the local bakery, Bread and Cie.

For sweet treats, the menu boasts Pop Tart ice cream sandwiches and something that’ll make you feel like a kid again: an all-day build-your-own cereal bowl bar featuring sugary old school classics like Cocoa Puffs, Lucky Charms and Cap’n Crunch with your choice of milk and toppings.

Liberty Public Market is located at 2816 Decatur Rd., at Liberty Station, adjacent to Stone Brewing World Bistro & Gardens.

The 25,000-square-foot marketplace – a $3 million collaboration between operating group Blue Bridge Hospitality and developer The McMillin Companies, which opened to the public in March 2016 – aims to be reminiscent of public markets in other cities, such as Napa’s Oxbow Public Market or Philadelphia’s Reading Terminal Market.

The focus at the indoor-outdoor marketplace is on fresh, sustainable, locally-sourced goods, including year-round produce sourced from regional farms, plus merchants offering locally-procured seafood, old-fashioned butcher services, homemade tortillas, bread and pastries, fine wine, locally-roasted coffee, specialty handcrafted goods and more.

As of early February 2017, Liberty Public Market was home to about 30 vendors, plus the full-service Mess Hall restaurant.

Many of the small, local merchants are well-known favorites at farmers markets, while some are entirely new concepts debuting for the first time in the marketplace. For most, this is their first-ever brick-and-mortar establishment after building a fan base around town.

The venue – a historic, warehouse-style building originally built as the Naval Training Center’s commissary in 1921 – has the capacity to house more than 30 merchants.

In late 2016, Liberty Public Market was ranked No. 13 on a list of the most popular food halls in the United States.

The food hall is open daily, from 11 a.m. to 8 p.m. Vendors hours may vary; check out this list of what's currently cooking there.

A Look Inside the Senate Room Where James Comey Will Testify

Room 216 of the Hart Senate Office Building is where several Supreme Court justices have faced confirmation hearings, where members of the 9/11 Commission analyzed the terror attacks and where federal judges have been grilled before impeachment.

On Thursday, former FBI director James Comey will appear there to give public testimony that is expected to shed light on the federal investigation into Russia's election meddling and whether President Donald Trump demanded Comey's loyalty as reports suggested.

News4 got an exclusive look at the grand hearing room on Tuesday, as staffers prepared for Comey's appearance before the Senate Intelligence Committee.


Comey will sit at a witness table facing an imposing wall of pale marble.

Members of the committee will sit before him, on an elevated dais. The United States Senate seal will hang over their heads.

The hearing room was built for high-publicity events that draw large numbers of spectators and reporters, U.S. Senate historian Katherine Scott said.

"Media boxes" where news organizations will set up cameras are tucked into the movable walls on a mezzanine level.

The hearing room was first used in 1988 for hearings between the U.S. and the U.S.S.R. on nuclear forces, according to press coverage from the time.

Supreme Court confirmation hearings for Samuel Alito, Ruth Bader Ginsburg, Neil Gorsuch and Sonia Sotomayor, among others, were held there, as well as 9/11 Commission hearings. Federal judge Walter Louis Nixon Jr. faced impeachment hearings there in 1989, as did judge Alcee Hastings.

Comey will give public testimony on Thursday, followed by a closed-door session to discuss classified matters.

A reporter asked Trump on Tuesday what message he would have for Comey ahead of his testimony.

"I wish him luck," he said.
