'I Am Not a Victim:' TV Sportscaster to Shooter

San Diego television sportscaster Kyle Kraska, who suffered multiple gunshot wounds outside his Scripps Ranch home in February 2015, spoke directly to the man convicted of attempted murder in the shooting.

“I am not a victim. I will never be a victim,” Kraska said in a downtown courtroom Wednesday moments before a judge sentenced the man who attacked him.

Mike Montana, a painter, was convicted of attempted murder after shooting Kraska in the chest, leg, hip and bicep.

“Your bullets may have hit their mark but they did not kill my spirit. It did not destroy my passion and it will not extinguish my love for life,” Kraska said.

Kraska was emotional several times in his seven-minute victim's impact statement. He survived the shooting by crawling on the ground for 50 to 60 feet and asking a neighbor to call for help.

Montana was initially hired to paint Kraska's home.

However, there was a dispute over the quality of the work between Kraska and Montana. Kraska said he fronted Montana $800 for supplies before the painter quit without completing the work. Montana said Kraska failed to pay him $2,200. 

Montana's defense attorney asked the judge to take into consideration his client's use of prescription drugs.

Judge Michael T. Smyth said he took that into consideration as well as a letter from Montana's sister that described a friendly, non-violent man whose actions were brought about by external forces.

“There is no doubt in my view that he was then and now remains a danger to society because of that inability to control himself,” said Smyth.

Montana received 38 years, 8 months to life in prison with possibility of parole.

Man and Woman Are Persons of Interest in PB Hit-and-Run

A man and woman are now considered persons of interest in a hit-and-run crash in Pacific Beach that left three men seriously injured – victims that may have had a run-in with the pair moments before the crash.

On Wednesday, the San Diego Police Department (SDPD) released a photograph of two persons of interest sought in the Aug. 5 hit-and-run. At around 1:09 a.m. that morning, police said a silver four-door sedan traveling eastbound in the 900 block of Garnet Avenue struck three men who were crossing the busy street.

The driver fled the scene.

One of the victims injured in the hit-and-run was J’Ron Erby, 23, a recent college graduate and intern for the San Diego Chargers. Erby was out that night celebrating a friend’s birthday. The hit-and-run landed him in the hospital with skull fractures and brain trauma, his father told NBC 7.

“We're just asking for, you know, whoever did this to just take a look in the mirror. If it were my son, he would do the right thing. Ee taught him and raised him right,” Erby’s father Lee said.

Police said all three pedestrians were hospitalized with various injuries ranging from lacerations and fractures to brain injuries.

According to investigators, the vehicle involved in the hit-and-run was likely a newer model Hyundai Elantra with stock brushed aluminum wheels. The vehicle may have sustained damage to its front-end in the collision, including its grill, hood and windshield. Earlier this month, investigators released a short surveillance video of the suspect’s vehicle fleeing the scene of the crash.

Investigators said Wednesday that after conducting follow-up interviews, police learned that the three victims were involved in some sort of dispute with a man and woman a few minutes before they were hit by the car.

At this point, the police department said the man and woman are considered persons of interest.

Police said the man is described as being in his 20s, with long hair pulled into a bun. The woman is also in her 20s, with long hair, and wore a light-colored sleeveless top and dark pants in the photo released by the SDPD.

The investigation is ongoing. Anyone with information can call the SDPD’s Traffic Division at (858) 495-7813 or Crime Stoppers at (888) 580-8477. Tipsters can remain anonymous.

Crime stoppers is offering a $1000 reward for anyone with information.

Search for 'At-Risk' Missing 69-Year Old Man

Officers are searching for a at-risk 69-year old man who went missing from his nursing facility in Kearny Mesa this weekend.

Bryce Guyle was last seen on Sunday morning at his nursing facility in the Clairemont Mesa East area of San Diego.

Police say he may be attempting to return home.

Guyle suffers from a medical condition and gets confused easily.

He is 5-feet 8-inches, weighs about 100 pounds, has gray hair in a thin ponytail and hazel eyes. He was last seen wearing a gray t-shirt.

Trump Openly Weighs a Massive Immigration Reversal

During a town hall that aired Wednesday, Donald Trump floated the possibility of allowing undocumented immigrants to remain in the country, NBC News reported. 

"No citizenship," Trump told Fox News' Sean Hannity in an interview taped Tuesday afternoon in Austin, Texas. "Let me go a step further — they'll pay back-taxes, they have to pay taxes, there's no amnesty, as such, there's no amnesty, but we work with them." 

Trump said he was moved by people concerned with his calls for a “deportation force” to remove all 11 million undocumented people from the United States. 

"When I look at the rooms and I have this all over, now everybody agrees we get the bad ones out," Trump said. "But when I go through and I meet thousands and thousands of people on this subject...they've said, Mr. Trump, I love you, but to take a person that has been here for 15 or 20 years and throw them and the family out, it's so tough, Mr. Trump."

6-Year-Old Rancho Santa Fe Boy Summits Mt. Whitney

A Rancho Santa Fe boy became one of the youngest people to ever complete the “portal to peak” hike on Mount Whitney earlier this month.

Anthony Slosar, 6, set out with his family in the early hours of the morning on August 5, embarking on a 12-hour journey to the summit of the tallest mountain in the Lower 48; he didn't return to the trailhead for another 20 hours.

Mt. Whitney’s marquis “portal to peak” trail begins at Whitney Portal and ascends more than 6,000 feet of elevation over 11 miles to the mountain’s peak at 14,505 feet. 

Climbing Whitney was Anthony's idea. His inner competitor wanted to hike the trail at a younger age than his big brother Jackson, who accomplished the feat at age seven.

Formal records for summiting hikers are not kept, but published reports suggest that he may in fact be the youngest to ever reach the top.

Anthony’s father, Jeff, told NBC 7 that he was prepared to cut feet holes in his backpack so that he could carry his son, but Anthony insisted from the beginning that carrying was not allowed—holding hands with dad was, though.

He got over his initial fears of elves, crocodiles and other creatures he thought he might encounter, and pushed himself toward the top despite seeing his older brother and sister turn back after succumbing to altitude sickness.

“If you can teach your kids a lesson beyond the golden rule, not quitting, I think, is important,” Jeff Slosar said. “This was a very tangible example of that."

Once Anthony gets a chance to watch “Captain America: Civil War”, a movie his mother initially forbade him from watching before granting permission as a reward for finishing the climb, he’ll set his eyes on future expeditions in the Grand Canyon and the Grand Teton Range in northeastern Wyoming.

Local School Skips Homework Assignments for Students

When it comes to homework, how much is enough?

One local school is rethinking homework---by not assigning any.

At Design39Campus in the Poway Unified School District, there is a “homework is different policy,” according to the principal Joe Erpelding, who also calls it a home connect policy.

The school adheres to HELO, home extended learning opportunities.

“We want you to go outside and play, we want you to read, we want you to expand your vocabulary, go to the grocery store with your mom and help her keep a budget and learn your math facts,” Hilary Duggan told her fourth and fifth grade students.

The students are encouraged to read at home, and to choose a “passion project,” something they like doing.

“When you have ownership over your learning, you have complete engagement in what you're learning, and that what we want to facilitate,” Erpelding said.

“I like to write things, it doesn't matter what it is," a student told NBC 7.

“I like to learn about new things, especially about animals,” another student said.

One student said there was enough time in school to learn the material, making homework unnecessary.

In Texas, a teacher's sent note to parents telling them she was eliminating homework for her second grade class went viral.

Man Wanted for 2 Sex Assaults Has Lengthy Record: Docs

A San Diego man wanted in connection with two violent sexual assaults has a lengthy criminal record, documents obtained by NBC 7 San Diego show. 

Jeremiah Williams, 24, is wanted for two recent attacks: the University City sex assault and another assault that happened the day after at a Motel 6, SDPD Capt. Brian Ahearn said. 

Court records show Williams has spent time in jail in San Diego and San Antonio for convictions for assault causing bodily injury and trying to dissuade a witness from testifying. He admitted to abusing his live-in girlfriend and was then charged with trying to keep her from testifying against him.

A District Attorney investigator wrote that he reportedly told his then-girlfriend that when she looks in the mirror, she would always remember him. 

He also has minor citations in Houston. 

Police had Williams in in handcuffs after the second attack but weren't aware of the allegations until days later when the victim came forward, in a strange twist. 

Williams is described as being 5-foot, 11-inches and 180 pounds. He has the numbers "210" tattooed on his right wrist and an outline of the State of Texas tattooed on his left forearm. He also has wings tattooed on both upper arms. 

Physical evidence from the scene of the first University City sex assault linked Williams as the suspect, Ahearn said. 

The University City sex assault happened on Saturday, Aug. 13 when a woman was attacked at the Venetian Condominiums on Nobel Drive.

The woman had been dropped off outside the complex around 10:30 p.m. and was walking to her apartment when she thought someone was following her.

Before the victim could unlock her door, the man knocked her to the ground and asked her for money at gunpoint. After giving him the money, the woman was dragged into her apartment where police say she was beaten and sexually assaulted.

Three days after that incident, San Diego Police were called to Sharp Memorial Hospital for a report of a separate attack. A 23-year-old woman told police she had been violently sexually assaulted on Sunday, Aug. 14 at  a Motel 6 on Alvarado Canyon Road in Mission Valley.

"The suspect, who she had recently met, entered her room choked and sexually assaulted her and then hit her in the head with a hand gun," Ahearn said.

After the interview, sex crimes detectives went to the motel and collected evidence.

During their investigation, detectives found that officers initially responded to the incident at the motel as a report of a man hitting a woman. 

Witnesses told police Sunday night they heard the victim yell for help, and the suspect fled on foot.

The Motel 6 manager told NBC 7 that the victim smashed a window in the room and drove off in a car before police arrived at the scene. 

Authorities located the suspect in a nearby canyon with a hand gun, Ahearn said. Initial statements given to California Highway Patrol (CHP) officers placed Williams at the scene, and he was cited with a misdemeanor gun charge and released.

It was only on Tuesday that police linked Williams as the suspect in the motel sex assault. 

The suspect remains at large; he is considered armed and dangerous. He has a criminal background in California and Texas. 

Anyone who sees Williams is asked to call 911. Police believe he is still in the San Diego area.

Cops Stumble Upon Gator in Tub

Police responding to a call about a burglary at a Staten Island home encountered an unusual suspect — a three-foot-long alligator, and it was in the bathtub. 

The reptile was hanging out in the empty tub when police responding to the anonymous call arrived at the abandoned Mariners Harbor home.

Animal care workers took the gator for evaluation. They're also looking into how the gator got into the tub.

The NYPD tweeted responding officers were "surprised" by the reptile, but no one was injured. The department tweeted photos of cops smiling next to the crate.

No arrests have been made.

Cubs Complete Sweep of Padres

The Padres must be pretty happy to see the Cubs leave town.

Chicago finished off a sweep of the Friars Wednesday afternoon with a 6-3 victory at Petco Park behind another strong pitching performance by Kyle Hendricks.

Hendricks kept the Friars to just two runs during the first six frames and left with eight punchouts and a 5-2 lead.

MVP candidate Kris Bryant and fellow Cubs All-Star Addison Russell did not hit homers this time (like they did in the first two meetings) but the visitors were able to take the lead just three batters into the first inning and never trailed the rest of the way.

Ben Zobrist smacked a two-run triple to the gap in right and the Cubs already were in front before Paul Clemens and the Padres even recorded an out.

In fact, in all three contests, San Diego never held the lead against the visitors.

Chicago outscored the Friars 16-7 during the series and stretched the gap in the NL Central division to 14 games over the Cardinals.

Hendricks improved to 12-7 with the victory while Andy Green’s squad fell to just 3-7 in its last 10 ball games.

One bright spot in Wednesday’s loss was Travis Jankowski. The Padres centerfielder extended his on-base streak to 23 consecutive games and contributed two hits.

Jankowski singled in his first at-bat and later led off the 3rd with a double and scored on a triple by All-Star Wil Myers.

Infielder Ryan Schimpf also contributed a double and a triple.

Clemens allowed five runs (four earned) and struck out six in 5.1 innings of work. He fell to 2-3 and has an ERA of 5.06.

San Diego is off Thursday and begins a 9-game road trip Friday in Miami.

Jarred Cosart will start for the Padres while the Marlins give the ball to David Phelps.

Officers Search for Stabbing Suspect in Carlsbad

One person was transported to Scripps La Jolla Hospital after being stabbed in Carlsbad Wednesday evening.

According to Carlsbad Police, the incident occured at approximately 8:50 p.m. on the 500 block of Carlsbad Village Drive. 

Police say the victim's injuries are considered to be serious.

The suspect remains outstanding.

No other information was immediately available.

Man's Car Stolen With Father's Ashes Inside

A local man, who had his car stolen last week, is asking for the person responsible to return his father’s ashes to him. The ashes had been inside the car, along with a cellphone that held a final message from his father.

Zachary Johnson, 22, moved into his new apartment on the 800 block of Date Street in Downtown San Diego Friday night.

He told NBC 7 that he had parked his 2011 White Chevy Malibu in front of his apartment but the next morning, he couldn’t locate it. He said at first he thought his car may have been towed and began making phone calls.

After a while, he realized it had been stolen.

Johnson said he doesn’t care about getting his car back—he just wants his father’s ashes returned to him.

"It’s like I lost him again. It’s not as devastating but pretty close,” he said. “I thought I'd always have him, his ashes with me—now it looks like I'm not going to.”

Johnson told NBC 7 that he had listened to the message his father left on the cellphone from time to time for strength.

“It was just telling me that he loved me and stuff,” he said. “I missed his call so he left me a voicemail. It was a week before he passed away.”

Also in the car were mementos of Johnson’s life, including his high school diploma.

“Everything in there is replaceable except the stuff they gave me and my dad's ashes. They can keep it all. I would do anything to get that stuff back. It’s very heartbreaking,” he said.

Johnson said his father’s ashes are in a wooden box shaped like a cross with jewels on it. He's hoping the person who took will return it to him, along with the cellphone.

Chargers Defensive Tackle to Serve Four Game Suspensions

Wednesday was a busy day at Chargers Park.

Hours after the San Diego Chargers released a statement on their status with first round draft pick Joey Bosa; the team announced defensive tackle Damion Square will be suspended without pay for violating the National Football League’s substance abuse program.

It's unclear what substance was abused.

According to the Chargers, Square will miss the first four games of the 2016 regular season. He will be eligible to return to the active roster on Monday, Oct. 3, after the Bolts’ game against the New Orleans Saints.

The Chargers released an official statement on Square’s suspension saying,

“While disappointed to hear the news today about Damion, we support and respect the league's decision. We are confident that he will learn from this and what is expected of him moving forward.”

Square also commented on his suspension saying, “I sincerely apologize to my teammates, coaches, the entire Chargers organization as well as the fans. I made a mistake and take full responsibility. I look forward to returning in Week 5 and doing whatever I can do to help the team."

Square is entering his third season with the Chargers and fourth in the NFL. The defensive tackle is eligible to take part in preseason practices and games. The Chargers next preseason game is against the Minnesota Vikings on Sunday in Minneapolis.

Chargers: Bosa Rejects Our 'Best Offer'

Defensive lineman Joey Bosa, the third overall pick in the NFL Draft, has rejected the most recent offer from the San Diego Chargers, one the team described as their "best offer."

"We gave Joey’s representatives our best offer last night, which was rejected today," the team announced in a written release Wednesday.

In an unusual move, the team released what was in the offer:

  • An initial signing bonus payment larger than any player in the League has received in the last two drafts.
  • More money in this calendar year than every player in this year’s draft except one (QB Carson Wentz).
  • The largest payment and the highest percentage of signing bonus received in the first calendar year of any Chargers’ first-round selection since the inception of the current Collective Bargaining Agreement (2011).

When Chargers camp opened in July, Bosa was no where to be seen and Chargers head coach Mike McCoy was not happy about it.

As NBC 7 Sportswrap reported, Bosa wants more of the bonus money paid earlier in the contract and to have what’s known as offset language where he can get paid by two teams if he’s released before the contract expires.

The team said all summer that it would negotiate the first point but would not negotiate the second point.

As of Wednesday, the team said they would restructure an offer now that they feel the rookie can not contribute for the whole season without time spent in camp and in preseason games.

Less than an hour after the team released its statement, fans reacted on Facebook and Twitter with strong opinions, both in favor of Bosa and against him.

Police Searching for Missing 80-Year Old Man in Carlsbad

Authorities are asking for the public's help to find a missing 80-year old man in Carlsbad.

Edward Matson was last seen getting off a bus at approximately 9:15 a.m. Wednesday on El Camino Real and Marron Road, Carlsbad Police say.

Matson suffers from dementia and has diminished cognitive skills. 

He is approximately 5-feet 8-inches tall, weighs 130 pounds, has thinning gray hair and hazel eyes. He was last seen wearing a boonie hat, white shirt with a flower print, tan shorts and was carrying a briefcase.

Police say they beleive he may be heading to northern California, possibly to the Bay Area.

Man Accused in Fatal Suspected DUI Crash Held on $2M Bail

A man accused of driving drunk and killing a young man in a fiery head-on crash Saturday night was held on $2 million bail. 

Roy Dunkin, 51, was charged with gross vehicular manslaughter and DUI causing great bodily injury. He pleaded not guilty through an attorney. 

If convicted, he could face 15 years and four months in prison. 

Dunkin is accused of hitting and killing Lucas Riley, 24, of San Diego, in a fiery three-car crash on State Route 67 over the weekend. 

The crash happened at approximately 7 p.m. Saturday and prompted a Sig Alert for the northbound and southbound lanes of State Route 67 near Cloudy Moon Drive, where the crash happened, San Diego County Sheriff deputies said.

The impact set the Mini Cooper on fire; by the time crews arrived on scene, flames had fully engulfed the car and trapped the victim, later identified as Riley, inside, deputies said. He died at the scene.

After the crash, authorities could be seen pulling out beer cans from the Chevrolet. Dunkin suffered a broken wrist. 

Shawna Wickwire, Riley's fiancee, told NBC 7 San Diego that Riley was a selfless man willing to help anyone.

“He was the most caring and loving person I ever have known in my entire life. I have never felt more love for him,” Wickwire said. The couple was planning on getting married this October. 

Riley's family has set up a GoFundMe as a memorial fund. The money raised will cover funeral expenses. To donate, click here.

The crash that killed Riley was one of four deadly crashes over the weekend. In three of those crashes, alcohol is suspected to play a role.

Dunkin will next appear in court on Sept. 7 for a preliminary hearing.

Court Docs: Officer in Fatal Shooting Returned to Work With No Discipline, Internal Affairs Interview

A veteran San Diego Police Officer who fired the fatal shot in a confrontation with an unarmed, mentally-ill man was not interviewed by internal affairs or the prosecutors investigating the officer-involved shooting according to a report by the VoiceofSanDiego.org.

The San Diego County District Attorney's Office released surveillance video of the April 30, 2015 shooting involving SDPD Officer Neal Browder.

Browder was responding to a 911 call reporting that a man was threatening people with a knife at the Highlight Bookstore on Hancock Street.

He encountered Fridoon Rawshan Nehad, 42, who was holding a metallic pen. Browder got out of his patrol car with his weapon drawn, yelled at Nehad to "drop it” or "drop the knife.”

When Nehad got within 10 or 15 feet of the officer, Browder fired his gun and shot him in the chest.

Nehad later died at UC San Diego Medical Center.

In December, DA Bonnie Dumanis told local reporters Browder had no doubt Nehad was going to stab him. In fact, the officer's interview was part of the report released by the DA's office after the shooting was determined to be justified.

According to the sworn deposition recorded in July 2016, Browder told attorneys he was interviewed by homicide investigators but never interviewed by the DA's office or SDPD's internal affairs department.

Browder was released from administrative duty and returned to patrol within a few weeks of the incident. He estimated the timing was June 2015, according to the report. 

In the sworn deposition, he answers several questions about whether he received feedback from anyone within the San Diego Police Department regarding the investigation or the incident. Browder said he did not receive any information regarding his actions on April 30th - positive or negative - from the SDPD before returning to the field.

Nehad's family has filed a multi-million dollar claim against the city of San Diego. They claim the SDPD has a pattern of poorly investigating cases and covering up officer misconduct.

The FBI and the U.S. Department of Justice launched an investigation and cleared Browder of violating any federal criminal civial rights statutes in the shooting. The DOJ said it was closing its investigation after careful consideration of the evidence. 

In February 2016, Browder accidentally fired his weapon during a foot chase and the stray bullet hit a baby’s crib in Oak Park.

No one was injured in the accidental discharge, which prompted a SDPD administrative investigation.

On Runway, Plane Makes Turn and Rolls Over

A small plane coming in for a landing at the Fallbrook Air Park ran out of runway and made a left, causing the plane to roll over, officials said. 

The Cessna 182, a part of the Civil Air Patrol, landed shortly after 1 p.m. Wednesday at the air park, located at 2155 S Mission Road. The Civil Air Patrol is the longtime all-volunteer U.S. Air Force auxiliary. 

The plane was on an authorized proficiency flight with two pilots on board when it landed on the runway, but ran out of space. 

The pilot made a left at the end of the runway and the plane rolled over, fire officials said. 

The two occupants inside, a 77-year-old man and a 79-year-old man, suffered minor injuries. 

The aircraft suffered "substantial damage", Federal Aviation Administration (FAA) spokesman Ian Gregor said. 

No one was trapped inside, fire officials said. 

FAA and the National Transpiration Safety Board (NTSB) officials will investigate the crash.

No other information was immediately available.

Controversial Guardrails Will No Longer Be Used in CA

Trinity Industries’ ET-Plus guardrail and end terminals, once a primary choice by the California Department of Transportation for use on many of the state's 396,000 miles of roadways, will no longer be purchased by the agency, according to a spokesman.

Matt Rocco, Media Relations Manager for Caltrans told NBC 7 Investigates, his agency will replace the ET-Plus guardrails currently on roadways throughout the state “as needed.”

“If there is a section of roadway under construction or an incident, they will be replaced with another type of guardrail,” he said.

Trinity manufactures guardrails lining highways across the country. Last year it was ordered to pay millions in damages and penalties for defrauding the federal government by making false statements about the changes it made to the ET-Plus.

The changes, according to lawsuits and complaints against the highway manufacturing heavyweight, based in Texas, cause the guardrail to perform improperly. Trinity is appealing the verdict and has always maintained their guardrails meet federal standards.

Rocco told NBC 7 Investigates, Caltrans is “moving towards more rigorous testing of its safety devices” through its membership in American Association of State Highway and Transportation Officials (AASHTO). This quasi-government agency provides research and guidelines for testing of highway safety equipment.

In a recent settlement between the guardrail manufacturer and the Federal Highway Administration the FHWA agreed not to pursue legal action against Trinity.

According to the settlement, the agreement was made “in the best interest of the Government,” with Trinity promising to behave in a responsible manner. The agreement requires Trinity to hire a compliance officer and an independent monitor. In addition, the company has to create a guardrail tracking program in at least one state that would include information on who made the guardrail, who installed it and what maintenance was performed.

Minn. Bridge Collapse Survivor Charged With Joining ISIS

Mohamed Amiin Ali Roble, 20, who in 2007 survived a bridge collapse in Minneapolis that killed more than a dozen people, has been charged with conspiring to support ISIS, federal prosecutors said Wednesday, NBC News reported.

Roble is accused of traveling to Syria and joining the terror group after he turned 18. The FBI says he used a $91,000 settlement he received from the bridge collapse to fund the group. Authorities believe he lives in Syria. 

Roble was just weeks shy of his 11th birthday in 2007 when the school bus he was riding in was caught on a Mississippi River bridge in Minneapolis that collapsed.

Thirteen people were killed and 145 people were injured, including Roble.

La Jolla Shores Among Top 25 Attractions in U.S.

With miles of white sand and turquoise waters, San Diego’s breathtaking La Jolla Shores has been named among the top 25 attractions to visit in the U.S., according to one well-known website.

The travel planning and booking website, TripAdvisor, has compiled a list of America’s most popular attractions based on the greatest increase in traveler interest over this past summer.

According to the company’s “Attractions Trends Index,” La Jolla Shores is ranked No. 11 based on year-over-year search activity on TripAdvisor, which has increased by 88.8 percent between 2015 and 2016 for the period of May through July.

TripAdvisor says the scenic spot is beloved by travelers not only for its views, but for its beach area where one can try out a variety of water sports, including surf lessons, for a quintessential San Diego experience. 

Other top-notch attractions across the U.S. that made the list include, in order:

1) One World Observatory: World Trade Center (New York City, New York)
2) The Magnificent Mile (Chicago, Illinois)
3) Gatlinburg Scenic Overlook (Gatlinburg, Tennessee)
4) The Pearl District (Portland, Oregon)
5) Mount Bonnell (Austin, Texas)
6) Newbury Street (Boston, Massachusetts)
7) Smoky Mountain Alpine Coaster (Pigeon Forge, Tennessee)
