Former City Attorney Accused of Retaliation

One of San Diego’s top attorneys is suing former City Attorney Jan Goldsmith.

Marlea Dell’Anno said her former employer retaliated against her and abused his power when he asked her to break the law and she refused.

“I spent 20 years of my life building that reputation. I had a spotless record. In one fell swoop Jan Goldsmith took that all away from me,” she told NBC 7 Tuesday.

Dell’Anno said she was San Diego’s Assistant City Attorney in charge of the Criminal Division when Goldsmith asked her to remove negative performance evaluations from certain employees’ files.

“I could not do that. Within a couple weeks I was demoted. He responded by humiliating me in the most public way possible,” she said.

“I was put in a dingy office on the fifth floor with a big sign on the door that said ‘Do Not Enter,’” she said.

In November 2015, Goldsmith opened an investigation into Dell’Anno and an attorney she oversaw. The investigation, he said, was about dozens of mishandled cases. Several of them were domestic violence cases that were not filed in time.

“My suspicion was that she was just overwhelmed and doing too much work and did not enter the cases into the system,” Dell’Anno said.

Dell’Anno said Goldsmith used the case as a reason to demote and eventually terminate her for disobeying him.

“I found out I had been fired a week before Thanksgiving,” she recalled.

“I think Jan lost sight and it became about Jan and Jan’s interest and Jan’s image,” she said.

NBC 7 reached out to the City Attorney’s Office and was told they are reviewing the lawsuit.


Disney Recalls 15K Minnie, Mickey Mouse Sweatshirts

Walt Disney Parks and Resorts recalled about 15,000 infant sweatshirts emblazoned with Mickey and Minnie Mouse because of a choking hazard, the company announced Wednesday.

The garments are hooded sweatshirts with a three-snap closure, Disney said. 

Both of the sweatshirts have ears attached to the hood and artwork that shows the classic Disney characters.

They were sold at Disney World in Florida, Disneyland in California and online through a Disney shopping app.

Woman Behind Viral Michaels Tirade Stands Behind Her Reaction

It has been nearly two months since video showing a woman’s tirade at a Chicago Michaels store went viral, but now the woman at the center of the footage that quickly took over the Internet, broke her silence. 

“This wasn’t about race, this was not about political views, this was about very poor customer service and being told to leave without warning,” Jennifer Boyle said in an exclusive interview with NBC 5 that aired Tuesday. 

In the weeks that have followed the video’s release, the 29-year-old Lakeview resident said she has been attacked on social media and called “racist” and “unhinged” for her comments. 

How did the situation escalate to the point we saw on video?

The video, seen more than 4.5 million times, shows Boyle yelling repeatedly at a black employee at a Lakeview store and telling one employee to “shut your face.”

Boyle says an employee discriminated against her and mumbled that she must have voted for Donald Trump, but the employee is heard in the video denying that assertion. 

“And I voted for Trump, so there,” she said in the footage. “What? You want to kick me out because of that? And look who won. Look who won.” 

Why not leave? Why not get out of the situation?

Now, at the start of 2017, Boyle said she regrets not leaving the store and ending the situation before her viral tirade. 

“Looking at it now, I think that would have been the right thing to do,” she said. “I really believe that it was fight or flight kicked in and I felt that I needed to defend myself.” 

If you had to do it over again, you would have handled it differently?

Boyle maintains that she was discriminated against, and confirmed that the incident started over a reusable bag. 

Witnesses have argued the employees “did nothing to provoke this verbal attack and in fact treated all customers with professionalism and courtesy.”

"I wish I would have just been above, cooler heads prevail, been above reproach and would have just left and called corporate like I did do on Friday," she said. 

A few days later another video surfaced, at Peet's coffee. Do you think you have an issue with dealing with your anger?

The Michaels video wasn’t the first footage of Boyle in a heated diatribe to be posted online. A similar video showed her in a verbal altercation at a Peet’s Coffee in the city’s Boystown neighborhood months earlier. 

“Oh my God you’re a floor manager and you call people a b----, you’re a b----,” she is seen shouting. “I was treated like crap, Bobby.” 

But Boyle claims this isn't a pattern.

"I do not believe that I have an issue dealing with my anger," she said. "I believe that again, taking the high road and walking away from situations in that matter. What people don’t know is what was said to me at Peet’s."

This wasn't the end of this. What's happened since then?

Boyle called the backlash from the video “very scary” and “very difficult.” Her home address, cell phone number and email address were all published online, leading to what she described as lewd calls, vulgar emails and death threats. 

“There’s not one bone in my body that’s racist or homophobic,” she said. “And that’s the bottom line.”

But still, Boyle refuses to apologize for what happened that November day and stands by what she said. 

“I believe that I stood up for myself,” she said. “Again, everybody is a work in progress. We’re all human and I really believe that being above reproach is the way to be from now on.” 

What was your reaction to the Michael's employee receiving more than $30K via a GoFundMe page?

Soon after the video was posted, a GoFundMe campaign aimed at helping the employee who became the target of Boyle’s tirade raised more than $32,000, well above its goal of $400. 

In a letter to those that donated to the campaign, the store manager identified only as Holli wrote "you have all single handedly changed my life."

"I've tried to be kind, I've tried to be fair, I've tried to share regardless if I was able to," the letter read. "I want others to smile when I smile back at them. Knowing deeply we all have a higher purpose."

Michaels said in a statement it does not “tolerate discrimination or racism of any kind against our team members or customers.” 

“We regret that our customers and team members were affected by this unfortunate incident and are grateful for the leadership of our store team in working to resolve it without further escalation,” the statement read. 

The company also tweeted later, “We appreciate the outpouring of support for our Chicago-based team member.”

Toshiba Recalls Additional 83K Laptop Battery Packs

Electronic company Toshiba America announced the recall of an additional 83,000 laptop battery packs as part of an expanded recall that began in March. 

Toshiba previously recalled 91,000 of the Panasonic lithium-ion battery packs, which are installed in 41 models of Toshiba Satellite laptops. 

Toshiba received five reports of the battery packs overheating and melting, but no one has been injured by devices. 

Users can go to the Toshiba website to check if their laptop is affected by the recall. 

If a laptop is included in the recall, Toshiba recommends users power off their computer and remove the battery pack immediately.

Girl Pulled from Under Car Near Bay Terraces Schools

A girl was struck by a vehicle early Wednesday near two schools in the Bay Terraces/Paradise Hills area of San Diego, her grandfather told NBC 7.

The victim, identified by police as a juvenile, was rushed to Rady Children's Hospital.

San Diego Fire-Rescue crews helped the victim after she was struck just after 8 a.m. near Paradise Valley and Briarwood roads. The location is less than a mile north of Bell Middle School and less than a mile south of Boone Elementary School.

Raul Belgra was walking his granddaughter and another child to school. He said the group was in the crosswalk and had almost reached the middle of the road when the incident happened.

"They were in front of me," Belgra said. “I see the car.”

Belgra said he grabbed one child's backpack to keep the child from being hit by the car. He soon realized his granddaughter had been hit.

"The car stopped then we say to the driver, 'What happened, what happened' but my granddaughter was under the car," he said.

Other drivers stopped to help, he said.

“They lift the car and pull my granddaughter from under the car,” he said.

Jerry Guevara had just dropped off his child at school when he saw the rescue.

“She was actually under the front axle,” said Jerry Guevara. “They lifted the car and pulled her out.”

Guevara said he watched as the paramedics from a nearby fire station jumped in to treat the girl.

"My heart was pounding," he said. "I was like, 'Please be alive, please be alive.'"

The injuries to the pedestrian were unknown, officials told NBC 7.

Belgra said his granddaughter talked a little bit after the collision and he's not sure of her injuries.

The driver of the vehicle stopped and was being questioned by police near the crash scene.

He told NBC 7 he was going southbound on Briarwood, making a left turn onto Paradise Valley Road and didn’t see the child.

Both schools are in the San Diego Unified School District which reopened Tuesday after the winter break.

No other information was immediately available.

San Diego Acts Invade 2017 BottleRock Festival

Calling all music fans (and winos), prepare to head into the great wide open. If life is getting "the best, the best, the best, the best of you" -- it might be time to start planning that vacation to the grand grape-crushing land of Napa Valley that you’ve been longing for.

The 2017 BottleRock Napa Valley music/food/wine/brew festival surely has something on tap you’ll like during its May 26-28 weekend with its huge lineup featuring headliners like Foo Fighters, Tom Petty & the Heartbreakers, Maroon 5, Macklemore & Ryan Lewis, Modest Mouse, Ben Harper & the Innocent Criminals, Band of Horses, two different types of Pickups (Silversun and Silverado), two different kinds of Saints (Motel and Lucia), and the Roots (among many others).

The mighty lineup -- which was announced Tuesday, Jan. 3 -- also features a San Diego invasion of sorts as well, with R&B star Andra Day (the 2016 SoundDiego Award-winning Artist of the Year), beloved blues/rock duo Little Hurricane, reggae/pop group Hirie, and the eclectic soul/pop/folk Redwoods Revue (a collective from the San Diego music label of the same name that includes familiar local names like Rebecca Jade & the Cold Fact, Birdy Bardot, the Midnight Pine, Cardinal Moon, and Dani Bell & the Tarantist) scheduled to perform.

Hometown favorites Little Hurricane are no stranger to the festival circuit, having played at SxSW, Austin City Limits, Lollapalooza and the Telluride Blues and Brews fest (among others) over the past few years. The same goes for the massively popular seven-piece band Hirie, who -- led by their namesake frontwoman -- have taken their sunny vibes to the big events such as the Sierra Nevada World Music Festival, the 2015 Reggae Rise Up Festival, and the huge California Roots Festival in both 2014 and 2016.

Day (who just capped an epic year recently by performing a tribute to Mavis Staples with Bonnie Raitt at the 2016 Kennedy Center Honors) has performed at a myriad of national events in 2016 alone, ranging from Milwaukee’s Summerfest to Washington state’s Sasquatch Festival to the Essence Festival in New Orleans.

But it’s a rather big coup for the Redwoods Music label. While we’re spoiled and get to see their Revue take over various San Diego venues every couple months (or Dani Bell & the Tarantist at, say, our next SoundDiego LIVE party on Jan. 20 at the Casbah), BottleRock is the first big step toward taking their massive show on the road. While the Midnight Pine has played the local stage at the first two incarnations of Kaaboo Del Mar, and the Joshua Tree Music Festival for the past couple years (along with some of the label’s other bands), the upcoming Napa fest may be the biggest out-of-town opportunity for the homegrown collective yet.

Save the Dates: Big San Diego Events in 2017

Happy New Year! As 2017 unfolds, San Diego will host its share of big events – from the Farmers Insurance Open to Comic Con, here’s a look ahead at noteworthy local happenings in the New Year.

San Diego Restaurant Week
Jan. 15 through Jan. 22
The tasty tradition continues in 2017 with this semi-annual foodie event featuring eight days of special prix-fixe menus at more than 180 top-notch restaurants spanning several San Diego communities. This year, the first round of San Diego Restaurant Week runs from Jan. 15 through Jan. 22. As always, a second installment is expected to follow in September.

Farmers Insurance Open
Jan. 26 through Jan. 29
The Farmers Insurance Open is San Diego’s prestigious PGA Tour golf tournament played at the scenic Torrey Pines Golf Course. Several ticket options are available for the tourney, depending on which day you want to head to the green, and what you want to do (mingling, eating, drinking) when you get there. 

Big Concerts in San Diego in 2017
All year
Big headliners will take the stage in San Diego in 2017 including Stevie Nicks on March 2 and Bon Jovi on March 5, both at Viejas Arena. According to the music experts at NBC 7's SoundDiego, these noteworthy acts (to name a few) are also coming to San Diego this year: Daya on March 12 at House of Blues; Green Day on April 8 at Valley View Casino Center; Lionel Richie with Mariah Carey at Viejas Arena on May 8; Shawn Mendes at Qualcomm Stadium on July 14; Coldplay at Qualcomm Stadium on Oct. 8. Also, for all the fan girls out there, New Kids on the Block -- with guest Paula Abdul (!) -- will also play San Diego this year, on June 1 at the Viejas Arena as part of the "Total Package Tour."

San Diego Padres Home Opener
April 7
The San Diego Padres start the 2017 season on the road in early April against the Los Angeles Dodgers and, on Friday, April 7, will take on the San Francisco Giants in the home opener at Petco Park. The three-game series continues through April 9. Also, for devoted Friars' fans who don't mind traveling, the Padres Spring Training Season starts on Feb. 25 with a game against the Seattle Mariners at the Peoria Sports Complex in Peoria, Arizona.

Memorial Day
May 29
Obviously, Memorial Day is not exclusive to San Diego, but it’s certainly worth jotting down the date in your planner. The unofficial start to the summer lands on May 29 this year, and thousands will flock to our sandy beaches to celebrate. Of course, thanks to the generous sunshine, beach days are standard long before this date in America's Finest City, too.

San Diego County Fair
June 2 through July 4
Attracting more than 1.5 million visitors each year, the San Diego County Fair is the largest annual local event and one of the largest 10 fairs in the United States. For the 2017 season, the fairgrounds in Del Mar will officially open to the public at 4 p.m. on June 2, and will run through July 4. It will be closed the first four Mondays and first three Tuesdays of the season. This year's theme is "Where the West is Fun," a nod to cowboy culture and the wild west, promising the "rootinest, tootinest fair." For the 21+ crowd, jot down these big days at the fair in your planner: June 10 for the Toast of the Coast Wine Festival; June 16-18 for the San Diego International Beer Festival; June 24 for the Distilled Spirits & Cocktails Festival. Of course, as always, indulgent, fried fair food will also play a large role at the 2017 San Diego County Fair. Come hungry.

Del Mar Opening Day & Opening Day Hats Contest
July 19
On your mark, get set, go! The 2017 Del Mar horse racing season begins July 19 with all of the glitz, glamour and hats (oh, so many hats) of the famous Opening Day celebration. Expect the Opening Day Hats Contest and a large OPening Day crowd, dressed to the nines and hoping to see and be seen. NBC 7 will be there, gathering stories, photos and hosting a livestream of the Hats Contest on NBC7.com. The track's 2017 season starts a little later than usual this year in order to give horses and jockeys more time to adapt to racing surfaces following a string of horse deaths in Del Mar in 2016. This time, the season runs through Labor Day (Sept. 4), with a total of 36 racing days as opposed to the usual 39. Del Mar's racing season will also include dozens of concerts and other summertime events at the venue.

San Diego Pride
July 2017
The annual San Diego LGBT Pride Parade colors the streets of Hillcrest in July, with the parade starting at the Hillcrest Pride Flag at University Avenue and Normal Street. The 1.1-mile route proceeds west on University Avenue, turns south on 6th, left onto Balboa Drive and ends at Laurel Street. Each year, thousands of spectators turn out for the parade, which includes lively floats and hoppin’ dance music. Pride weekend also features live music acts, a street festival, a Pride 5K run and other fun events in the hip Hillcrest community.

Over-the-Line (OTL) Tournament
July 8-9 and July 15-16
A San Diego summertime tradition, Over-the-Line (OTC), is hosted over the course of two weekends every July at Fiesta Island. Put on by the Old Mission Bay Athletic Club (OMBAC), the annual tournament typically gathers approximately 1,200 teams from around the world to play Over-the-Line, a bat and ball sport first played in Mission Beach in the 1950s. The rules are simple: games last three innings, no one had to run bases and the main goal is to hit the ball “over the line” about 55 feet in front of the batter. Teams dress up in wacky costumes and bring tents, chairs, beer and hilarious signs to the beach for the carefree, daytime tournament. This year's 64th annual OTL tournament is planned for July 8-9 and July 15-16.

San Diego Comic-Con International
July 20 through July 23
A signature San Diego event, the enormous pop culture spectacular returns to the San Diego Convention Center in 2017 with celebrity panels, elaborate costumes, sneak peek screenings, exhibits and events galore. As always, Comic-Con badges are hard to come by and the event will sell out. On the bright side, many interactive Comic-Con events are hosted outside the Convention Center, too, as downtown San Diego transforms into a lively hub for fanboys and fangirls of all ages. It really is a unforgettable sight. NBC 7 will offer tons of coverage on the big event on our special Comic-Con section online here.

Clear the Shelters
July
NBC 7 will take part once again in Clear the Shelters, a nationwide pet adoption drive that helps find loving forever homes for animals in need. Nearly 700 shelters across the country will team up for this, including many in San Diego County. NBC 7 will bring you live coverage on our website of touching tales as pets find new homes with caring San Diegans.

San Diego Bay Wine and Food Festival
Nov. 13 through Nov. 19
The 14th annual San Diego Bay Wine and Food Festival will return this November to shine the spotlight on the best wine, beer and spirit purveyors in the land, as well as top-notch local chefs. For a week, foodies and winos can indulge in different tasty events around town, all leading up to The Grand Tasting -- an epic food festival along the Embarcadero.

Balboa Park December Nights
Dec. 1 and Dec. 2
Each year in early December, Balboa Park kicks off the holidays in San Diego with the bright and merry December Nights, a two-day, multicultural celebration of the season. The event -- in its 40th year in 2017 -- brings more than 350,000 visitors to Balboa Park for festive, family-friendly fun, including live music, arts and crafts, photos with Santa Claus, free entry into select museums, drinks and food from across the globe and, of course, plenty of twinkling holiday lights. At this year's celebration, Balboa Park's International Cottages hope to debut new cottages representing nations from around the world -- part of an expansion of the International Cottages area long in the works.

Man Flees Police, Jumps Into River

A man with an outstanding warrant for his arrest fled from police officers in San Diego Wednesday by jumping into a river.

At around 10:10 a.m. officers with the San Diego Police Department (SDPD) tried to stop the suspect in the 4000 block of Sports Arena Boulevard near the San Diego River in the Mission Bay area.

The man refused to stop for officers and instead fled on foot, jumping into the river to escape capture, police said. Lifeguards were called to the area to help pull the man from the water.

Just before 10:40 a.m., officers and lifeguards had surrounded the river and were ordering the man to surrender peacefully.

San Diego Lifeguards posted a photo of the unusual river rescue on social media:

About 10 minutes later, authorities were able to fish the man out of the water and take him into custody.

No one was hurt; no further details were immediately released.

Lemon Grove Preparing for Medical Marijuana Dispensaries

A third city in San Diego County is preparing to open the door to medical marijuana businesses. 

Lemon Grove residents approved Measure V in November by a close margin. The measure repeals an existing city ban on marijuana businesses. 

The City Manager for Lemon Grove, Lydia Romero, told NBC 7, in the city’s zoning code if a use is not listed within the code, then the use is not allowed. Since medical marijuana dispensaries were not listed in the code, “that is how the City kept dispensaries out of the City,” according to Romero. 

In 2012, voters rejected two measures on the ballot that would have allowed medical marijuana operations in the city. 

In November, Measure V passed by 90 votes, according to the Registrar of Voters certified election results, narrowly passing the “over 50%” requirement to repeal the ban.

According to Romero, the Measure V results were certified on December 20th, giving the city 90 days to figure out the approval process for “medical marijuana retail outlet permits”. 

“No applications nor any permits will be issued before the March 20th date,” Romero said in an email to NBC 7. “Any retail outlets that open before it is approved by the City will be considered illegal and both the property owner and business owner will be subject to code enforcement action.” 

According to the text behind Measure V, these businesses will require a Conditional Use Permit and will be “limited to opening only in Heavy Commercial, Limited Commercial, General Commercial and Light Commercial Zones. Residential and Multi-Use.” 

Romero said Lemon Grove staff were still working to properly identify allowable locations in the city and any areas that may be considered “sensitive,” where shops would be prohibited due to nearby retail outlets or malls. 

According to how Measure V was written, the measure would allow medical marijuana dispensaries, if permitted, to “grow, process and dispense marijuana to a ‘qualified patient’ or ‘primary caregiver’ on the premises.” 

At first, Romero told NBC 7 that commercial cultivation of medical marijuana was not allowed under Measure V. 

After NBC 7 referred to the writing of Measure V, stating dispensaries were permitted to grow and process marijuana, the City Manager said the city is still deciphering the approved measure. 

Lemon Grove joins the cities of San Diego and La Mesa as the only cities in San Diego County to pass measures that legally allow marijuana for medicinal use to be sold. 

The City of San Diego has been accepting dispensary applications since 2014 and according to the city’s communications department, 15 locations have been legally permitted to operate as of November 14, 2016.

The City of La Mesa is planning to start accepting applications for both dispensaries and cultivation sites on January 12th, according to Community Development Director Carol Dick. 

Dick told NBC 7 the City of La Mesa’s Planning Department is still working on a map that will show applicants where dispensaries are permitted and prohibited within the city limits.

SD Company Earns Military Contract for Underwater Robots

San Diego-based Teledyne SeaBotix will supply 60 small unmanned underwater vehicles to U.S. military units specializing in explosive ordnance disposal, under a recently announced Pentagon contract.

The deal is worth millions of dollars, Teledyne said in a Jan. 3 announcement. SeaBotix did not give a dollar amount for the contract.

The SeaBotix robot is about the size of a toaster oven and can operate at the end of a tether that can stretch for more than a mile.

The vLBV 300 systems will be fitted with a variety of off-the-shelf equipment, including a tracked crawler attachment skid and imaging sonar.

The Defense Department inked the contract with a SeaBotix distributor, Atlantic Diving Supply.

Explosive ordnance disposal mobile units have used Teledyne SeaBotix robots for several years. The new order will upgrade those units around the globe.

“The systems perform a variety of critical functions for the military but also serve to keep the men and women of our military out of harm’s way,” Teledyne SeaBotix President William Kikendall said in a prepared statement.

“Diving is a dangerous activity. Robots are replaceable,” said an oceanographic equipment supplier in a Business Journal interview in 2007.

J.J. Watt Surprises Football Fan Who Lost Jersey After Accident

Houston Texans football star J.J. Watt surprised an 8-year-old fan at the hospital after the child's favorite jersey was ripped open after he was hurt in a car accident on New Year's Eve, NBC's "Today" show reported.

Noah Fulmer underwent surgery for two broken legs after being hit by a car that had crashed into the bed of a parked pickup truck he'd climbed into.

Marc Carapia, a relative of Noah's, tweeted news of the accident to Watt.

Noah's dad Cory Fulmer, a pipe fitter's helper in Bay City, Texas, told "Today" that Watt showed up the next day.

He brought along with several jerseys, including one game jersey that he'd autographed with a special message for Fulmer.

CHP Seeks Driver in Deadly New Year's Day Hit-and-Run

Investigators are searching for a hit-and-run driver who killed a man in Spring Valley on New Year’s Day moments after the victim got out of a car after getting into an argument with his mother.

California Highway Patrol (CHP) Officer Kevin Pearlstein said the tragic, deadly crash happened on Jan. 1, at around 1:30 a.m., on eastbound State Route 94.

A 21-year-old Spring Valley resident was riding in his mother’s car when the pair got into an argument. The mom, who was driving, pulled over on SR-94 and the young man exited the car. Pearlstein said the man began running in the fast lane and, moments later, was hit by a driver in another car.

The young man died at the scene. The driver did not stop to help and instead fled the scene.

Pearlstein told reporters on Wednesday that investigators were actively seeking the hit-and-run suspect in this case. At this point, however, the description of the suspect’s vehicle is very limited; investigators believe it’s a small passenger vehicle that likely sustained damage to its front-end in the collision.

For now, Pearlstein said investigators are examining surveillance videos captured by nearby businesses for leads in this case, but said the CHP needs the public’s help. Anyone with information on this hit-and-run can call the CHP at (619) 401-2000.

Pearlstein said the driver, if found, is facing a felony hit-and-run charge.

The name of the victim killed in this hit-and-run has not yet been released. Pearlstein said this case serves as a warning to never get out of your car while on the freeway.

“There really is no safe place to pull over on a freeway, unless it is a true emergency, just because of the inherent danger of the speed of the vehicles approaching,” he explained.

Pearlstein said the site of the deadly crash is not well-lit, so the driver may not have seen the victim in the road. The suspect may have also been driving under the influence, Pearlstein said, as the crash occurred in the early hours of New Year’s Day.

Macy's to Close 65 Stores in 2017, Cut 10K Jobs

Macy's announced it is shutting down 65 stores in 2017 and eliminating an estimated 10,000 jobs as it battles slowing sales and growing online competition.

The closures are part of a planned shut down of about 100 stores that the company previously announced in August 2016. On Wednesday, Macy’s said it will close 63 locations in early spring 2017 and another two mid-year. Macy’s already shuttered three of its 730 stores in 2016.

The company says about 3,900 employees will be affected by the closures. It also will eliminate about 6,200 other positions as part of an effort to streamline operations and reduce expenses so it can invest more in its digital operations.

“As we’ve noted, it is essential that we maintain a healthy portfolio of the right stores in the right places. Our plan to close approximately 100 stores over the next few years is an important part of our strategy to help us right-size our physical footprint as we expand our digital reach,” the company said in statement.

Macy’s shares fell more more than 9 percent Wednesday after it posted disappointing holiday sales and announced which stores will be closing, CNBC reported.

Final clearance sales at Macy’s stores closing in early 2017 will begin on Monday, January 9, and run for approximately eight to 12 weeks.

A Look into the Future at CES

It’s called the world’s biggest gadget show and it’s happening this week in Las Vegas.

The Consumer Technology Association's annual conference is January 5th through the 8th in Las Vegas. CES, as it's known, provides a glimpse into the future of technology and electronics.

This 50th  year of CES will feature 3,800 exhibits, 2.6 million square feet of exhibit space and about 165,000 people are expected to attend, including many from San Diego.

North County resident Matt Dukleth, Program Manager for NetZero, said “It’s like nerd fun land, with amazing sights and sounds.”

Dukleth is at CES to launch NetZero’s Arlo Go.  Arlo Go is a high-definition video home security camera system that can be placed wherever there is cell phone coverage.

Dukleth said a “connected home” will be a huge theme of CES and something he’s looking forward to being part of, “Your phone is your command center, so when you’re away from home connecting back to your home is a natural fit, that’s where things are headed.”

San Diego businessman Eric Grab went to his first CES in 2003, he figures this year will be at least his 10th CES, “It’s sensory overload.  It’s overwhelming because there are so many things to see and do. It’s tough to see everything.”

Historically, CES is known as a place to unveil industry and technology changing ideas, but Grab expects this year’s CES to be “less big bang and more incremental developments.”

Grab, a former Chief Technology Officer at DivX, has a new start-up company named Disruption Wave.  Disruption Wave helps organizations and people ride the wave of technological change.

One thing Grab is very interested in this year is the evolution of virtual reality and ultra HD video, specifically 4K TV’s and 360 degree video, “I think 360 degree video is something that TV viewers will become accustomed to. 360 degree video allows you to change your point of view and angle.”

Dukleth and Grab say they’ve seen an increased presence at CES from San Diego businesses and innovators in recent years, but that Qualcomm is still king when it comes to local impact at CES.

“Qualcomm’s chips and technology are at the heart of CES, they’re everywhere, including in our Arlo Go,” said Dukleth.

“San Diego has positioned itself to diversify more and more with technology.  The Bay Area is reaching a bubble, so I think there’s a nice core that could increase here locally,” said Grab.

CES officially starts Thursday, January 5th and runs through Sunday, January 8th.


Former HS Coach Sentenced for Arranged Illicit Meeting

A former Santana High School campus supervisor and track coach has been sentenced to five years probation for attending an arranged illicit meeting with a minor

Keith Silvia, 49, engaged in sexual activity with an underage student, according to his plea. He previously pleaded guilty to the felony charge.

A judge sentenced Silvia on Wednesday to five years probation and 365 days in custody through short term work furlough. Silvia will have to register as a sex offender for the rest of his life. 

The incident first came to light when the victim's parents found letters from an unknown person in their daughter's backpack earlier this year, deputies said. 

When they looked into the matter further, they discovered the letters were from Silvia. GUHSD officials said Silvia worked as a campus supervisor and also coached freshman football and track and field. 

Deputies conducted an investigation and found the coach fostered an intimate relationship with the victim, deputies said. The coach arranged more than one off-campus meeting, deputies said. 

The victim's parents reported the incident to the school, which told the Sheriff's Department. He resigned from the district on June 23, 2015 and later turned himself in to authorities in July 2015. 

Silvia was initially charged with four misdemeanor counts of annoying/molesting a child under 18 years of age and one felony count of arranging a meet with a minor for the purpose of engaging in lewd acts.

San Diego Lays Out Demands For Rural/Metro

After months of reportedly responding late to emergency calls, the City of San Diego’s ambulance service, Rural/Metro, has been given a strict list of terms to abide by in order to avoid what the city calls a “material breach of the terms of the EMS agreement.” 

The list of terms were laid out in a letter sent by the City of San Diego’s Chief Operating Officer Scott Chadwick on December 1, 2016 to the company’s top west coast management. In 2015, Rural Metro was acquired by AMR, which took over all Rural/Metro operations. 

The letter along with other documents pertaining to the city’s new requests about Rural/Metro’s services within San Diego, was released to NBC 7 Investigates through a California Public Records Act request. 

NBC 7 Investigates first reported Rural/Metro’s non-compliance with mandated response times in October 2016, when the city fined Rural/Metro $291,000 in penalties. According to the company’s contract with the city, it is required to meet a response time of 12 minutes or less, 90% of the time.

In the letter, Chadwick states Rural/Metro has failed to meet the response time standards in multiple medical response zones for the months of July through November, 2016. 

“Repetitive quarterly fines for failure to meet response time standards will not be tolerated,” Chadwick said.

Throughout the letter, the city spells out demands for AMR, requesting new data, setting specific deadlines and asking for in-person meetings. 

According to the letter, the city requested: 

  • AMR “provide the city a robust ambulance system deployment plan” on how the company can improve response times based off of 911 incident demands from December 1, 2015 to November 30, 2016.

  • The company provide, by January 31, evidence the company can build and maintain a stable workforce, showing the steps the company plans on taking to “permanently secure and retain a stable, long term workforce.”

  • AMR provide turnover rates for employees who worked in San Diego in 2015 and 2016.

  • The ambulance company provide monthly reports that detail wages, hours and working conditions of AMR employees, as well as plans to “retain and grow veteran Paramedics and EMTs so as to sufficiently staff it’s workforce to meet the EMS Agreement’s response time requirements.” 

The letter provides a deadline for AMR to comply with the demands. In an email to NBC 7 Investigates, San Diego Fire-Rescue Captain Joseph Amador said, “AMR has complied with all of our requests for information and deadlines.”

The city and fire department declined to talk on-camera or answer any additional questions, “until after he [Fire Chief Brian Fennessy] reviews the end of Q2 data and the Mayor & City Council have received the information.” 

In the letter it states if the company does not accept the terms of this “Plan-to-Cure” notice by the end of December, “the city of San Diego may have no choice but to begin drafting in January of 2017 a Notice of Breach and Intention to Terminate the EMS Agreement.” 

AMR did not answer questions on-camera for this story. Jason Sorrick, Director of Communications and Government Relations for AMR sent an email to NBC 7 Investigates and said, “AMR has provided the city of San Diego with all the information that was requested last month, and we are pleased to report that we have exceeded all response time requirements for the months of November and December." 

The city did not confirm AMR’s claim of compliance for the month of December. “Until we have completed our review of the Quarter 2 data, we won’t know whether AMR-RM has been contractually compliant Citywide and in all eight (8) zones,” Amador said.

Last month, NBC 7 Investigates spoke with Joseph Ross, a former Rural/Metro Emergency Medical Technician, EMT, who spoke about, what he called, “unethical business practices” and staffing shortages he witnessed. 

“We’re not having enough ambulances in service on our city streets,” Joseph Ross told NBC 7 Investigates. “If you have somebody who’s gone on a chest pain [911 call] 500 times in their career versus someone who has gone on a chest pain [911 call] five times in their career, it’s a lot more smooth when you have an experienced person.”

To help the company meet mandated response time standards, the city offers to help staff a limited number of Rural/Metro ambulances with San Diego Fire-Rescue Department Firefighters and rated Paramedics per day, for a predetermined length of time, according to the letter from the city. 

If AMR takes advantage of the offer, the city would require personnel and other incidental costs reimbursed per normal city cost recovery formulas. 

“It is AMR’s responsibility to fund what is necessary to staff the requisite number of ambulances,” Chadwick states in the letter. 

In addition to the letter, NBC 7 Investigates received a memo sent to the Mayor’s office and San Diego City Council members on December 7, 2016, a week after the “Plan-to-Cure” letter was sent to AMR. 

In it, City of San Diego Fire Chief Brian Fennessy said AMR responded to the city’s latest letter four days after it was sent and acknowledged response times were negatively impacted in select zones for the FY 2017 Quarter 1 and 2 (July 1, 2016 through November 30, 2016.) However, according to the memo, AMR told the city, they were in full compliance in all medical response zones for the month of November.

According to the memo, the city and AMR have a scheduled a meeting to discuss the city’s concerns that were not addressed in the company’s initial response.

Spreckels Mansion Back on the Market

The historic, beachfront Spreckels Mansion in Coronado is back on the market – listed for $15.9 million.

According to Realtor.com and listing agent Scott Aurich, the estate – which spans three beachfront lots totaling 19,000-square-feet – is located at 1043 Ocean Blvd.

It was last on the market in 2013; before then, the mansion was owned by pharmaceutical company executive Jonah Shacknai, who sold it to an investment group in 2012.

In July 2011, Shacknai’s son, Max, fell down the stairs at the Spreckels Mansion and later died as a result of his injuries. Two days after Max’s fatal fall, Shacknai’s girlfriend, Rebecca Zahau, was found dead at the property, nude and hanging by a rope around her neck from a second-story balcony above the courtyard of the home. Her highly-publicized death was later ruled a suicide by investigators. Zahau's family filed a wrongful death lawsuit in the case because they do not believe her death was a suicide.

Aurich said the tragic events in the home’s recent history do not impact the property’s value. He said the home’s impressive architectural design and prime location in Coronado cannot be overlooked, despite what happened there.

“The home has been completely renovated and is in the best state it’s ever been since it was built,” he added. “It’s the crème de la crème in Coronado.”

The property includes a 4-bedroom main house, a 3-bedroom guest house and two apartments over a four-car garage. The home also features an enclosed courtyard, swimming pool and spa.

The home’s location on the beach was chosen by John D. Spreckels in 1908, when he owned all of Coronado Island. The mansion was designed by architect Harrison Albright; the guest house was added in 1928 by architect Richard Requa.

When the Spreckels family lived there, they would often invite dignitaries and members of early 1920s high society to stay at the property. Today, Aurich said it’s one of the only large family compounds available in Coronado.

Mission Valley Macy's to Close By End of 2017

The Macy’s store in Mission Valley is among 68 stores that will be closing nationwide after the store chain reported disappointing holiday sales, the company announced Wednesday.

The store at Westfield Mission Valley has been opened since 1961 and has 140 employees, according to CNBC.

It wasn’t immediately clear when the local store would close, but Macy’s reported in a news release that 63 of the stores nationwide would shutter by this spring and two more would be closed by the middle of the year. Three more were prepared to be sold, the statement said.

The massive number of shutdowns followed a weak performance during what’s usually a boon for business: the holiday season.

For instance, Macy’s comparable sales fell 2.1 percent in November and December, according to CNBC.

The store closures will result in a about 3,900 workers nationwide losing their jobs and another 6,200 also being displaced.

Search for Armed Robbery Suspect in Mountain View

San Diego Police are searching for a man who robbed a Home Depot with a gun in San Diego's Mountain View neighborhood. 

The alleged robbery took place at the store on the 300 block of Marketplace Wednesday, police said. 

The male suspect is believed to have ran under a freeway overpass and into a canal area, where police are looking for him. They are also searching the 4600 block of Nogal Street. 

They do not have a description of the suspect. 

A helicopter is overhead assisting with the search. 

No other information was immediately available.
