Padres Beat Pomeranz In Petco Park Return

$

For half the season, Drew Pomeranz was the Padres best starting pitcher.

Over the past two months, the All-Star settled into the AL division race nicely as he acclimated to his new surroundings in Boston.

Pomeranz’s return to Petco Park on Monday however did not go entirely as he had planned.

Adam Rosales hit a 2-run homer off his former Padres teammate to spoil the All-Star’s first visit back to San Diego since the Midsummer Classic.

That one swing wound up being enough to help the Friars hang on for a 2-1 victory and spoil Pomeranz’s cameo.

On Labor Day, Pomeranz worked 5.2 innings and struck out five while only allowing six hits. But two of those hits came in the 4th when Poway native Alex Dickerson singled safely right before Rosales went yard.

The lefty however was solid in his first game back at Petco Park since pitching a scoreless inning for the National League back in July.

Pomeranz was traded later that week to the Red Sox in a deal that brought back highly-touted pitching prospect Anderson Espinoza.

San Diego starter Edwin Jackson was superb. Jackson struck out 11 batters in seven shutout innings, and even struck out the side in the 3rd and the 5th.

The Red Sox managed only four hits and two walks against the crafty righty before he was relieved by Brad Hand.

Chris Young instantly sent the first pitch of the 8th inning into the bleachers to cut the Padres lead in half. But Hand was able to strand the tying run on third base, and Brandon Maurer pitched a scoreless 9th to sew up the win for Jackson and the Friars.

Maurer retired David Ortiz for the final out on a harmless fly ball to centerfield after “Big Papi” had fouled off multiple pitches.

A very pro-Boston crowd went home disappointed Monday afternoon but the Red Sox are in town for two more games Tuesday and Wednesday.

San Diego’s Paul Clemens takes the mound Tuesday at 7:10 p.m. with Clay Bucholz slated to pitch for the visitors.

David Price and Jarred Cosart are scheduled to toe the rubber in the final game of the series later this week.

'Suspicious' Chula Vista Garage Fire Under Investigation

Chula Vista Fire Department (CVFD) officials say a small but damaging garage fire is being investigated as suspicious.

The fire broke out around 2:07 p.m. Monday on the 1700 block of Summer Sky Street, when neighbors called in to report a garage on fire.

Nobody was home at the time of the fire, Chula Vista Police Department Lt. Peak said, but a small family is believed to live at the location.

When fire crews arrived, they quickly put out the garage fire. The fire stopped short of spreading to the house, though flames coming out of the garage door melted an upper story window, CVFD Spokesman Harry Muns said.

Muns said the blaze was "definitely a suspicious fire."

Arson investigators are on scene.

No other information was immediately available.

Teen Arrested in Pointe Fire

A juvenile has been arrested, accused of arson in connection with a brush fire that burned 26 acres and prompted evacuations in Spring Valley.

The fire, dubbed the Pointe Fire, broke out August 17 on Pointe Parkway in Spring Valley.

One firefighter suffered a snake bite and another firefighter suffered an ankle injury while battling the flames.

Cal Fire officials said a 17-year-old was arrested Sunday and will face a charge of willfully and maliciously setting fire to forest land.

The fire broke out in a canyon near a residential area south of State Route 94 and east of State Route 125 near Jamacha Boulevard.

Residents said the fire started small, but quickly exploded in size. Within 30 minutes, families were told to evacuate. Within two hours, they were allowed to go back home.

One resident told NBC 7 that he wasn't surprised with the arrest, saying that teenagers often go into the canyon near Pointe Parkway.

"I presumed it was someone who started it intentionally," Steve Flesser said.

"We're always concerned with people here who want to smoke or do anything with fire because it's dangerous," said neighbor Chris Heiserman.

Heiserman says he's glad someone was arrested because it may stop others.

"Maybe if they know, they'll be more careful down there," he said.

Yosemite Wedding Photo Mystery

This wedding snapshot just might put every other couples' big day photos to shame.

The photographer's snapshot of the mysterious newlyweds who didn't know they were being photographed shared the photos online in an effort to find out who they are. By Tuesday, they were found, but a photographer who shot their wedding said they wish to remain anonymous.

The viral image was taken by photographer Mike Karas, of Hawaii, who was simply enjoying the sunset in Yosemite this week. He said he happened to be in the right place at the right time when the couple, dressed for a wedding, emerged from the shadows.

That's when Karas snapped a once-in-a-lifetime photo of the duo as they embraced on top of a Yosemite cliff with the golden sun setting behind them.

The photo Karas took of the unforgettable photo is one of his favorite works.

"It was surreal," he said. "We had seen the bride and groom walking down, but all of a sudden we saw them out on the ledge as we were shooting other photos and that 'Eureka!' moment just unfolded."

Karas shared the photo on Instagram and Facebook in hopes of hunting down the couple so that he could share the priceless picture with the newlyweds.

As he waited, he was grateful to the mysterious tandem for allowing him to share in an extraordinary moment that was captured with just one frame.

"Thanks for adding to an already amazing sunset photo opportunity and I would love to be able to share this with you," Karas said. "As much of an amazing moment it was for me to capture, it was clearly an even more special moment in your life."

The couple in the photo wants to remain anonymous, Derek Copenhaver, one of the photographers who photographed the wedding, told NBC Bay Area.

Copenhaver added that the ceremony was performed in Yosemite Valley before the bride and groom hiked up to Taft Point to snap some candid shots. And yes, the bride sported her white dress during the ascent, a trek that Copenhaver noted is actually "relatively easy."

The photo was taken at sunset on Sept. 1 at Taft Point along the Pohono Trail in Yosemite National Park.

Carlson Settles Fox Lawsuit Against Ailes for $20 Million

21st Century Fox has agreed to a multi-million dollar settlement with former news anchor Gretchen Carlson, who charged she was sexually harassed by former Fox News CEO Roger Ailes.

"21st Century Fox is pleased to announce that it has settled Gretchen Carlson's lawsuit," the company said in a statement. "During her tenure at Fox News, Gretchen exhibited the highest standards of journalism and professionalism. She developed a loyal audience and was a daily source of information for many Americans. We are proud that she was part of the Fox News team. We sincerely regret and apologize for the fact that Gretchen was not treated with the respect and dignity that she and all of our colleagues deserve."

Citing sources familiar with the details of the settlement, Vanity Fair reported Carlson would receive $20 million along with the public apology. A source familiar with the confidential settlement also confirmed that amount to The Associated Press.

According to a document filed today in the United States District Court District of New Jersey, Carlson voluntarily dismissed her case against Roger Ailes with prejudice on Tuesday.

"I am gratified that 21st Century Fox took decisive action after I filed my complaint," Carlson said in a statement. "I'm ready to move on to the next chapter of my life in which I will redouble my efforts to empower women in the workplace. I want to thank all the brave women who came forward to tell their own stories and the many people across the country who embraced and supported me in their #StandWithGretchen. All women deserve a dignified and respectful workplace in which talent, hard work and loyalty are recognized, revered and rewarded."

Ailes was ousted as chief executive at Fox News Channel in July after running the network he built from scratch for nearly 20 years. Carlson alleged Ailes sabotaged her career after she refused his suggestions for sex and complained about a pervasive atmosphere of sexual harassment at Fox.

Ailes has steadfastly denied the allegations.

Brock Turner Registers as Sex Offen

Ex-Stanford University student Brock Turner registered as a sex offender on Tuesday in his hometown of  Bellbrook, Ohio, four days after he left a San Jose, California, jail after serving three months for felony sexual assault.

Carleen Turner tried to shield her son's face with her white sweater, as the 21-year-old walked into the Greene County Sheriff's Office Tuesday morning to sign the paperwork — with a bank of reporters trailing his move. Turner took his sunglasses off to sit down and fill out the necessary forms on a clipboard. He did not speak publicly, driving off in a white SUV, refusing to answer questions about whether he wanted to apologize or what he would do about work.

He will remain on the sex offender's list for the rest of his life.

Greene County Sheriff Gene Fischer said all of Turner's neighbors will receive a notification letter informing them that a sex offender is moving in nearby.

"We’re required to check in on him, and we exceed our requirements sometimes, so we will check on him and make sure he’s living where he’s supposed to," Fischer said.

Before sentencing, Turner's mother had written the court asking the judge not to send her son to prison or jail, saying that would be a "death sentence."

[[392435751, C]]

"This is his future life," she wrote. "I beg of you, please don't send him to jail/prison. Look at him. He won't survive it. He will be damaged forever and I fear he would be a major target. Stanford boy, college kid, college athlete - all the publicity.... this would be a death sentence for him. Having lost everything he has ever worked for his entire life and knowing the registry is a requirement for the rest of his life certainly is more than harsh.... Your honor, please be kind and merciful to my beautiful son. He is suffering and will continue to pay for this for his entire lifetime."

Since Turner returned to his hometown in Ohio, his neighbors have been anything but welcoming. Some of them brandished rifles, carrying the guns under the state's open carry laws to send the message that Turner's actions will not be forgotten. The armed protesters stress they are not threatening to harm Turner, unless they catch him committing another crime. They say it's their form of justice and a way to keep Turner on edge.

[[392377631, C]]

Turner walked out of the jail in San Jose Friday morning after serving three months of a six-month sentence for sexually assaulting an unconscious woman after a fraternity party at Stanford in January 2015.

Santa Clara County Superior Court Judge Aaron Persky handed out the sentence in June after a probation officer recommended that prison would have a severe impact on the former Stanford swimmer. Persky has since been under fire for being too easy on Turner, who could have received a 14-year prison term for his crimes. Many rallies have been held in Silicon Valley against both the judge and Turner.

Meanwhile, the committee of Bay Area organizers working to recall Persky say they don't agree with the armed protesters in Ohio but believe Persky is responsible for creating a more vigilante environment.

In her letter to the court, Carleen Turner noted that her son "is suffering" and "will continue to pay for this for his entire lifetime."

Port Selects Plan for Harbor Island Redevelopment

$

San Diego port district staff have recommended a proposal by locally based OliverMcMillan Inc. to develop hotels, recreational canals and other elements on 57 waterfront acres at Harbor Island. Port commissioners are scheduled to review the recommendation at their Sept. 8 meeting.

Port staff favored the OliverMcMillan plan over a competing proposal by San Diego’s Sunroad Enterprises. The two firms had been chosen as finalists earlier this year from among six development teams that had submitted plans to redevelop the land, much of which formerly housed rental car lots.

Port commissioners will be reviewing a recommendation calling for port staff to enter into an exclusive negotiating agreement with OliverMcMillan. According to port documents, the developer’s plans include two hotels, each with between 500 and 750 rooms; a 200 to 300-room “Boat-el” with affordable lodging accommodations; canals for kayaks, paddleboards and small watercraft; and a public administration campus that would include a port district administration building and headquarters for the Harbor Police Department.

The proposal also includes a mixed-use concept, which would have hospitality, blue-tech, retail, public market, office, restaurant and marine services. Other elements include a seaplane exhibit honoring the history of the location where planes were once built and launched; public view corridors; a grid of “urban” sidewalks and streets emphasizing pedestrian access; and a network of plazas, open spaces and piers.

OliverMcMillan plans to partner with San Diego-based Evans Hotels on the hotel components. The developer has estimated the total development cost of the mixed-use project at between $760 million and $1.12 billion.

If the developer’s project is chosen by the port, construction would not likely begin for about four years or longer, following necessary environmental and other reviews.

Headquartered in downtown San Diego, OliverMcMillan was founded in 1978 by CEO Dene Oliver and Chairman Jim McMillan. The company owns several San Diego County properties and has numerous mixed-use projects in various development stages nationwide, in cities including Tustin, Nashville, Denver, Atlanta and Honolulu.

A professional mixed martial arts fighter plans to donate his son's organs after he was pronounced brain dead Sunday as a result of his injuries after an alleged drunken driver crashed into the baby and his teenage aunt in Los Angeles County.

The 15-month-old, Liam Kowal, was taken off life support Tuesday.

The baby's father Marcus Kowal told NBC4 that he and his wife plan on donating his organs to another child who may need them.

"The man we would have raised him to be ... he would want to do that anyway," Kowal said, fighting back tears.

The boy's body was kept alive several days after the crash in preparation for organ donation.

"I've lost my son but he wasn't in pain," Kowal said. "That's the one thing out of this. He was never in pain. It happened so quickly."

Liam's 15-year-old aunt was pushing the baby in a stroller inside a Hawthorne crosswalk when they were both struck by an SUV on Saturday

The crash occurred on 133rd Street and Hawthorne Boulevard around 4:20 p.m., police said.

The driver, Donna Marie Higgins, fled the scene of the crash, but witnesses followed her. They used their cars to block Higgins in until police arrived.

Higgins, 72, was arrested for felony hit and run and felony drunken driving. She is now out after posting $100,000 bail.

The LA County district attorney's office will likely update Higgins charges to homicide or murder charges, officials said.

"There's no greater loss than the loss of your child," Liam's uncle said.

Kowal, Liam's father, is a decorated MMA fighter.

Today we received the worst news imaginable. His 15 month old son, Liam, was tragically killed when he was hit by a drunk driver yesterday afternoon. While in his stroller, Liam and his Aunt were in the crosswalk when an SUV barreled through them before fleeing the scene. Liam bravely, and valiantly fought for his life, but ended up succumbing to his injuries. At this time, all we can do is support Marcus, his wife Mishel and Liam's Aunt who was also injured in the accident. Industry Insiders Estimate EpiPen Costs No More Than $30

Mylan says middlemen and suppliers have forced them to jack up the prices on EpiPens by hundreds of dollars, but two industry insiders say the company pays no more than $30 per device, NBC News reports.

Some patients are forced to pay a little over $600 out of pocket for a two-pack of the lifesaving medication. Mylan sparked outrage last month when it was revealed the company had hiked up costs for the drug by over 400 percent since it acquired the brand.

Kevin Deane, a partner with the PA Consulting Group, a global technology and design firm that sold a drug delivery technology company to Pfizer in 2004, told NBC News that the base components for each EpiPen, including the plastic cap, tube and needle, might cost between $2 to $4 to purchase. Pharmacists contacted by NBC estimate that the epinephrine inside costs less than $1.

Mylan gets $274 from each sale, but must use that money to pay for costs, according to the company and Mylan CEO Heather Bresch, in a recent CNBC interview. Mylan didn't respond to an NBC News request to itemize its costs, but a Mylan spokesperson told NBC that "all of those costs would clearly make the $274 number significantly lower."

A gas leak stemming from a broken line prompted evacuations of about 20 homes in the Sunset Cliffs area Tuesday morning, officials said.

The leak was reported just after 8 a.m. in the 4400 block of Adair Street, across the way from Santa Barbara Street and Point Loma Avenue.

Lee Swanson of the San Diego Fire-Rescue Department (SDFD) told NBC 7 residents had been evacuated as a precaution after construction crews working in an alley accidentally broke a two-inch gas line, causing gas to leak.

San Diego Gas & Electric was called out to help repair the broken line. SDG&E officials said crews were repairing the line and the leak had been capped by 9:25 a.m.

By 9:45 a.m., officials were clearing the scene and were allowing residents back into their homes.

About an hour later 14 customers in the area remained without gas. SDG&E crews were working to get them back online. At this point, it is unknown when the repair work will be completed.

No injuries were reported, and no further details were immediately released.

Phoenix-Area Pursuit Ends in Gunfire on Live TV

A police pursuit ended Tuesday afternoon in Tempe, Ariz., when authorities pinned a suspected bank robber's SUV against a barrier and officers opened fire on the driver, authorities told NBC News.

Police said the driver was pronounced dead at the scene. Two "people of interest" in the bank robbery were in custody and no suspects were at large, police said.

Avondale police told NBC News that the chase began with the robbery of Credit Union West in the Phoenix suburb of Avondale. Video of the chase showed two unmarked vehicles forcing the SUV to spin to the right as it made a right turn and a third vehicle then pinning it against a fence — a tactic known as a "precision immobilization technique," or PIT.

An officer from the first vehicle approached and opened fire into the front seat of the SUV as local television stations broadcast the encounter live.
