Prison Law Repeal Urged By Former Lt. Governor

Critics of California's controversial prison "realignment" program are now looking to repeal it -- at the ballot box.

Leading the charge for an initiative campaign is former lieutenant governor Abel Maldonado, who's raising money to run for governor.

Since October 2011, under Assembly Bill 109, state prison parolees have been supervised by local probation officers.

And newly sentenced, non-violent, "low-level" felons have been sentenced in county jails.

Meantime, with crime rates on the rise, calls have been mounting to unwind the system.

Maldonado prominently added his voice during a sidewalk news conference Monday outside the county’s central jail downtown.

"This was not designed to hold four, five and six-year sentences!" he exclaimed, waving an arm at the jail entrance as journalists and news photographers recorded the event.

Abel Maldonado said he’s concerned that ex-convicts locked up for misdemeanors since late 2011 can be released early to make room for newly sentenced felons -- and then go on to commit serious crimes all the way up to murder.

"In the olden days, pre-early release, the District Attorney could say, 'This is a threat,' and send them back to prison,"  Maldonado said.

But with federal courts ruling California's prisons overcrowded to the point of "cruel and unusual punishment", there's no room in the penitentiaries.

Maldonado said that means new prisons should be built, current ones expanded, and old ones re-opened.

"We have to look at increasing capacity in California,” he said, explaining that providing funding ought to be a top priority in Sacramento. “And it should be the responsibility of the governor and the Legislature -- but mostly the governor.  Governors get what they want.  But since they're not doing anything, we're going to take it to the people of California."

But rehabilitation experts argue that prison construction alone is an approach that ignores the larger issue of reducing recidivism rates hovering above 70 percent.

"Brick and mortar doesn't work --  I mean, there is no such thing as rehab in prison,” says Scott Silverman, founder of With Tough Love and Second Chance, community-based programs for returning troubled individuals to society.  "Putting more people on the inside, in institutions with no tools to prepare them to come outside -- all we're doing is building a bigger, better recidivism machine,”

With that in mind, Sheriff Bill Gore is looking forward to opening a 400-bed "re-entry" facility at the county’s Otay Mesa jail complex, to better prepare inmates for release and reduce a men's jail capacity factor of 99 percent.

“We're looking at alternatives to incarceration, to make beds so we don't have to do early releases for the more serious felons,” Gore said in an interview Monday. "We're doing in-custody ankle bracelets.  We're putting people into work-furlough programs. Those types of programs make room for the people who need to stay in jail."

Gore said he sees no simple, affordable solution close at hand to a problem that’s been developing for two decades: “As the prison population grew, the recidivism rate climbed, and the state did not build more capacity in the system … the state looked at realignment and felt that's the better way to approach this than releasing people early from the state prisons."

Maldonado's initiative -- aimed at the November ballot next year -- would require the valid petition signatures of more than half a million registered voters.

It's shaping up as the key platform plank of a gubernatorial bid, for which he's established an official.

The victim managed to get away and flag down a passing motorist, according to deputies.

Neighbor's Dad Charged in 6-Year-Old's Shooting Death

The New Jersey father of a 4-year-old boy who accidentally shot and killed his 6-year-old neighbor has been arrested, accused of having multiple unsecured weapons accessible to children, officials said.

The Atlantic County prosecutor's office announced Monday that Anthony Senatore, 33, has been charged with six counts of child endangerment and a disorderly person's offense for enabling access by minors to a loaded firearm.

Senatore's son and 6-year-old Brandon Holt were playing in their neighborhood April 8 when the 4-year-old got a loaded .22-caliber rifle from his family's home and shot Brandon in the head, authorities said. The boys were about 15 yards apart.

Brandon died at a hospital a day later.

Police were seen carrying multiple firearms out of the Senatores' home after the shooting. Anthony Senatore was known to be an avid hunter, and his three children have names associated with hunting terms, according to law enforcement sources and neighbors.

Brandon's grandmother told NBC 4 New York at the time she was angry the family failed to take enough caution in locking up their guns.

"I can't believe that they found 11 guns in that house," said Donna Elefante. "I mean, with three kids? Give me a break."

Attorney information for Senatore was not immediately available, and a phone number was not listed.

The Atlantic County prosecutor's office took over investigation of the case early on because the Senatores have relatives who worked in law enforcement in Ocean County, where Toms River is located.

One resident said the two families had not lived in the neighborhood for long and she did not know them well.

“I'm sad for the children involved and their families, but I'm angry with whoever owns that gun and allowed a little child to get hold of it,” Debi Coto, who lives a few doors down, said after the shooting.

Teen Helps Save Woman from Burning Home

Neighbors rushed to save a woman from a burning house in Carlsbad Monday. The youngest rescuer was a 13-year-old boy.

Matt Shearin, a student at Oakcrest Middle School, said he heard his father screaming about a fire three doors down.

One of the neighbors said he heard a woman screaming from a second story window of the home on Corte La Paz just before 7 a.m.

“I looked out and there were flames coming out and I said ‘Oh God, it’s not good,’” Shearin told NBC 7 San Diego.

Without thinking, he immediately rushed to help his father.

“He's trying to get the ladder but his back kind of hurt,” he explained.

So Shearin grabbed the ladder from his dad, ran under a bush and hoisted the ladder to the window.

Another neighbor climbed the ladder and grabbed an 82-year-old woman out of the house.

Shearin’s father hosed the house down with water his mother called 911.

When the engines arrived, they reported flames out of that window,” said Carlsbad Fire Chief Mike Davis. “She would’ve been forced with a terrible decision to have to make.”

“When you’re in your mid-80s, making a jump even from the first floor is really hard,” Davis said.

An hour later, the woman's cat was rescued.

The 82-year-old woman was taken to the hospital with minor burns and smoke inhalation.

The cause of the fire is under investigation.

Girl Drowns, Sibling in Grave Condition

An 18-month-old girl has died of an apparent drowning and her older brother is hospitalized in what officials describe as grave condition.

The girl and her 2-year-old brother were found unresponsive in a pool at 10011 Sunset Ave. Monday, said San Diego County sheriff's deputies.

Their mother was visiting a park resident when the children wandered off and ended up unresponsive in the pool, according to the sheriff's department.

The mother initially told investigators that the children were in the pool at the Lamplighter Mobile Home Park, instead of the pool at the Sunset Avenue residence. Lt. Glenn Giannantonio said the reason she did not provide the actual location was to protect the homeowner from getting into trouble.

In an attempt to get the children to the hospital, the mother and her friend drove the children in a black pickup truck to Grossmont Hospital.

On the way, they stopped outside La Mesa Fire Station 13 Grossmont Boulevard and asked firefighters to help deputies said.

Firefighters administered first aid and took the children and their mother to Sharp Grossmont.

Staff pronounced the girl dead and transported the boy to Rady Children's Hospital for further treatment.

The mother's friend left the scene of the fire station prompting a search by authorities. Deputies believe the man may be wanted on an unrelated warrant. He has not been located.

While investigators looked at the home on Sunset Avenue, they located a marijuana grow in the basement. Narcotics Task Force investigators have been called to the scene.

Investigators want to speak with the man who drove the children to the hospital to corroborate the mother's story and want to stress they do not consider him at fault in the drowning.

Anyone with information about this incident is asked to call the Homicide Detail at 858-974-2321.

A fire burned near Lakeside at Wildcat Canyon Road and Barona Road on Monday, according to CAL Fire.

Around 3:15 p.m. smoke and flames could be seen burning roughly 2 miles north of Barona Casino. The fire also started near a gun range, though it is uncertain if that is the cause.

The blaze grew to 17 acres in size, but firefighters were able to surround and extinguish it.

California Highway Patrol shut down Wildcat Canyon Road in both directions near the fire, and a SigAlert was issued. Wildcat Canyon road is closed between San Vicente and Founders Way until 7 p.m.

San Diego Gas & Electric also responded to the scene for power lines down in the area.

Two helicopters, four tankers and 70 firefighters responded to the scene.

N. Miami Mayoral Candidate Claims Endorsement From Jesus

A North Miami mayoral candidate who earlier claimed she was being intimidated with voodoo tactics now says she's secured an endorsement from on high.

Anna Pierre, a registered nurse and one of seven candidates looking to become the city's mayor during Tuesday's election, is claiming she is being endorsed by Jesus Christ.

"Yes, Jesus endorsed me!" Pierre said during a stop at the Gwen Margolis Community Center Tuesday morning as the polls opened. "I'm not nuts, if I'm a freak and nuts for Jesus, let it be! Let the world know that Jesus is it and when you have Jesus on your side you can go on."

The claim was made on a campaign flyer posted to Pierre's Facebook page that reads "Anna Pierre, RN, is endorsed by Jesus Christ" and features a photo of the savior.

Salaries of South Florida Mayors

Pierre said the endorsement came to her in a revelation while on the campaign trail as she's been competing against six other candidates.

"I don't know about if he likes me more, but what I can tell you, I know he loves me very much," Pierre said. "If it wasnt for the love of Jesus I wouldn't be standing here today."

Last month, Pierre, a Haitian native who recorded a hit pop song before coming to America, claimed someone had placed voodoo artifacts outside the door of her campaign office.

The items included candles, food and dolls with pins stuck in them, said Pierre, who believes one of her opponents may have been behind the intimidation.

North Miami Mayor Exploited Position to Use Soccer Fields for Free: Ethics Commission

"The voodoo stuff, I don't know who's doing it, but I'm not afraid," she said at the time. "It's just intimidation to ... slow me down. But you know what? I'm not going to slow down until the finish line."

Voters Tuesday remained slightly skeptical of the Jesus endorsement.

"Well, I thought 'I wonder if I ought to vote for this person to maintain the cosmic balance,'" Grover Rawlings said. "I mean, I want to stay on the good side, it's a pretty powerful endorsement if it's true."

Others took the self-proclaimed revelation sincerely.

"Well, like I said, I'm Christian and if she believes it, I've never heard it before, but you know, she could've been," Ann Simpson said.

Pierre is going up against fellow candidates Gwendolyn V. Boyd, Kevin Burns, Modira Escarment, Smith Joseph, Jean Rodrigue Marcellus and Lucie M. Tondreau.

Cancer survivors and fellow celebrities are praising Angelina Jolie's decision to undergo—and share the deeply personal details about— a preventative double mastectomy.

The surgery was completed last month after Jolie discovered that she carried the "faulty" BRCA1 gene and her doctors estimated that she had an 87 percent chance of developing breast cancer.

In a widely shared op-ed published in The New York Times Tuesday, Jolie explains that her mother had died of breast cancer and she wanted to take a proactive role to avoid having the same fate.

She explained that she decided to share the details of her medical decision to inspire other women to be proactive about their health.

"I hope that other women can benefit from my experience," she wrote. "Cancer is still a word that strikes fear into people's hearts, producing a deep sense of powerlessness. But today it is possible to find out through a blood test whether you are highly susceptible to breast and ovarian cancer, and then take action."

Salk Drug May Reverse Alzheimer’s Damage

Scientists at the Salk Institute in San Diego have developed a new drug that reduced memory loss in mice, which may help Alzheimer patients.

The new drug could help treat millions of people living with the disease and it might even offer a cure, according to researchers.

Researchers at the Salk Institute said all of the current Alzheimer's treatments just manage the symptoms of the disease, while this one would treat the disease itself.

The drug is called J-147.  Scientists put the drug in the food of 20-month-old genetically engineered mice.

Researchers said with just three months of treatment, the drug reduced the memory loss in the mice and significantly slowed down their Alzheimer’s.

The Salk team treated mice using a therapeutic strategy that they say more accurately reflects the human symptomatic stage of Alzheimer's.

Usually when Alzheimer's drugs are tested on mice, the mice receive treatments before they have Alzheimer's. But in this case, researchers waited until the mice were really old and had severe memory loss.

“So this really does have the potential to be disease modifying so in addition to what's already out there that helps memory problems for a short period of time we expect that J-147 would do the same thing.,” said Marguerite Prior, a research associate at Salk Institute

Meaning this drug could hopefully stop the progression of the disease, if not even cure it.

The team hopes to raise the $1.5 million they need to get this drug to clinical trials. Once they do that, they'll be able to determine whether the drug will work on humans.
