Inmate Found Dead at Richard J Donovan Correctional Facility

An inmate found dead at the Richard J. Donovan Correctional Facility had been there two to three days before authorities found him, officials confirmed to NBC 7 San Diego. 

James Acuna, 58, was pronounced dead on Monday, according to Vicky Waters with the California Department of Corrections and Rehabilitation. 

He was found two to three days after he died, the Medical Examiner found, according to San Diego County Sheriff Department's Ken Nelson. Sheriff's detectives were called to the scene on Monday. 

The ME said there were no indications of foul play, Nelson said. 

The circumstances surrounding his death are under investigation, Waters said. 

Officials with the CDCR said they could not release further information as the death is under investigation. 

No further information was available. 


Barbecue Fire Chars 2 Apartment Units in Point Loma

Two apartment units at a complex in Point Loma were burned Thursday by a fire that started from an unattended barbecue, San Diego Fire-Rescue (SDFD) officials said.

The fire broke out at an apartment building at 4344 W. Point Loma Blvd. just before 4:30 p.m., according to SDFD.

Officials say an outdoor barbecue was left unattended with food on it, and the fire spread from an outdoor patio on the first floor, into the first-floor unit and up to the second-floor unit above.

No injuries were reported, but five adults were displaced from the two units, SDFD said.

Initial estimates of structural and content damages from the fire are around $225,000.

1 Burned in Small Backyard Explosion: SDFD

One victim suffered burns in a small backyard explosion in Clairemont, San Diego Fire-Rescue (SDFD) officials said. 

The call first came in for a structure fire on the 4100 block of Willamette Avenue at approximately 1:01 p.m. Thursday. The location is just a few blocks from the Clairemont Town Square. 

Fire officials with the hazardous materials division told an NBC 7 crew that a man was pouring an unknown liquid into a hole in his backyard when a small explosion occurred. 

The patient suffered burns to his legs and was taken to UC San Diego's Burn Center. The extent of his injuries is unknown. 

A private cleanup company handed the cleanup. SDFD's Hazmat crew did respond to the scene, but determined there was no hazard. 

Fire officials referred the building to City Building Inspectors because of code issues.

Man Armed with Bat Near Health Clinic Prompts Long Pursuit

A man wanted on an active felony warrant, standing near a health clinic on the Santa Ysabel Indian Reservation armed with a bat, prompted an extensive search through rugged terrain, San Diego County Sheriff's officials (SDSO) said. 

Deputies first responded to the health clinic on Thursday when someone called to report a suspicious person loitering near the clinic. The caller said he knew deputies were looking for the man the previous day, and that he may be wanted. 

The man, later identified as Patrick Clay, was standing near the clinic with a baseball bat, deputies said. 

When officials arrived on scene, they immediately recognized the man as a suspect wanted on at least one active felony warrant for his arrest, Sgt. Brian Jenkins said in a statement. 

Multiple deputies from the Ranchita and Julian substation, as well as the Sheriff Department's helicopter, ASTREA, responded to the area. 

Clay fled the scene, running out the back of the clinic and into nearby bushes and trees on the reservation, Jenkins said. 

Sheriff's began to chase after him on foot with a canine unit from Poway; the helicopter followed him as well. 

The wanted suspect ran through thick, heavily wooded terrain on the reservation. 

All the while, ASTREA maintained visual contact with Clay as he ran, Jenkins said. Sheriff's officials in ASTREA were able to direct deputies toward Clay from the air. 

As deputies pursued the suspect, one of the deputies involved driving a patrol vehicle was involved in a rollover crash in his SUV, Jenkins said. The deputy suffered minor injuries and was taken to a nearby hospital for treatment. 

After an hour of evading capture, deputies eventually caught up with Clay. As they got closer and started yelling commands, Jenkins said, Clay refused commands to surrender. 

Deputies deployed a canine, who made contact with the suspect. 

Clay was taken into custody and transported to the hospital for treatment. 

Once he is released, he will be booked into a North County jail on charges of parole violation and felony resisting. 

1 Person Injured in Five Vehicle Crash in East Village

Five vehicles were involved in a collision in the East Village area of San Diego Thursday night.

According to the San Diego Police Department (SDPD), the crash occurred at 8:21 p.m. on 16th Street and F Street.

One person was taken to a local hospital, police said.

It is unknown what caused the crash.

One Person Found Stabbed in East Village: SDPD

A person was found stabbed in the East Village area of San Diego Thursday night, the San Diego Police Department (SDPD) confirmed.

The incident occurred at 9:03 p.m. on 15th Street and Imperial Avenue.

Police said the victim was taken to the hospital. The extent of injuries is unknown.

BP Arrests Suspect Wanted for Sexual Assault of Minor

A man wanted for sexual assault of a minor and burglary was arrested at the San Ysidro Port of Entry by U.S. Customs and Border Protection (CBP) officers.

Santiago Flores-Martinez, 48, an undocumented Mexican citizen, was taken into custody while he was trying to enter Mexico. 

A CBP officer discovered Martinez's was an exact match to a suspect wanted in Oregon on charges of sexual assault of a minor and first degree burglary.

Martinez will be turned over to the U.S. Marshals Service and extradited to Oregon to face charges.

“CBP officers routinely encounter and stop dangerous fugitives, attempting to depart the United States. Working with our law enforcement partners is not only critical but necessary in order to ensure justice is served," said Pete Flores, director of field operations for CBP in San Diego.

Vehicle Drives Into Bar in Spring Valley

The owner of a Spring Valley bar reported that a pick up truck had driven into his property, the California Highway Patrol (CHP) confirmed.

It was reported around 9:09 p.m. at the Bancroft Bar on the 9100 block of Campo Road.

A truck plowed into the bar, slamming into a pool table inside.

According to the owner, the driver was parked outside the bar and went into drive instead of reversing.

According to the San Diego County Sheriff's Department, one man was taken to the hospital as a precaution. He had been slightly pinned by the truck during the incident but is expected to be okay.

Thousands of Dollars Raised for Homeless Good Samaritan

After finding and rightfully returning a $676 cashier's check, a San Diego homeless man walked away with more than $15,000 and a new friend.

Yesenia Del Valle said she looked anxiously for her cashiers check with no avail after losing it on April 18.

Later that night, Del Valle said Sergio Juarez knocked on her door and proved that good people still do exist. And one act of kindness led to another.

"I couldn't believe that a person that was homeless and didn't have a job nor money for gas, took the time to find me and return this check for that amount of money," Del Valle said.

Juarez has been living out of a Motel 6 with his wife and three children after losing his job and apartment.

After learning about his situation, Del Valle said she felt compelled to help.

She created a GoFundMe campaign in hopes of raising a few thousand dollars for Juarez and his family.

The campaign went viral and has raised close to $20,000.

For Juarez, the kindness of complete strangers left him and his family speechless.

"Once I get back on my feet, I plan to pay it forward," Juarez said.

Local Neighborhood Seeks to Put Park Curfew Against Homeless

The Adams Avenue Recreation Council in Normal Heights is aiming to establish park curfews to drive away homeless in their neighborhood.

Community members are concerned over campgrounds being set up on the south end of Ward Canyon Park and the Adams Avenue Recreation Center.

“I used to go run at night and I've been noticing lately that there are more and more people, more homeless people,” said Kevin Lara, who lives a block away from the recreation center.

The council voted Tuesday to seek approval to set up curfews at both parks. The goal is to have the curfew implemented into the City of San Diego's municipal code. 

Law enforcement would be able to patrol and cite those breaking the curfew.

The council believes the curfew will create a way for police to record the number of problems in the area.

They said the next step is to get approval from the city's Department of Parks and Recreation.

Weaver Struggles Again in Loss To Arizona

Jered Weaver’s tendency to give up home runs is not going away.

After allowing three more round-trippers in a 6-2 loss to the Diamondbacks Thursday night, Weaver’s ERA rose to 4.71.

What’s more disturbing is that Weaver has already allowed ten homers in his first five starts as a Padre.

To put that in perspective, the veteran righty has only struck out 14 batters this year.

Chris Owings certainly likes playing against the Friars. The D’backs second baseman crushed a pair of homers off of Weaver to bring his season total to four.

Three have come against San Diego this week alone.

Meanwhile, Taijuan Walker fooled the Padres lineup and improved to 3-1 after striking out 11 batters in eight solid innings.

Padres infielder Ryan Schimpf managed to go yard for the second straight day when he bashed a solo shot in the 7th inning but it was too little too late.

Yangervis Solarte collected another RBI in the first inning when he singled home Wil Myers.

Solarte leads the Padres with 16 RBI, while Myers still owns the best batting average at a .316 clip.

After dropping three of four contests in the desert, San Diego starts a three-game series up in San Francisco with a Friday date against the Giants.

Luis Perdomo is expected to take the mound while the Giants are scheduled to pitch Jeff Samardzija who is off to an 0-4 start with a 7.40 ERA.

The five highest-paid executives at Illumina Inc. each pulled in over $2 million in compensation last year, with an average of $4 million each.

That average is a tad skewed, however, considering Illumina’s president and CEO brought in a total compensation of $8.4 million. Total compensation can include things such as salary, bonus, stock awards, options awards, non-equity incentive plan compensation and all other compensation.

Illumina is one of San Diego’s largest public companies, with a market cap of $27 billion. It reported $2.4 billion in revenue in 2016. The company is the largest maker of DNA sequencing machines in the world, and employs 5,500 globally and at least 1,500 employees in San Diego.

Here are Illumina’s five highest-paid officials in 2016 (with titles as listed at the time), according to documents filed by the U.S. Securities and Exchange Commission this month:

Veteran of 2 Wars Turns 100

A U.S. military veteran who served in two wars turns 100 this week in San Diego.

Theo Logan enlisted in 1942 and retired 20 years later as a major in the U.S. Army.

He was stationed in Germany, Italy and Korea.

He said he saw a lot and was grateful to be one of the boys to make it back home alive.

But he’s quick to point out, he’s no hero. He was just a man doing his job.

“My part was so small, that I can't see the big picture in that manner, but I think we all did our part as best as we could under the circumstances,” Logan said.

Among those circumstances was a segregated army.

“Once we were integrated, I think it makes the service, much, much stronger, than let me say, the individual was,” he said.

When Logan returned home to the U.S., his dedication to helping people wasn’t over.

He became involved in the San Diego Parks and Recreation Department and helped to develop the Southeastern Economics Development Corporation.

He also started a successful real estate business with the focus on helping African-American and Hispanic residents in Southeast San Diego become homeowners.

Seeing people buy their first home is something he will always remember.

“It makes you feel like you are doing something worthwhile, when you do that,” Logan said.

Logan’s children said he still reads two newspapers every day.

They will celebrate his 100th birthday on Sunday with family members and more than 100 guests.

Fire Weather Warning Issued for Riverside, Imperial Counties

Expect conditions that could lead to fires Friday in Imperial and Riverside counties, the National Weather Service warned this week.

The NWS issued a fire weather warning for both counties beginning at 10 a.m. with strong winds and low humidity in the forecast.

Anyone heading to the Colorado River Valley can expect to see warnings of fire danger.

Winds are expected to be between 20 and 25 mph with gusts up to 40 mph according to the NWS forecast.

Humidity may be as low as 8 percent.

Group: Gov't Doesn't Care About Immigration Detention Abuse

Yordy Cancino moved to California as a child.

He graduated at the top of his high school class at Jackie Robinson High School in Los Angeles and was accepted to numerous colleges, including UCLA and UC Santa Cruz.

“My ultimate dream is to be a fashion designer,” he said with a smile.

Cancino said he couldn't afford to pay for college and as an undocumented immigrant, couldn’t get financial aid. “They didn't have funding for undocumented students. Unfortunately, when I graduated in 2011, DACA wasn’t present.”

Deferred Action for Childhood Arrivals (DACA) is a United States immigration policy founded in June 2012. DACA allows certain undocumented immigrants who entered the country as minors, to receive a renewable two-year period of deferred action from deportation and eligibility for a work permit.

Cancino said without another option to pay for college, he returned to Mexico.

“The risks I knew,” he said. “I wasn't going to be able to come back, it’s like me leaving my family behind, for me fulfill my dream.”

After two years studying in Mexico City, Cancino said he wanted to return to California.

In 2014, he turned himself in at the Otay Mesa border, seeking asylum, swearing under penalty of law that he’d been beaten and stalked in Mexico. He said he was targeted because he was gay.

Cancino was held at the Otay Mesa  Detention Center, a Department of Homeland Security and ICE facility managed by a private company, CoreCivic.

Cancino said he never thought he'd be harassed by the guard who was supposed to uphold order. He said that guard gave him pet names and ridiculed his sexuality.

“He was always looking at me, so I didn't even feel comfortable taking a shower,” he said. “He was always approaching me in different ways I shouldn't be approached.  As an officer, he should have been taking care of me, he wasn't taking care of me.”

According to Cancino, he complained to the guard's supervisor but his complaints were not taken seriously or documented correctly.

“I think by not investigating each allegation, each complaint of sexual assault our government is sending a message that sexual assault of immigrants will be tolerated,” said Christina Fialho, co-founder of Community Initiatives for Visiting Immigrants in Confinement (CIVIC). “These are thousands of human beings who are being sexually assaulted, raped, either because the government has been unwilling or unable to protect  them or because the government has been the perpetrator of these sexual assaults.”

According to CIVIC, the Department of Homeland Security Office of the Inspector General Received 1,016 complaints related to sexual abuse or assault on detainees, from May 2014 to July 2016. Details on individual cases were not disclosed, including whether the alleged perpetrators were corrections officers, or detainees themselves.

Fialho said the number of complaints is likely much higher, noting the Inspector General reported more than 33,000 allegations of a broader range of abuse from January 2010 to July 2016, including 702 complaints of coerced sexual contact, 714 complaints of physical or sexual abuse and 589 complaints of sexual harassment. Fialho said the majority of those complaints were filed against ICE and the inspector general investigated less than "1 percent" of those complaints.

“In California, there were 4,500 complaints lodged with the Inspector General, but only 45, a very small number, were investigated by OIG,” she said.  “With the current climate under President Trump, it is very concerning. He is planning on expanding immigration detention system by 30,000 on any given day. Right now, there are about 40,000 people in immigration detention on any given day.”

On April 11, CIVIC sent a letter to homeland security demanding a thorough investigation of all complaints, including Cancino's.

The group said it has not received a response.

A spokeswoman with DHS, Gillian M. Christensen, told NBC 7 Investigates the department will review the letter "to determine if further action or recommendations are warranted." Christensen also noted the allegations represent a tiny percentage of the more than 2 million admissions to ICE detention facilities in the six-year period covered in the report and the agency has a "zero-tolerance policy" related to sexual abuse.

Recalling his time in custody, Cancino said, “I suffered a lot. I would cry. It was a nightmare.  Mentally and physically, my family didn't know what was going on with me. You are not just a human to them you are an object .”

He spent three months at the Otay Mesa Detention Center, which CIVIC ranks the 5th highest for sexual abuse complaints, out of 211 ICE Immigration detention facilities.

Cancino now has a 5-year work visa, but his permanent status is still in question.

He knows speaking out is risky, but he said he won't stay silent, “You have to have some type of respect.”

Lauren Mack, a spokeswoman for ICE in San Diego would not provide an interview to NBC 7 Investigates for this story. Repeated emails and phone calls to CoreCivic, the company that manages the Otay Mesa facility, were not returned.

Fialho said she wants Congress to create a bipartisan commission to investigate sexual assault complaints in ICE immigration facilities. Her group also wants the Department of Homeland Security to publish details about all documented sexual assaults and investigations.

If that's not done, Fialho said her group may sue DHS, to force changes.

'Major, Major Conflict' Possible With North Korea: Trump

President Donald Trump warned on Thursday that the U.S. could be headed toward a "major, major conflict" with North Korea over the country's nuclear and missile programs, NBC News reported.

The president spoke in an interview with Reuters, adding, "We'd love to solve things diplomatically, but it's very difficult."

Trump also said he hoped the North's 33-year-old leader, Kim Jong-Un, is "rational." The president said taking over a regime at a young age is "a very hard thing to do."

The interview comes just hours after a North Korean propaganda outlet released a video simulating an attack on America, with the White House and aircraft carriers superimposed with targets.

Sitter Accused of Lewd Acts With Child Used Alias: Detective

An Escondido woman accused of filming the molestation of two girls in her care advertised her babysitting services on at least three websites and used two different names, investigators said Thursday.

Carlsbad police detectives are sharing new information about the defendant because they believe there may be more victims in the case.

Brittney Lyon, 22, was arrested in July and charged with eight felony counts that included conspiracy and lewd and lascivious conduct with a child under the age of 14.

Carlsbad Police say Lyon would take two 7-year-old girls she was babysitting to her boyfriend's relatives’ home in the Bressi Ranch Community where he allegedly molested them while she recorded the acts. One of the victims was a child with special needs.

The alleged assaults started in January 2015 and happened repeatedly with the same two victims for over a year.

Lyon's boyfriend, Samuel Cabrera, Jr., was also charged in the case.

Now detectives say they have come to believe there may be other victims in the case and that the victims may reside outside of San Diego County.

Carlsbad police say Lyon used the name "Lauren Allen" when she advertised as a babysitter on the websites Care.com and Sitter.com. Carlsbad Police say in a statement: "We want to state unequivocally that Lauren Allen herself is in no way a suspect in this case."

Families in Riverside, San Bernardino and Los Angeles counties should look at the photos of Lyon that were posted on those websites as well as SitterCity.com.

Osprey Recalls Child Backpack Carriers Due to Fall Hazard

Osprey is recalling 82,000 child backpack carriers due to a fall hazard.

The recall involves all models of Osprey’s Poco, Poco Plus and Poco Premium child backpack carriers manufactured between January 2012 and December 2014.

According to the Consumer Product Safety Commission, a child seated in the carrier can slip through the leg openings, posing a fall hazard to children.

Osprey says it has received four reports of children falling through the carrier, including one report of scratches to the head and another sustained a skull fracture.

The nylon child carriers were sold in three colors, “Romper Red,” “Koala Grey” and “Bouncing Blue.” They have a metal frame and a gray padded child’s seat inside.

The production date is stamped on a black label sewn into the interior of the large lower zippered compartment on the back of the carrier. “Osprey” is printed on the fabric above the kick stand. The model name is printed on the back at the bottom.

Consumers should immediately stop using the recalled carriers and contact Osprey for a free Seat Pad Insert for use along with the existing safety straps to secure the child in the carrier.

Consumers who previously received and installed the free Seat Pad Insert in their carriers are not required to take further action.

The products were sold at REI and specialty outdoor stores nationwide and online at Amazon.com from January 2012 to December 2015 for between $200 and $300.

Trump Reflects on Presidency: 'I Thought It Would Be Easier'

Donald Trump misses his old job, struggles with the workload of the presidency and finds it brings a lack of privacy, he told Reuters ahead of his 100th day in office, NBC News reported.

"I loved my previous life. I had so many things going … this is more work than in my previous life," he told Reuters. "I thought it would be easier."

The interview comes as Trump proposes a major tax reform plan, signs a slew of executive orders and tries to get a health care bill passed. He is also working to contain the nuclear threat in North Korea by negotiating with other major Asian leaders.

"I'm a details oriented person. I think you would say that, but I do miss my old life," Trump said. "I like to work, so that's not a problem, but this is actually more work."

Suspected Drunk Driver Crashes Into SDPD Patrol Vehicle

A suspected DUI driver crashed into a San Diego police patrol vehicle early this morning in the College area, while officers were pulled over on the side of the highway. 

It happened along the eastbound lanes of Interstate-8 just west of College Avenue, Friday at 1:35 a.m.

Officers were taking into custody someone suspected in a domestic violence case in Pacific Beach.

No one was hurt. 

Police arrested the driver and domestic violence suspect. 

The crash shut down several lanes of eastbound I-8. The lanes have opened.
