Game Security's 'Inappropriate Actions' Under Investigation

A shocking video posted and shared by thousands of people on social media has prompted an investigation by San Diego Police and the company that employs security personnel for events at Qualcomm Stadium.

Elite Security has confirmed it is looking into a video clip that appears to show what the company called “inappropriate actions” by a male employee on the field of Sunday’s game between the San Diego Chargers and the Oakland Raiders.

“Elite would like to apologize to anyone who was offended by this isolated incident,” the company’s statement reads. “Additionally, Elite has opened a formal investigation into the matter and has acted swiftly in terminating the employee involved.”

In the video, a man can be seen standing facing the crowd and at least one Chargers girl as well as photographers. It appears the man has his right hand in the front of his pants and is moving his hand while looking at the cheerleaders.

The San Diego Police Department (SDPD) confirmed Tuesday they have been made aware of the situation. “We are investigating the situation,” SDPD Lt. Scott Wahl told NBC 7.

Elite Security confirmed the unnamed guard passed state and federal background screening through the State of California Department of Justice and the Federal Bureau of Investigation.

“There was nothing in the screening process that would indicate that this type of conduct was foreseeable,” the company said.

The Chargers echoed the security company’s sentiment when the team  released a statement.

“We are aware of the disturbing actions of an Elite security staff member at Sunday’s game. We apologize to any fans who may have witnessed the incident. Elite Security is currently investigating the incident and has vowed to take immediate and appropriate action."

12-Year Old Girl Ejected in Crash on Interstate 805

A 12-year-old girl was ejected from a vehicle after a crash on the Interstate 805 Wednesday, the California Highway Patrol (CHP) confirmed.

The crash occurred around 4:13 p.m. between Imperial Avenue and Market Street when a gold SUV lost control, hit another car and rolled over, CHP said.

The girl who was ejected, her parents and other children who were also in the vehicle are all expected to be ok, according ot the CHP. 

It is unknown what caused the SUV to lose control.

2 Arrests in Mira Mesa Shooting

The investigation into a mysterious shooting that locked down a Mira Mesa neighborhood has led to two arrests, San Diego Police confirmed Wednesday.

Officers blocked off several streets near Menkar Place and Markab Drive for hours beginning Monday night as the investigation into a fatal shooting led to a SWAT action.

Residents were told to shelter in place while officers searched for the person who fired a gun, striking and killing an 18 year old in the middle of the road.

The teenager died at Sharp Memorial from a gunshot wound to the upper torso, police said. A friend of the teenager pointed officers to a home at Menkar and Harlow as the possible site of the shooter.

Now, homicide investigators said the victim in the fatal shooting was actually in the Mira Mesa neighborhood to commit a crime when shots were fired Monday around 8:30 p.m.

James Carmona Martinez, 18, of San Diego was killed and two companions have been arrested in his death, police said.

Chien Ngoc Pham, 22, and a 17 year-old juvenile both from San Diego, will face criminal charges in the shooting, according to homicide Lt. Ray Valentin.

Martinez, Pham and the third suspect drove to the Mira Mesa neighborhood to commit a crime before "gunfire was exchanged" outside of a home on Markab Drive, according to Valentin.

No details were given on the type of crime the group had allegedly planned.

17-Year Old Teen With Autism Found

A 17-year old teenage boy with autism was found at a car repair shop in Kearny Mesa after he went missing Wednesday morning.

Demetrius Vitalich, 17,  was last seen at approximately 9 a.m. after he left his house for a run in University City, police said.

Police advised that the teen loved airplanes and might have gone to a location where he could see them.

Vitalick was found Wednesday night by workers at a Kearny Mesa repair shop.

"We are really really greatful to some wonderful people who hadn't even seen the reports," said Nick Vitalich, the teen's grandfather. "They saw him wondering around and knew he was in trouble and it was bumper to bumper auto repair, and they brought him in and they figured out how to call us."

Trump Calls Berlin Violence 'Attack on Humanity'

President-elect Donald Trump said the truck ramming attack at a Christmas market in Berlin is an "attack on humanity and it's got to be stopped."

Trump made the comments in brief remarks to reporters at his Mar-a-Lago estate in Florida following a top-secret security briefing. He said the violence in Germany validates his assessment of Islamic-inspired threats.

"Hey, you've known my plans all along and it's, they've proven to be right, 100 percent. What's happening is disgraceful," he said. 

Trump condemned the Berlin attack in a statement on Monday.

"ISIS and other Islamist terrorists continually slaughter Christians in their communities and places of worship as part of their global jihad," he said then. 

Asked on Wednesday about his statement that ISIS is targeting Christians, Trump said: "Who said that, when did, when was that said?"

When a reporter said it was part of his statement, Trump responded: "It's an attack on humanity. That's what it is, it's an attack on humanity and it's got to be stopped."

With Trump during Wednesday's remarks were his pick for national security adviser, retired Gen. Michael Flynn, and his incoming White House chief of staff, Reince Priebus.

Trump also said he talked to President Barack Obama two days ago, but not since then.

A man in California is recovering after an e-cigarette exploded in his pocket this week. The 53-year-old man was on a bus in Fresno Wednesday morning when the device started smoking and then burst into flames.

A powerful storm produced dangerous driving conditions and led to several highway collisions including one fatal crash in Lakeside, California Highway Patrol Officers said Thursday.

A tropical storm moving north into San Diego from Mexico brought a lot of moisture in a short amount of time beginning late Wednesday. More than an inch of rain has been reported in some communities and excess water on the roads has led to multiple crashes on our local highways.

In Lakeside, a driver died when she lost control on rain-slicked roads and crashed along eastbound Interstate 8 just before midnight Wednesday, California Highway Patrol officers said.

The driver, described as a 23-year-old woman from San Diego, crashed into the guard rail and overturned just east of Los Coches Road. CHP officials say the woman was traveling at approximately 65 mph and was attempting to change lanes before the crash.

In Chula Vista, a van driver changing a flat tire in the rain was struck by an out-of-control big rig on the shoulder of Interstate 805 at 2:23 a.m., CHP officers said.

The semi made an unsafe turn to the right, CHP officers said, and collided with the van. The van struck a man who had been standing outside the van while changing one of the tires. He suffered major injuries, officers said. A woman sitting in the passenger seat of the van was also injured.

The truck kept moving and struck a traffic sign before running off the road. The truck driver and the two people from the van were rushed to UCSD Medical Center.

In Otay Mesa, one person had to be rescued just before 7 a.m. after a vehicle became stuck in approximately 2 feet of water near Airway and La Media Road.

The San Diego Police Department advised drivers of street flooding reported at the following locations:

  • Avenida del Rio at Camino De La Reina
  • Airway at La Media
  • La Media closed from Airway to Centurion
  • Rancho Mission Road at San Diego Mission Road
  • Fairmount Avenue at San Diego Mission Road
  • Mira Mesa Boulevard at Aderman Avenue

Boulders were reported in the road in Del Cerro just after 4:30 a.m. Five large rocks fell from a hill onto Bernadette Lane. No one was injured.

San Diego was soaked by a powerful storm Thursday that may produce thunderstorms before moving east.

“It’s just a ball of energy and it’s moving very slowly,” said Whitney Southwick from the NBC 7 Weather Center.

Rain, heavy at times, will move on shore throughout the day with showers tapering off by late afternoon.

Residents in the South Bay may experience thunderstorms, Southwick said.

    The storm won't be bringing unusually cold temperatures. A second storm is expected to arrive Friday.

    The National Weather Service has issued a winter storm watch for Julian, Pine Valley and other mountain communities from Friday afternoon through late Saturday night.

    Snow levels will be near the 7,000-foot level Friday evening and will drop to the 4,000-foot level or 5,000 level Saturday morning and even lower reaching possibly the 3,000-foot level by Saturday evening, according to NWS.

    'That’s the Job': Former Hardee’s Actress on 'Sexist' Ads

    Lisa Taylor was 29 when she agreed to travel the country in a black French maid outfit to promote a cheeseburger for Hardee’s, a fast food chain run by President-elect Donald Trump’s recent pick for labor secretary.

    It was another overtly sexual social promotion from a company known for its racy advertising. As CEO of CKE Restaurants, the parent company of Hardee’s and Carl’s Jr., Andy Puzder has drawn attention for overseeing television ads that showed a swimsuit-clad Paris Hilton washing a car before digging into a cheeseburger.

    “The whole industry that you work for is sexist,” said Taylor, a stage name for the actress and teacher who lives in the Midwest. “You’re paid strictly for how you look.”

    Puzder has repeatedly defended the ads, claiming he wanted to appeal to a young, male demographic.

    “I like our ads. I like beautiful women eating burgers in bikinis,” he told Entrepreneur in 2015. “I think it's very American." 

    If approved by the Senate, Puzder will head a federal agency tasked with promoting a workforce that is nearly 50 percent women. He will also have jurisdiction for enforcing anti-discrimination laws, including sex discrimination, among federal contractors and subcontractors.

    Women’s rights advocates, Democrats and labor organizations have criticized his appointment, not least because of the depiction of women in his company's advertising.

    “To possibly have a secretary of labor who is the CEO of a company whose ads objectify women is an abomination,” Madonna Badger, who runs an ad agency that aims to promote a positive image of women, told NBC.

    Terry O’Neill, president of the National Organization for Women, said: “Mr. Puzder is promoting a deeply offensive and misogynistic view of women: that women are sexual objects to be used to sell fast food. It’s really disgusting.”

    While the company's television ads are well known, their sexualized road show hasn't received the same attention. On the tour for Hardee’s, Taylor joined three other actresses, the so-called “‘French me’ Femmes” to advertise the French Dip Thickburger across the South and Midwest in the summer of 2009.

    The sandwich consisted of sliced roast beef on top of a burger patty and melted Swiss cheese, with au jus dipping sauce on the side.

    “Meat was in essence a condiment,” David Johnson, then-creative director of Ngage, the ad agency hired by Hardee’s for the promotion, said of the meat-on-meat sandwich.

    To riff on the French-themed burger, Johnson said, the actresses dressed as maids during the tour.

    “You’re hired to portray a look and that personality type,” Taylor said of the promotion. “That led people to think they could treat you a certain way.”

    Taylor and the other actresses — clad in black miniskirts, fishnet stockings, choker necklaces and garters — teased shirtless men with feather dusters at auto races while plugging the burger. The Femmes asked men through fake French accents when they first French kissed. They offered to wipe radio hosts’ mouths after they took a bite of the burger.

    For Taylor, the job was standard. Hardee’s did not ask for anything out of the ordinary; it’s the business that is inherently sexist, she said. Dealing with “handsy” men and “creepy,” unsolicited comments is in the job description for a promotion like the Hardee’s one.

    “You’re used to that like lecherous, gross guy coming up to you. That was the whole point,” she said. “You’re wearing this French maid costume, giving out coupons. You deal with it. That’s your job.”

    The promotion was aimed specifically to attract 18 to 34-year-old men — “hungry young guys,” as Puzder describes them.

    It was a dynamic that made Taylor at times uncomfortable, but one she accepted because it was part of the job.

    “It’s almost like you put on your mask,” she said. “But if I was just an ordinary citizen living my life, I would be just grossed out if a guy was like ‘can I take a picture with you?’ or ‘you’re hot!’”

    Taylor never interacted with Puzder and was hired by an independent ad agency, not directly by Hardee's. But for Badger and other critics of the Cabinet nominee, the sort of advertising his company produced has wider implications for how women are treated in the workforce and in society as a whole.

    “Women are not props to be portrayed as scantily clad burger eating sex toys for anyone's viewing pleasure,” Badger told NBC. “Until women are portrayed as equal, we will not be treated as such.”

    CKE Restaurants and the Trump transition team did not respond to requests for comment.

    One of 78 Rescued Dogs Accepting Adoption Applications

    Looking for an adorable new addition to your family this holiday season? 

    Lucy, one of the 78 dogs rescued from an extreme hoarding situation in El Cajon, is nearly ready for adoption. 

    Because of the high interest from potential adopters, the San Diego Humane Society says she is being considered a celebrity pet and will require a special adoption application. 

    The deadline to submit the application (which you can find by clicking here) is due by 11:50 p.m. on Dec. 27, 2016. 

    Lucy, a 2-year-old dog, was covered in scabs and fleas when she was first rescued. She had thick, inflammed skin and was missing large patches of fur near her tails and eyes. She had given birth to possibly multiple litters, officials said.

    Since her arrival, Humane Society officials have been documenting her journey

    Humane Society officials said they expect the rest of the rescued dogs to be available by the end of the year and will be releasing information soon. 

    The dogs, which include Chihuahuas, dachshunds and terrier mixes, were rescued from a hoarding home earlier this month. The conditions were extremely unsanitary, officials said: the floors were completely covered in urine and inches of dog waste, and the dogs were seldom let outside.

    Stephen MacKinnon, chief of the Humane Society’s law enforcement, said officials declined to charge or cite the owner of the dogs because he was extremely cooperative in forfeiting the dogs and sought help for a mental health condition.

    Officials said in the Facebook live video that they continue to undergo medical care, but are in otherwise good condition. The medical costs for the dozens of dogs have topped $100,000, so the Humane Society is seeking community donations. You can donate here by clicking on 'donate.'

    The shelter has also received about 3,000 pounds of blankets for the dogs’ bedding, but officials say they still need more blankets and towels.

    Iconic Don Diego Clock Tower to be Demolished

    An iconic landmark at the Del Mar Fairgrounds will soon be demolished.

    The Don Diego Clock Tower was built 1953 and opened a year later, just in time for the Southern California Exposition.

    According to the Del Mar Fairgrounds website, the clock tower was based on Don Diego Alvarado known for throwing lavish parties and "regarded as the local symbol of a gracious host."

    “I think it was special back then but we certainly didn't have many buildings on the fairgrounds back then, so it really did stand out, much more than it does today,” said Shawn Feisst, spokesperson for the Del Mar Fairgrounds.

    At the time, it was a modern and unique architectural design. The character was even brought to life by actor Tom Hernandez, who portrayed Don Diego during the annual fair for 37 years.

    In 1985, a 16-foot statue of Hernandez as Don Diego was unveiled at the main entrance to the fairgrounds.

    But 63 years later, the tower is falling apart—bathrooms have not been working for more than 10 years and the clock is without any hands.

    “It's been around a very long time and its really crumbling, it's really only being held together by termites holding hands at this point,” Feisst said.

    The agricultural district, which oversees the Del Mar fairgrounds, made the decision to tear it down.

    But there will be an effort to preserve some parts of the tower.

    “We're going to replace those, someplace else on the fairgrounds and the clock as well, so we hope we can retain some of that,” Feisst told NBC 7.

    There is no set date from the demolition but it's expected to be taken down before the fair in June, 2017.

    Grandfather Said Toys R Us Wouldn’t Honor Black Friday Sale

    A Rancho Bernardo grandfather said he took advantage of a Black Friday toy sale but days after he placed his order, he feels the store took advantage of him by not honoring the advertised prices. 

    Shiv Gupta was Black Friday shopping when he and his wife came across a toy, called Ride-Ons, that he wanted to buy for his granddaughters. 

    “It has a start switch, it has a gear to go forward and back, it has a steering wheel so they can get the full experience of driving,” Shiv said. 

    The Paceman Mini-Cooper is battery operated and drives 2.5 miles per hour. 

    Shiv said he found them on sale for $99 on the Toys R Us website for Black Friday, down from the regular price of $189. 

    “They seemed perfect for our little granddaughters who are two and three years old,” Shiv said. 

    Shiv said he bought two of them and received an email from Toys R Us, saying the sale went through and he would have to pick them up at the store in four to five days. 

    Three days later, Shiv said he received another email from Toys R Us that troubled him. 

    “There’s another email from Toys R Us which says your order is cancelled,” Shiv said. 

    Shiv said he called Toys R Us and was told by a representative that the Ride-Ons were only available at the higher price, not the sale price he had already ordered. 

    Frustrated, Shiv said he felt taken advantage of by the toy giant. 

    “A colleague of mine told me about Consumer Bob and said you should email them,” Shiv said. 

    NBC 7 Responds reached out to Toys R Us to explain the problems Shiv said he was experiencing and within days, Shiv received a call from Toys R Us. 

    “Next day I got a call from Toys R Us, this was from an Assistant Manager from their corporate headquarters, and he said he wants to make things right,” Shiv said. 

    When Shiv placed his order on Black Friday, a Toys R Us spokesperson tells us they were out of the cars the store had reserved to sell at the Black Friday price. 

    Shiv said Toys R Us never explained that to him. 

    However, the Toys R Us spokesperson said they would make an exception to their policy and sell Shiv the toy cars at the Black Friday sale price. 

    Shiv told us his family decided to give his granddaughters the ride-on cars early and that they are thrilled with the gift. 

    In an email, a spokesperson for Toys R Us told us, "The issue has been resolved with the customer and the order has been placed for the item he was hoping for."

    Days Before Christmas, Thief Steals Gifts Under Tree

    A La Mesa family is not letting a Grinch steal their Christmas. 

    During a home burglary Tuesday night, the Acosta family came home to find all the presents under their tree stolen - just four days before Christmas. 

    Jesus Acosta, his wife and kids came home from their dinner to find their home on Pomona Avenue broken into. 

    "It looks like hammered in, reached in and unlocked it and went in," Acosta said. 

    In addition to their wrapped presents, other electronics - including a laptop - and their luggage are missing. They did spare some of the family's valuables, Acosta said. 

    "Didn't seem like it took very long because a lot of the stuff didn't get taken," he said. 

    But the toughest loss by far, Jesus said, was the wrapped gifts under the tree. The family is now short toys and clothes for four-year-old Alex and Ceci, as well as their cousins. 

    At first it was shocking, Acosta said, but the family is coming to terms with it. 

    "It could have been a lot worse," he said. "They could've taken a lot more stuff."

    La Mesa Police say they have not heard of other similar reports in the area, but urge neighbors to look out for each other. 

    But despite the break-in during a season normally dedicated to joy and giving, Acosta says the family is choosing to focus on the good. 

    "It'll be alright," he said. "No one got hurt."

    The family has filed a claim with their insurance company. They say this will not stop Christmas from coming.

    Woman Found Dead on SR-905

    California Highway Patrol officers shut down eastbound State Route 905 west of La Media Road Thursday after a woman was found dead on the highway.

    A traffic collision occurred in the center median area at approximately 5:45 a.m., CHP officers told NBC 7.

    A white pickup was facing the wrong way in the eastbound lanes of the highway.

    Around the same time, people also called in to CHP reporting a body in the slow lane of 905 EB just before La Media.

    CHP officers found a woman's body approximately a mile or so away from the truck.

    The woman's wallet found nearby matched the registration on the truck, CHP officials said.

    They are actively looking along city streets with cars with any front end damage.

    No witnesses have come forward, CHP officers said.

    A Sig Alert was issued for the slow lane just before La Media off eastbound SR-905.

    CHP officers also halted traffic just before Britannia Boulevard for a short time.

    Dashing All the Way: USPS Braces for Busiest Delivery Day

    Expecting a package today? You're not alone — the U.S. Postal Service expects Thursday to be its busiest day for deliveries all year. 

    Thirty million packages are expected to be dropped off at homes and offices around the country, according to the USPS's projections. That's roughly one package per every 10 people in the United States, and it doesn't account for packages delivered by UPS, FedEx and other shippers. 

    The busiest projected delivery day comes three days after what USPS estimated would be its busiest mailing and shipping day. 

    It all caps off an exceptionally busy holiday period for the nation's post offices. 

    About 16 billion cards, letters and packages were projected to be delivered throughout the holiday season, which stretches from Thanksgiving to New Year's Eve. That includes 750 million packages, up 12 percent from 2015.

    And it's not too late to get a package delivered before Christmas — the last day the USPS recommends you can ship packages by to make sure they arrive by Saturday is Friday, though you'll have to use the Priority Mail Express service.

    Video of Chewbacca Caroling 'Silent Night' Goes Viral

    The latest yuletide video featuring Chewbacca is much, much better than 1978's much-maligned "Star Wars Holiday Special."

    Popular YouTube channel "How It Should Have Ended", which normally creates short cartoons with alternate endings to movies and TV shows (including the Star Wars films), posted a mash-up of scenes of the galaxy's most famous Wookie appearing to sing "Silent Night."

    The channel explained that the video is one that gets re-shared every holiday season, but was actually created in 1999 by Scott Anderson.

    On his website, Anderson explains that he made the song after a coworker gave musician Paul Todd the nickname "Chewbacca." Anderson said that Todd had worked with his company to create a CD titled "Christmas with Paul Todd," so he started by creating a new album cover featuring Chewbacca. 

    Anderson said he decided to take the goof one step further and mapped sounds of Chewie's trademark growls and roars onto a synthesizer, which he then played to the tune of "Silent Night."

    "How It Should Have Ended's" video adaptation of Anderson's song has already been viewed more than 500,000 times since it was posted Wednesday. The video also became a trending item on Facebook Thursday.

    Men Pulled From JetBlue Flight With Ivanka Trump Aboard

    A New York man and his husband were removed from a Jetblue flight after an incident involving the daughter and son-in-law of President-elect Donald Trump.

    Hunter College professor Matthew Lasner said in a tweet that his husband went to "harass" Ivanka Trump and her husband, Jared Kushner, as they boarded a plane at John F. Kennedy airport on Thursday. 

    In a second tweet, Lasner said that his husband "expressed displeasure in a calm tone, JetBlue staff overheard and they kicked us off the plane."

    He also tweeted a photo of what appeared to be the president-elect's daughter sitting on the plane.

    Lasner later deleted the tweets.

    JetBlue said in a statement that the couple was rebooked on another flight and that the "decision to remove a customer from a flight is not taken lightly."

    "If the crew determines that a customer is causing conflict on the aircraft, the customer will be asked to deplane, especially if the crew feels the situation runs the risk of escalation during flight," the company said in the statement. "In this instance, our team worked to re-accommodate the party on the next available flight."

    In a Facebook post, Marc Scheff, a passenger on the flight who witnessed the exchange, wrote that Lasner's husband did not yell at Trump or "accost her." Scheff told NBC News that the professor appeared agitated and said, "Oh my God. This is a nightmare. They ruin the country and now they ruin our flight!"

    Scheff explained in his Facebook post that the flight was delayed because Trump's family had to board the flight first through some other entrance.  

    "The comments were definitely for everyone but he was directing them towards her," he said.

    He continued: "When the JetBlue staff went back to speak to the man I overheard Ivanka say to them 'I don't want to make this a thing.' My assessment is that she was happy to let the man take his seat. Security made a different call."

    The President-elect's daughter and her family landed at San Francisco International Airport around 3 p.m. local time, and were immediately whisked off in a private car to a chartered plane that was waiting on a nearby tarmac.

    A representative for Ivanka Trump declined to comment on the exchange. A spokesperson said she and Kushner were on a flight to San Francisco en route to Hawaii at the time.

    San Diego is among the nation’s highest-growth markets for single-family rentals, according to HomeUnion, an online real estate investment management firm that on Tuesday released a list of the U.S. rental markets with the highest year-over-year growth.

    Seattle tops the list, with rent growth of 6.7 percent. However, the average cost of renting a single-family home in Seattle, $2,220, remains lower than the average cost of doing so in San Diego. San Diego, where single-family rentals average $2,520, came in ninth on HomeUnion’s list with year-over-year growth of 4 percent.

    "Many of the metros at the top of our list have these two common characteristics: strong job growth, and residents who prefer renting over homeownership as median home prices remain relatively high and the cost of mortgage debt continues to increase," said Steve Hovland, director of research at HomeUnion.

    Still, while the hottest rental markets continue to have very high rents, HomeUnion’s research revealed that growth slowed in those regions in the past year, Hovland said.

    "We're seeing declines in rents for the most expensive Bay Area neighborhoods, as well as slowing rent growth in San Jose submarkets,” he said. “However, rents remain extremely high on a relative basis in both these markets – in the $4,000 range."

    El Paso landed at the bottom of the list with a 7.1 percent decline in year-over-year rents.

    Trump Insists He'll 'Drain the Swamp' as Gingrich Walks Back 'Boo Boo'

    Former House Speaker and Donald Trump ally Newt Gingrich is walking back his claim that the president-elect will not prioritize his campaign promise to "drain the swamp" in Washington, a charge that came after Trump selected a series of wealthy donors and business executives for his White House team, NBC News reported.

    Gingrich suggested in an interview with NPR earlier this week that Trump was no longer enamored of the pithy pledge, claiming Trump "now says it was cute, but he doesn't want to use it anymore."

    But in an online video posted Thursday, Gingrich said that the statement was "a big boo-boo," adding that Trump assured him in a conversation Thursday that "he intends to drain the swamp."

    Without mentioning Gingrich by name, Trump tweeted that "we will always be trying to DTS."
