Trampoline Warranty Voided due to Bad Weather

An Eastlake family contacted NBC 7 Responds after they said a company voided the warranty on their trampoline, citing bad weather in San Diego as one of the reasons behind the decision.

Carol Grady has three active boys but one of them faces a challenge.

“There are three things our autistic child loves: trampoline, sand and water,” Carol Grady said. “It brings him a world of happiness.”

Not only does he love it but she says it’s one of the few things that helps him socialize and exercise each day.

Carol said she was concerned though when she discovered a hole in the safety netting that surrounded the trampoline. The Gradys had purchased the trampoline from Kmart and were offered a two-year warranty plan at the checkout stand. When Carol called after finding the hole, she says things didn’t go smoothly.

“They initially told me it wasn’t covered due to the weather,” Carol said. Carol said the representative told her San Diego’s winter rains voided the warranty but the fine print of the warranty didn’t say anything about rain.

“They list tornadoes, hurricanes, high winds, if it had been struck by lightening or had rolled over,” Carol explains.

But, Eastlake and San Diego County, rarely experience this type of weather. So, after three months of trying to get the warranty honored, Carol decided to call NBC 7 Responds.

About a week after NBC 7 Responds reached out to Kmart, a representative with the store said instead of replacing the net they would send the Grady’s a gift card to buy a brand new trampoline and net.

Kmart also refunded the Grady’s’ money for the first trampoline including taxes and the warranty.

In a statement, a representative from Kmart said, "After learning of this concern, the member services team worked quickly to research the warranty in question. The team has since spoken to the member and resolved the concern to her satisfaction by issuing a full comparable replacement of the trampoline. We value our members' and customers' experiences above all else and are happy to have this matter resolved."

ACC Pulls Championships From North Carolina Over Bathroom Law

One day after the NCAA voted to move championship tournaments and other games from the state of North Carolina over a controversial law that some say can lead to discrimination against LGBT people, the Atlantic Coast Conference has followed suit.

The ACC Council of Presidents voted Wednesday to relocate all of the league's tournaments and championship games from the state for the 2016-17 year, citing HB2's inconsistency with the ACC "values of equality, diversity, inclusion and non-discrimination."

"Every one of our 15 universities is strongly committed to these values and therefore, we will continue to host ACC Championships at campus sites."

Both Florida State University and the University of Miami are ACC member schools.

The law requires transgender people to use restrooms at schools and government buildings corresponding to the sex on their birth certificates, and not the one they identify with. It also excludes gender identity and sexual orientation from local and statewide antidiscrimination protections. HB2 was signed into law earlier this year by Republican Gov. Pat McCrory, who has defended it as a commonsense safety and security measure.

“Today’s decision is one of principle, and while this decision is the right one, we recognize there will be individuals and communities that are supportive of our values as well as our championship sites that will be negatively affected,” said ACC commissioner John Swofford. “Hopefully, there will be opportunities beyond 2016-17 for North Carolina neutral sites to be awarded championships.”

The ACC was scheduled to hold 14 of its 21 championship events in North Carolina this academic year, with 10 of those at neutral sites and the other four on the campuses of Wake Forest (field hockey), Duke (fencing), North Carolina (softball) and N.C. State (wrestling).

The first of those neutral-site events, which are pre-determined championship locations regardless of the teams competing, was men's and women's cross country that was set for Oct. 28 in Cary.

This action by the ACC is the latest in a steady stream of public and business backlash against the law.

The NBA moved its 2017 All-Star Game to New Orleans instead of hosting it in Charlotte as originally scheduled because of the law. Duke's men's basketball schedule had to be reconfigured when Albany backed out due to that state's travel ban, and the Vermont women's basketball team has canceled a December trip to play North Carolina in Chapel Hill.

Entertainers like Bruce Springsteen, Pearl Jam and Ringo Starr have canceled plans to play in North Carolina. And PayPal reversed plans to open a 400-employee operation center in Charlotte.

A junior linebacker at the University of North Carolina at Chapel Hill who accused of sexual battery and assault on a female student  turned himself in Wednesday, NBC News reported.

Allen Artis, 21, was suspended from the football team after his accuser, a fellow student, publicly came forward in a news conference Tuesday.

Delaney Robinson, 19, said the incident occurred this past Valentine's Day. She contacted police, the university and got a rape kit but she became frustrated when the university's investigation appeared to stall.

The Orange County Magistrate's office issued arrest warrants for Artis for misdemeanor assault on a female and misdemeanor sexual battery. Artis was released on a $5,000 bond. Orange County District Attorney Jim Woodall told NBC News on Tuesday that its case was still open pending lab results and further investigation.

A man has been arrested in the arson attack at a Fort Pierce mosque, authorities said Wednesday.

Joseph Schreiber, 32, was arrested in the attack, St. Lucie County Sheriff's Office officials announced at a news conference.

Authorities said Schreiber faces felony first-degree arson. Officials classified the attack as a hate crime.

St. Lucie Sheriff's deputies say tips from the community led to the Schreiber's arrest Wednesday. He was picked up by police while walking in Port St. Lucie.

Officials revealed that surveillance video showing the suspect on a motorcycle also helped them connect the dots. Authorities also conducted a search warrant at the suspect's home after the arrest.

No one was injured in the fire, which was started late Sunday at the Islamic Center of Fort Pierce and burned for more than five hours before it was extinguished Monday.

The surveillance video from the mosque showed a man on a motorcycle approach the building with a bottle of liquid and some papers, then leave when there was a flash.

The fire was started on the 15th anniversary of the 9/11 terrorist attacks. The mosque had been attended by Orlando nightclub gunman Omar Mateen.

Authorities said Schreiber has made anti-Islamic comments on his Facebook page. They also said he has a criminal past.

If convicted, Schreiber faces a minimum 30-year prison sentence.

US to Boost Number of Refugees to 110K in 2017

The Obama administration is planning to increase the number of refugees it will allow into the U.S. in 2017 to at least 110,000, NBC News reported.

It's a 30 percent increase over the current fiscal year and a more than 57-percent jump since 2015. The increase "is consistent with our belief that all countries should do more to help the world's most vulnerable people," a State Department official told NBC News.

Of the 110,000 refugees the U.S. intends to admit, at least 40,000 are from the Near East and South Asia, a White House senior administration official said. Most have been trying to flee the Syrian civil war.

The administration's move comes as many GOP lawmakers and Republican presidential nominee Donald Trump warn that Islamic terrorists could be hiding among the refugees.

Renewed Push to Find Man Accused in 2 Violent Sex Assaults

$

Authorities are asking for the public's continued help in finding an 'armed and dangerous' suspect wanted in connection with two violent sexual assaults, more than a month after the assaults occurred.

Jeremiah Williams, 24, is wanted for two August attacks: the University City sex assault and another assault that happened the day after at a Motel 6, according to San Diego Police Department Capt. Brian Ahearn.

Authorities are asking for the public's continued help in finding the suspect.

Williams is described as being 5-foot, 11-inches and 180 pounds. He has the numbers "210" tattooed on his right wrist and an outline of the State of Texas tattooed on his left forearm. He also has wings tattooed on both upper arms.

Anyone who sees Williams is asked to call 911. Police believe he is still in the San Diego area.

Physical evidence from the scene of the first University City sex assault linked Williams as the suspect, Ahearn said.

The University City sex assault happened on Saturday, Aug. 13 when a woman was attacked at the Venetian Condominiums on Nobel Drive.

The woman had been dropped off outside the complex around 10:30 p.m. and was walking to her apartment when she thought someone was following her.

Before the victim could unlock her door, the man knocked her to the ground and asked her for money at gunpoint. After giving him the money, the woman was dragged into her apartment where police say she was beaten and sexually assaulted.

Three days after that incident, San Diego Police were called to Sharp Memorial Hospital for a report of a separate attack. A 23-year-old woman told police she had been violently sexually assaulted on Sunday, Aug. 14 at a Motel 6 on Alvarado Canyon Road in Mission Valley.

"The suspect, who she had recently met, entered her room choked and sexually assaulted her and then hit her in the head with a hand gun," Ahearn said.

After the interview, sex crimes detectives went to the motel and collected evidence.

During their investigation, detectives found that officers initially responded to the incident at the motel as a report of a man hitting a woman.

Witnesses told police Sunday night they heard the victim yell for help, and the suspect fled on foot.

The Motel 6 manager told NBC 7 that the victim smashed a window in the room and drove off in a car before police arrived at the scene.

In a strange twist, investigators say police officers had the suspect in handcuffs after the second attack but weren't aware of the allegations until days later when the victim came forward.

Authorities located the suspect in a nearby canyon with a hand gun, Ahearn said. Initial statements given to California Highway Patrol (CHP) officers placed Williams at the scene, and he was cited with a misdemeanor gun charge and released.

It was only days later that police linked Williams as the suspect in the motel sex assault.

Physical evidence and victim interviews linked Williams to the Motel 6 sex assault and to the University City sex assault, Ahearn said.

The suspect remains at large; he is considered armed and dangerous. He has a criminal background in California and Texas.

Community Members React to Resignation of Randy Ward

Details of the separation agreement between Superintendent Randy Ward and the County Office of Education came to light Wednesday afternoon.

Ward resigned Tuesday night after calls for his removal and being placed on paid administrative leave in July. A lawsuit alleges Ward took unauthorized pay hikes under a controversial "me too" clause that say every time teachers get a raise, the superintendent and potentially other top district officials do too.

The board agreed in closed-session to pay Ward about $35,000 to resign by Nov. 15 in a 5-0 vote, according to NBC 7 sources familiar with the negotiations.

The board also agreed to pay any legal fees Ward incurs because of pending lawsuits brought against the district and Ward.

There's a caveat though: the legal funds won't cover any criminal defense and Ward agreed to return the money if he is convicted of any criminal charges.

Community members who spoke with NBC 7 on Wednesday say now that Ward is gone, it is time for the district to move on.

"I think that people should be able to move on," said Reverend Shane Harris from the National Action Network. "The board is going to move forward and start selecting a new superintendent and I think the community needs to start moving forward now to focus on education."

Harris was vocal in criticizing the district on transparency over how public funds are spent and one of the county schools' top attorneys, Dan Shinoff.

The lawsuit alleges Ward's extra pay increases amounted to between about $70,000 to $100,000 between about 2008 and last July.

The board released a statement on Tuesday night, which in part, read:

"Dr. Ward and the Board have agreed that it would be in the best interests of all involved to reach an amicable separation at this point in time. We also wish to reiterate that the placement of Dr. Ward on leave was not, nor was it intended to be, any kind of assertion that the allegations of the California Taxpayers Action Network lawsuit have any merit."

SANDAG Receives $1 Billion Grant for UTC Trolley Project

$

San Diegans could soon take the Metropolitan Transit System (MTS) Blue Line further north, thanks to a newly secured federal grant helping fund the project.

The Federal Transit Administration (FTA) signed a federal grant agreement with the San Diego Association of Governments (SANDAG) on Wednesday pledging $1.04 billion to the city’s Mid-Coast Corridor Transit Project.

The $2.17 billion project will extend the MTS Blue Line nearly 11 miles from Old Town to the Westfield UTC shopping center. Projected stops in between include Tecolote Road, Clairemont Drive, Balboa Avenue, Nobel Drive, the VA Medical Center on Ja Jolla Drive, UC San Diego, Voigt Drive and Executive Drive.

The Blue Line currently runs from San Ysidro to the downtown Santa Fe Depot.

“FTA is proud to partner with San Diego to bring new transit options to this growing region,” said FTA Acting Administrator Carolyn Flowers. “With the population along the Mid-Coast corridor expected to grow nearly 20 percent in the coming decades, this trolley extension will offer a much-needed alternative to traffic congestion in the years ahead.”

The FTA grant comes by way of its Capital Investment Grant (CIG) Program, the federal government’s primary grant program for funding major capital investments.

The official signing of the grant has made $100 million immediately available to SANDAG while the rest of the funding is scheduled to come in payments over the next 10 years, subject to annual Congressional approval.

The rest of the funds needed for the project will come from TransNet, the countywide half-cent sale tax increase dedicated to improving regional transportation. According to TransNet, funds from the tax hike will also support operation of the Mid-Coast Corridor Transit Project through 2048.

“The Obama Administration is committed to investing in transportation projects that improve mobility and provide ladders of opportunity for residents,” said U.S. Transportation Secretary Anthony Foxx. “San Diego’s Trolley extension will do just that by helping thousands of transit riders to access employment, education, healthcare and other important services.”

According to SANDAG, the extension project will produce more than 14,000 new local jobs and will support more than 325,000 jobs once it is completed.

Pre-construction preparation has already begun, and primary construction is expected to begin in October. Service on the new extended line is expected to open in 2021.

San Diego County Sheriff's officials (SDSO) are searching for a man wanted for breaking into a consignment store, twice, and stealing $80,000 worth of jewelry.

The suspect, described as a man in his late 40s, broke into the Consignment Classics store on the 200 block of Encinitas on two different occasions, deputies said.

On Aug. 20, the suspect broke into the store around 3 a.m., deputies said. He took approximately $30,000 in jewelry from a display case.

More than two weeks later, on Sept. 2, the suspect broke into the store again at approximately 5:30 a.m. He nabbed approximately $50,000 worth of jewelry from a display case.

The store manager says she hopes it doesn't happen again.

"The way we feel is, we're all family here so we're all taking it personally," said Lee Baker. "It's a family owned business and so all of us feel hurt."

Rose Soto, a customer at the consignment store, also works at a nearby dentist's office.

"[I] feel really bad for them because they're really nice ladies and the people that put their stuff there, I feel bad for them also," she said.

She told NBC 7 that her home was broken into in the past so she understands what the store owners are going through.

"I had my house broken into years ago and you know, its a feeling you don't recover [from], you don't recover," she said. "Your belongings are gone and you can't replace them."

The theft is impacting not just the store, but also the customers said Baker.

"You're not only dealing with employees and the owners, you're also dealing with the customers. It affects all of us, it all trickles down now unfortunately," she said.

The suspect is described as a 6-feet-tall man that weighs approximately 200 pounds. He was last seen wearing prescription glasses, a black sweater, dark pants and tennis shoes. He was seen carrying a duffel bag with a shoulder strap.

Anyone with information on this case should call the North Coastal Sheriff’s Station at (760) 966-3500 or the Crime Stoppers anonymous tip line at (888) 580-8477. Crime Stoppers is offering up to a $1,000 reward to anyone with information that leads to an arrest in this case.

Local Bakers Win Grand Prize on 'Cake Wars'

Two local bakers stole the show -- and won the grand prize -- on Food Network's Cake Wars with a larger-than-life Powerpuff Girls cake.

Escondido baker Linda Caro, owner of Little Hunnys Cakery, and her assistant, Alicia Becerra, owner of Alicia's Delicias, competed on the Sept. 12 episode of show.

Caro said she was first contacted through Instagram, asking whether she would be interested in competing. She took a some time to think about it before she said, "Why not? I'll give it a shot!"

Once she picked her assistant, Becerra -- "I was so relieved" she said yes, Caro said -- the pair submitted an audition-esque video and were sent contracts to compete on the show.

The bakers faced off against three other teams in the Powerpuff Girls-themed episode.

For the first round, Caro made sweet Mac 'n Cheese, replacing the cheddar cheese with mascarpone cheese and adding sugar and spice (and all that's nice).

But the main event was the larger-than-life cake made as a homage to the Powerpuff Girls. Caro had four hours to create a massive cake with Becerra and two additional assistants.

Caro had the team working on baking, fondant designs, hand painting and 2D fondant work. She recalled the uphill battle as she looked up and saw the clock.

"The two hour mark hit and we were so far behind, I didn't think we were going to finish," Caro said.

Judges Waylynn Lucas, Richard Ruskell and the three girls who voiced the Powerpuff Girls. They eliminated one contestant right off the bat, so Caro and Becerra faced off against another team.

"I was beyond nervous, my whole body was shaking," Caro said. "My lips quivered. I could envision them saying the other contestants name."

Caro said when she finally heard host Jonathan Bennett call out her name, she couldn't believe it.

"I was so shocked, my jaw dropped," she said. "I immediately started crying."

When the team cleaned up, they headed over to Food Network headquarters, where they presented their cake and celebrated the Powerpuff Girls at a party.

The experience was one of the most rewarding experiences, Caro said.

"It was the most stressful and nerve wracking thing I have ever done, but it was by far the most rewarding," she said.

The episode aired on Sept. 12.

Wal-Mart customers will be able to use a handheld device to summon an empty cart and have it whisked their way via "motorized transport unit," according to Wal-Mart's patent, granted last week. The customer's location is determined by optical sensors in the device which will receive information from smart LEDs in the store, NBC News reported.

The system's "central control circuit" will also track shopping cart idle times to see which ones are not being used and implement image sensors to make sure they're empty.

And the carts will even be able to return themselves.

"The Super School Project was born out of the conviction and commitment that every child from every background has a right to a quality education that prepares them for a future none of us can easily predict," said Russlynn Ali, Chief Executive Officer of XQ Institute.

The Super School Project was created by Emerson Collective in 2014 as part of President Obama’s My Brother’s Keeper Initiative. Participating high schools were asked to offer ideas and create models which challenge students to become critical thinkers to solve real world problems—as a form of the next level of high school learning.

The high school was selected after an 11-month application and evaluation process that began in March of this year.

A group of Vista High students created a model for a new learning platform which was submitted to XQ. After students put that platform to use this year, those who struggled in a traditional style of learning in the classroom are already seeing improvement.

"The statistics for the other kids, they’re going to grow tremendously because every student will be able to go through this new model,” said student Bella Rivera.

Rivera, a senior at Vista, played a major role in creating the model for the learning platform.

"Instead of just learning about it, we get to do something to make a change,” she said.

Although she will not be able to experience the model being implemented at the school, she said she is excited about the opportunities it presents for other students.

"I had no words honestly. I was just shocked,” she told NBC 7, speaking of the moment she found out that her school was a winner. “So, I'm just really excited to see what that's going to do for Vista High School."

Vista High School Prinicipal Anthony Barela said they are thankful for being chosen as the winner and excited for students to tackle issues outside of the classroom.

"Real world problems such as poverty, quality education and giving them the skill set to be change agents not only within our site, within our city, but worldwide,” he said.

The school will receive the $10 million over the next five years to implement the new learning model.
