Met Opera Understudy Wore Jeans

An understudy made his Metropolitan Opera debut over the weekend – all while wearing jeans and sneakers.

Tenor Francesco Anile surprised theatergoers at New York City's Lincoln Center during a staging of Othello after the performer in the title role was unable to continue singing in the final acts. The change was so sudden that Anile was unable to change clothes, taking the stage in garb more befitting a modern New Yorker than a 16th century Venetian general.

"People were a bit surprised, but it was a big surprise for me," he said.

Anile said he was texting with friends in the green room when Aleksanders Antonenko’s voice went out during the fourth act – just before the climactic finish of the Shakespearean adaptation.

A stage director ran into the green room, gave Anile a black cape and told him, "Francesco, come. We need you to sing."

Anile said he didn't have time to get into costume, so he went out onto the stage wearing his street clothes and cape. He belted out the final minutes on the side of the stage as Antonenko walked the part and lip-synched.

The audience was so moved by Anile’s odd debut that they gave him a standing ovation.

"(It was) strange, but I am very happy," Anile said, noting that news of the debut made it back to his home town in Italy.

Hibla Gerzmava, the Russian soprano playing Othello’s wife Desdemona, said the sudden change took her for as much of a loop as it did Anile and the audience. But she applauded him for being able to step in.

"For Francesco, I say ‘Bravissimo’ because it’s difficult for him,” she said.

Clinton: Sandy Hook a Focal Point

In her only interview with Connecticut media on Monday, Democratic presidential front-runner Hillary Clinton told NBC Connecticut about her recent rhetoric about guns and how the Sandy Hook tragedy has been a focal point of her campaign.

Clinton, who held a campaign rally at the University of Bridgeport over the weekend, said she hasn’t politicized the tragedy, even with a campaign ad featuring the daughter of Sandy Hook Elementary School Principal Dawn Hochsprung who was killed that day.

"I think we have a real problem with guns in America. Thirty-three thousand people per year are killed by guns and politics, our government, our democracy, is supposed to be about solving problems," Clinton said backstage. "We need universal background checks. We need to end the universal immunity that has been given to the gunmakers themselves. We have to do more on mental health. We have to do more on education about the dangers of guns, so I think it's an appropriate and necessary topic to be discussing in this campaign."

That final comment was a nod to the lawsuit that families of Sandy Hook victims filed against the manufacturer and seller of the weapons used in the December 2012 massacre. A judge recently ruled the suit could move forward.

Clinton spoke several days ago during a campaign stop in Lancaster, Pennsylvania, about how, as a child, she would spend time at a family cabin on Lake Winola. She said that’s where she learned to use a gun.

NBC Connecticut political reporter Max Reiss asked Clinton if she’s used a weapon recently.

"Well, not recently; I did go hunting when I lived in Arkansas. I haven't really had much chance to do it," she said. "I've done skeet shooting, but I wanted to make the point that I am not against responsible people having guns."

Clinton went on to say she believes in the Second Amendment and policies that can be good for both lawful gun owners and public safety.

"There is no contradiction between having safe gun policies that save lives and respecting Second Amendment rights," Clinton said.

On the issue of possible Supreme Court nominees, Clinton said some decisions by the high court have been "gifts to the gun lobby" and she would want a justice who could work to change those constitutional interpretations.

Additionally, Clinton said overturning Citizens United, the case that established that corporations could give unlimited sums to political campaign, would be a priority.

"I would certainly look for people who understood that Citizens United was one of the worst decisions the court has ever made," she said.

Connecticut’s economy has struggled since the 2008 recession and wage growth has remained essentially flat. Mentioning some of Connecticut’s largest cities, Clinton said her economic policies could provide some growth.

"I want to zero in [on] those places like Bridgeport and Waterbury that need those extra boosts and I will have those economics and jobs policy to do that. I will have an infrastructure policy and advanced manufacturing policy, a clean renewable energy policy, a small business policy and I want to do everything I can, working with the people in communities like Bridgeport and Waterbury to get back in the economic hunt to be able to provide more jobs that are going to provide good livings," she said.

The former secretary of state knows she will have to win over supporters of challenger Bernie Sanders, as well as independents, in the event she becomes the Democratic nominee. Clinton hopes her connections to the state as a student at Yale will play into voters’ decisions.

"I went to law school with Sen. [Richard] Blumenthal, so I've obviously known him for a very long time. Many other people in politics, in business and academia, and all kinds of civic groups so I do want people to know that I've spent a lot of time in Connecticut, driving around, seeing this beautiful state, and I want to be a partner to move the country forward," she said.

Clinton said her supporters in 2008 were polled as saying nearly half would not support then-Sen. Barack Obama in a general election but eventaully did.

Clinton hopes voters not only turn out for her Tuesday, but also that those who don’t vote for her examine how their values may line up with hers.

"I think the vast majority of my opponent's supporters are going to look at who the two nominees are and I'm very confident that we will have their support and we will work hard for it because I want people who don't support me now, not just people supporting my opponent in a Democratic primary but Republicans and Independents to really take a look at my record," Clinton said.

Cali Bear Sedated After Chase

A bear led authorities on a wild chase through the Southern California community of Sylmar before wildlife officials sedated the gentle giant Monday night.

The black bear was first spotted near the Los Angeles Mission College campus, prompting officials to warn students and teachers to shelter in place.

The Los Angeles County Fire Department was assisting after the bear was spotted in the 13300 block of Eldridge Avenue at 9 p.m.

The bear scaled fences, running from police cruisers trying to scare it from the area for more than an hour.

No people were hurt by the bear, LAFD officials said.

The male bear is likely 2 to 3 years old and weighs 125 pounds, California Fish and Wildlife officials estimated.

The bear snoozed in a truck bed after a wildlife official shot it with a tranquilizer dart.

The animal was to be returned to the Angeles National Forest, officials said.

Hanging Up on Robocalls

Carol Hill quit answering her home phone because the calls are rarely from anyone she knows.

"I would say 90 percent of them are those," said Hill.

"Those" are telemarketing calls, robocalls ranging from carpet cleaners to solar energy. Even with the Do Not Call list, the Federal Trade Commission gets millions of robocall-related complaints.

Chris Sharp says he gets two to three telemarketing calls every day.

He doesn't screen his calls instead, "as soon as there is a little delay and you know it's not a person on the other end right away, I just hang up."

But there are services that help. PrivacyStar and Truecaller help screen calls. Time Warner Cable is now offering to block customer calls by using Nomorobo.

"If the number is on the block list," said Bret Picciolo with Time Warner. "It will ring once and then the call is dropped."

Rep. Jackie Speier (D-Calif) wants the Federal Trade Commission to require all telecom customers to have access to call blocking services.

Bret Picciolo with Time Warner says if Nomorobo works with his customers, he won't hear much about it.

"If all is quiet on the front, then that means it's working," he said.

New Superintendent Named for Grossmont Union High School District

The Grossmont Union High School District has a new superintendent.

Doctor Tim Glover was tentatively selected Monday as the next superintendent.

He's expected to join the district full time this July. The terms of his contract were still being negotiated according to a district news release.

He has lived in the East County for 25 years and has nearly 30 years of experience in education.

He most recently served as the Assistant Superintendent of the Student Services and Programs Division at the San Diego County Office of Education.

Superintendent Ralf Swenson has decided to retire July 1 after six years in the role.

Coast Guard Cheating Scandal

Three cadets could be removed from the U.S. Coast Guard Academy in New London, Connecticut, and others will be punished in connection with a cheating scandal, authorities said.

The Coast Guard Academy is recommending that three cadets be removed and said others will face punishment after the investigation into "unauthorized collaboration on online quizzes."

The alleged "violations of the collaboration policy" occurred were in the Ships and Maritime Systems class during the fall of 2015.

"We are greatly disappointed in the behavior of the cadets implicated in this investigation and the poor decisions they made. Our cadets are taught from the day they arrive that violations of the honor concept will not be tolerated and that their choices have consequences," the academy said in a statement.

The cadets who were involved "face various punishments including restriction, marching tours, work hours, and a lengthy honor remediation program," according to the academy, which added that "three cadets have been recommended for disenrollment."

First Units Sell in Pacific Gate Condo Complex

The developer of a new downtown construction project announced more than $90 million in sales Monday.

Bosa Development’s Pacific Gate project, at the corner of Broadway and the Pacific Highway, held its first weekend of private sales. A public sales campaign for the new condo complex will begin in May 2016.

The least expensive unit in the 41-floor building was expected to list for $1.1 million. There will be 215 two and three-bedroom residences total.

Residents at the apartment complex will have access to shared boats and cars as well as a full-time concierge.

The area will soon include a Ritz Carlton hotel and a massive Pacific Gateway project along the waterfront.

The project is slated to be finished in winter 2017.

Lyft Driver Reports Robbery, Pistol Whipping: SDPD

A Lyft driver called 911 Monday to report he'd been robbed and pistol whipped in Mission Valley and now San Diego Police are looking for the two men responsible.

Officers were called to Camino del Rio South south of Interstate 8 and east of State Route 163 at 10:10 p.m. Monday. 

Police say two men walked up to the driver while he was sitting in his car checking his phone.

The driver suffered cuts to his face in the attack.

Police have not released what was stolen.

SDPD and California Highway Patrol is investigating. 

No other information was immediately available.


Newborn Attacked by Dog Died of Bite Injuries to Head: ME

A three-day-old infant attacked by the family dog died from bite injuries to his head, according to an autopsy report by the San Diego County Medical Examiner's office.

The newborn, Sebastian Caban, was attacked by the dog while it was in bed with his parents who were watching television in bed on Thursday, police said. According to the report, the dog who was also in bed with the family and was startled when the mother coughed.

"The dog made contact with the baby leading to traumatic injuries," Sgt. Tuu Nguyen, of the Child Abuse Unit San Diego Police Department (SDPD), said.

The ME's office ruled the death an accident. 

Shortly after the accident, the couple made two unsuccessful 911 calls, SDPD officials confirmed. 

The family waited 28 seconds before hanging up during their first 911 call, then waited an additional 34 seconds on their second emergency call before finally hanging up and driving the baby to the hospital themselves.

Hospital staff tried to save the baby's life, but the attempts were unsuccessful.

"Our heartfelt condolences go out to the family in this very tragic case. We know every second counts in an emergency,” Lt. Scott Wahl of SDPD said in a statement Saturday. 

According to SDPD, between 7:15 p.m. and 7:45 p.m. when the family was calling for assistance, dispatch received 73 total 911 calls.

Dan DeSousa, of the San Diego County Department of Animal Services, said the family has not yet decided if they would like to keep the dog.

The dog, a 2-year-old American Staffordshire Terrier is in the custody of the Department of Animal Services and under quarantine.

Any decision on the fate of the dog will be made by the department after speaking with the family.

Sole Surviving Puppy in Abandoned Litter Now Up for Adoption

A tiny black puppy found clinging to life in a cardboard box, abandoned in the middle of the desert and the lone survivor in a box full of his dead siblings, is now up for adoption. 

A Southern California family found the cardboard box as they were biking through the inland desert hills east of San Diego County last month, according to Helen Woodward Animal Center.

The family quickly rushed the puppy to their home for nourishment and shelter. They then called a local animal rescuer, who took the puppy to the Helen Woodward.

The Center says the box of puppies was abandoned near the bike track running through the desert, surrounded by dirt, dusty-green rocks and cacti blooms, about a month ago.

The puppies struggled to survive without food or water and most succumbed to the heat of the sun. The family named the box's sole survivor Rico. Rico weighed about 3.5 pounds at the time of his rescue, said the Center.

Rico, a tiny chihuahua terrier blend, now weighs just under five pounds. He’s a male, neutered puppy. Officials estimate he is about 3 months old; they describe him as very friendly and social.

Rico's health took a toll from being abandoned in the desert, vets said. Despite developing a respiratory infection, he is slowly gaining weight and recovering his strength.

More than a month after he was found abandoned in the wilderness, Rico is now up for adoption.

Greater One-Horned Rhino Calf Debuts

A 9-week old calf is now among the greater one-horned rhinos on exhibit at the San Diego Zoo Safari Park.

Anandi, whose name means "joyful" in Hindi, debuted Monday in the park's 40-acre Asian Plains exhibit.

The calf was born February 24 and has been kept off exhibit with her mother, Alta, so the two could bond, according to a park news release.

The young one’s young, pink skin was visible under the folds of her thickening, armor-like, top layer of skin that appears as more of a gray color.

This species of rhino has been listed as vulnerable because of poaching and sales of rhino horn. Their habitat is also being encroached, according to the park.

An estimated 3,300 greater one-horned rhinos remain in the wild. Of those, more than 70 percent live at Kaziranga National Park in India.

Anandi is the 69th greater one-horned rhino born at the Safari Park since 1975, the park said in a news release.

What To Do If You Are Audited by the IRS

You've received a letter from the IRS regarding an audit. Stay calm and assess the situation.

The letter you receive may be one of three types:

Adjustment Letter – This notifies you of a change in your taxes owed, or the refund amount. In this case, it is generally from an obvious wrong number entry or miscalculation on your form.

Correspondence Audit – This letter asks for further information to verify your tax return; such as a W-2 form that does not match the amount reported by your employer. The letter will tell you exactly what information is needed and how to respond. It is possible that your entire audit can be dealt with via correspondence. This is the most common form of audit.

Examination Audit – This in-person audit is what most people envision... and fear. The letter will let you know the nature of the audit, what information is needed, and how to schedule an in-person appointment. The appointment may take place in your home, place of business, or at an IRS office. You generally have ten days to schedule an appointment.

There is a comprehensive list of notices and letters at the IRS website, along with links for further explanation. All letters and notices will contain the reason for the letter, its purpose, and how to respond.

Once you have read your letter and understand the issue, what's next?

Step 1. Don't Ignore the Issue – Ignoring the problem will not make it go away. The issue may be simple, such as acknowledging a math error, and may only require sending a check. In any case, you have a set amount of time to reply. This varies depending on the type of notice, but it is typically 30 or 60 days. If you have to pay interest, the more you delay, the more you will have to pay.

Step 2. Do you Need Representation? – You probably need representation by a CPA or attorney if you disagree with their findings, cannot find the documentation the IRS requested, or have a more complex tax issue.

You are still responsible for your return even if you had a third party prepare it for you. Take advantage of whatever audit defense is included with your contract. Professional tax-preparation does not guarantee freedom from an audit.

Step 3. Audit Preparation – Gather all the information requested, and have it organized. Make sure you have the correct year – IRS audits can involve returns from up to three years prior, and two years is not uncommon. It is wise to keep records for up to six years.

Step 4. The Audit – Bring all the requested information with you, and answer the auditor's questions to the best of your ability. Do not bring extra information, or discuss other issues – stick to the focus of the audit. You may have your representative with you during the audit, and you may make an audio recording as long as you provide advance notice.

Step 5. The Conclusion – The auditor will either agree with you and resolve the matter, or rule against you and require you to pay some additional taxes. There may be penalties and interest charges that you are liable for as well. You can choose to pay, or fight in court if you think your chances of success are good and the amount at stake is much greater than the legal fees.

The good news is, if you filed your return honestly -- and maintained thorough documentation and proof of your deductions – any additional taxes due are likely to be manageable. Consequently, keep your records in order, follow the IRS instructions, and get representation as needed. Your audit experience should be less painful than you fear it will be. And if you do assume the fetal position, snap out of it long enough to take care of business.

White House Lockdown Lifted

The White House was briefly placed on lockdown Tuesday afternoon after a man who was fleeing from a nearby robbery jumped over a fence at the complex, according to the Secret Service.

Members of the press were not being allowed in or out of the building about 4:10 p.m. The Secret Service said the White House was under a "condition yellow," a lockdown state.

The lockdown was lifted shortly after 4:30 p.m., but press members were still restricted and Lafayette Park was closed to pedestrian traffic.

A D.C. Fire and EMS spokesman said a man jumped the fence in the area of 17th and G streets, Northwest, at the Eisenhower Building, also known as the Old Executive Office Building. There is a separate fence between the grounds of the Old EOB and the White House, but the man did not get close to the second fence.

The man suffered a cut on his hand and was being treated at the scene, according to the fire department. Investigators with the Secret Service said the man was fleeing the scene of a nearby robbery when he jumped the fence.

The jumper was in custody of the Secret Service. President Barack Obama was at the White House after returning late Monday from an international trip.

Grocer ALDI to Open New Store in Vista

A German discount supermarket chain is planning a May store opening in Vista as part of its push to operate 45 stores in the state of California by the end of the year.

ALDI plans a grand opening of seven stores on Thursday, May 19 including one at 1750 University Drive in Vista.

It’s the first store in San Diego County for the grocery store chain.  Last week ALDI opened 10 Southern California stores, mostly in Los Angeles and Orange counties.

The stores are usually smaller than most grocers and focus on selling the most frequently purchased grocery and household items.

"We have our own products," Jim Taylor, director of store operations told NBCLA.  "Ninety percent of them are manufactured for us in our own exclusive brand format."

First-time ALDI customers might notice a few differences than other grocery stores.

For example, shoppers bag what they buy. Also, shopping carts come with a 25-cent rental fee. Shoppers get the money back after returning the cart.

The first 100 shoppers to arrive at the Vista store on May 19 will get a voucher for an ALDI gift certificate of various amounts. All shoppers will be able to enter for a chance to win free Produce for a Year. There will also be complimentary ALDI reusable eco-bags handed out May 19-22.

The grocer has more than 1,500 stores in 33 states and serves 30 million customers each month, according to a company news release. 

The retailer is expanding, planning to have more than 2,000 stores open nationwide by the end of 2018.

Railroad Crossing Arm Skewers School Bus in South LA

A railroad crossing arm crashed through the windows of a school bus carrying special needs children in South Los Angeles, spraying glass onto them, but no injuries were immediately reported, firefighters said.

The incident took place about 7:30 a.m. Tuesday at the crossing at East 55th Street and Long Beach Avenue in Central-Alameda (map), according to the Los Angeles Fire Department.

The crossing arm was coming down as the bus was making a left turn onto Long Beach Avenue, investigators said. The arm busted through the side windows, narrowly missing students.

"There were students in the seats where the cross arm came down, it did strike the glass, break the glass, but the students were not injured by the cross arm," said LAFD Capt. Ken Kemp. "It was fairly close."

Firefighters used a rotary saw to cut and remove the arm, then escorted the children off the bus, some of them in wheelchairs.

A second school bus was summoned to pick up the eight children, who were on their way to Hooper and Lizarraga elementary schools, according to the Los Angeles Unified School District.

Officials with First Student, the Cincinnati-based company that contracts for bus service at the LAUSD, did not return calls seeking comment.

Union Pacific workers repairing the arm said lights at the railroad crossing are timed to go on four seconds before the arms come down, which should give drivers enough time to stop.

California Highway Patrol officers are investigating whether the arm malfunctioned or whether the driver was at fault.

No Discussion of Mar Vista HS Arrests at Board Meeting

Sweetwater Union High School District officials were not questioned about the investigation into alleged sex crimes by an instructor, a tutor and a coach at the same high school when the board met with parents and community members Monday.

The Sweetwater Union High School Board met Monday night for the first time since the arrests of several staff members at Mar Vista High School.

Three adults with jobs that involved interacting with high school students, were arrested within days of each other. Each man is accused of sex crimes involving minors. Each has pleaded not guilty to the charges.

A 48-year-old former Navy Junior ROTC instructor who served as a substitute is accused of having a relationship with a female high school student.

An assistant football coach, 27, is accused of committing lewd acts with a 13-year-old freshman female on school property, according to the criminal complaint. 

In the third case, a 20-year-old tutor is accused of sex crimes with a minor.

NBC 7 learned Monday that a fourth employee, an instructor with the NJROTC, was pulled from the classroom and placed on administrative leave.

The district also removed classroom computers as part of their internal investigation.

The new personnel matter does not involve an accusation of sex crimes with a minor according to the district. That is something the San Diego County Sheriff's Department verified as well.

However district officials did not release what prompted the employee to be placed on leave.

The board opened the floor to members of the public to weigh in, and the result was a bit unexpected.

Like every school board meeting, board members held a public comment period.

Plenty of people got up and spoke, but no parent or community member said anything about the series of recent arrests at Mar Vista High School.

Board members and school district officials refused to comment about the sex scandal involving the Imperial Beach high school saying it was an active investigation.

'He Was Dying in My Hands': Boy Pulled Cousin From Water

A boy who found his young cousin face down in a San Diego pool said he will never forget his attempts to save the 8-year-old's life.

"I remember how I picked him up out of the water," said Juan Galindo, who was swimming with his cousin, Brandon Reynoso, at a family party over the weekend. "He was dying in my hands and I couldn't do nothing."

The family had gathered Saturday at the Del Rio Apartments on Fenton Parkway near Rio San Diego Drive in Mission Valley.

Juan said he saw his cousin motionless in the water and thought at first Brandon was playing a joke, then realized the seriousness of the situation.

"I got so scared, I didn't know what to do," said Juan. "So I just brought him over there where everybody was."

Brandon was not a strong swimmer, according to Juan, and was wearing a dive mask over his face. The snorkel was not attached.

Emergency crews tried unsuccessfully to revive Brandon, who did not regain consciousness or take another breath on his own, authorities said.

"I was crying a lot, because I was scared," said Brandon's sister, Jennifer Reynoso. "I had hoped that he would be safe because it was just water."

Family members raised money at a food sale Monday to help cover the cost of Brandon's funeral. They remembered him as a happy child who loved to swim.

"We never thought that the water would take his life away, what he loved so much," said Jennifer.

"He was the only little brother I have," she added. "We used to call him Baby Brandon, in a nice way."

She was grateful to the 50 people who turned out Monday to buy food and raise money. 

"They show that they care about him, even if they only knew him a little bit, or they only saw him once," Reynoso said. 

The family has set up a GoFundMe to help cover funeral costs.

SDPD's Child Abuse Unit is investigating the drowning, as is the protocol in all sudden child deaths.

Irvine Company owns the property but declined to comment out of respect for the family.

Selfies Banned in the Voting Booth

If you will be heading to the voting booth for the primary in June, do not take a selfie.

According to the San Diego Registrar of Voters, taking photos inside a polling place during voting hours is banned.

But for many voters, especially the younger generation, a voting booth photo is a must.

According to an article published in the New York Times Tuesday, several states like Pennsylvania and Vermont have banned taking pictures inside the voting booth. Those who violate the ban can be fined up to $1,000.

Now, Snapchat is joining the fight against the photography ban. The company filed an amicus brief in New Hampshire Friday.

Some supporters of the ban argue there may be attempts to manipulate voters through pictures taken inside the booth. Others are afraid of election fixing.

But those against the ban say there is not enough evidence to back up that argument.

Snapchat says ballot selfies and photos is a way for younger voters to participate in politics.

A photography ban is also in place at all polling locations in San Diego.

So, if you love to Snapchat or Instagram, try to take your selfie before or after you vote.

'Independent' Option Confuses Voters: Poll

The June primary in California may matter this year after decades of taking place too late in the game to matter. As some 1.7 million registered California voters gear up to cast their ballots, there is some confusion in the name of one party that may prevent some residents from casting votes.

With nearly half a million registered voters, the American Independent Party is bigger than all minor political parties combined.

It’s on the far right of the political spectrum with its members consider themselves pro-life and supporters of the Defense of Marriage Act. They also support building a fence along the entire southern United States.

A poll from the LA Times found 3 out of 4 people were simply confused by the name of the party, thinking they were checking the registration box that made them an “independent” voter.

The Times found Hollywood celebrities like Demi Moore and Emma Stone didn’t realize they weren’t declaring themselves independent of the major political parties Democrats or Republicans when they checked that box.

California has a top two primary system allowing voters to cast ballots for any candidate, regardless of party. But in presidential races, parties set the rules and the Republicans have a closed primary in California this year.

Democrats will allow voters registered as “No Party Preference”, the legal term for Independent.

In Ocean Beach, one resident said he hoped to vote in the Democratic primary until he discovered the registration mistake.

“It actually was not knowing I’m registering for a party and I thought I was registering as an independent,” said Bryan Davidson. “It was pretty shocking.“

He said they should make the registration form clearer.

"There should be no doubt what you are registering for when you put your check mark on the box," Davidson said. "You should know a hundred percent that you are going to be registered as an independent or for the American Independent Party because you certainly don't want to be affiliated with a party you know nothing about or don't stand for their views."

San Diego County Registrar of Voters Michael Vu said there are approximately 50,000 voters registered with the AIP.

“It would probably behoove those individuals that would consider themselves as independent voters to double check that by going to our website at sdvote.com,” Vu said.

Trump’s Attorneys Argue No Trial Is Needed

There is no need for a trial now; that’s what Donald Trump’s California-based legal teams have told the U.S. District Court in San Diego, hearing a federal class-action lawsuit against Trump University.

Two different lawsuits allege Trump’s school engaged in deceptive practices and scammed thousands of students who enrolled in response to claims the school would make them rich in the real estate market.

According to the newly-filed court documents, Trump’s attorney claims enough “undisputed facts” have been submitted so the “causes of action” in the case can be decided. In the documents, they are asking for either a full or partial summary judgment.

U.S. Federal Judge Gonzalo Curiel is set to consider this request at a July 8 hearing in San Diego.

In the documents, under the heading of “Undisputed Fact,” the Trump’s attorney lists dozens of reason why the GOP Presidential candidate is innocent of the allegations. Many of the “undisputed facts” tie to Trump’s testimony taken during a deposition for the case.

Among the facts, provided by the attorney:

 

  • Trump cares about the image of the Trump brand, which symbolizes, “high quality, excellence and luxury."
  • Trump works hard to make sure “his brand maintains its image,” but, according to the court documents, this doesn’t mean he personally manages “all business operations of the Trump Organization.”
  • Trump’s motivation for the school was to “impart to students the practical lessons about real estate investing” Trump learned “the hard way.”

According to court documents, the idea for Trump University was brought to Trump by Michael Sexton to provide educational training products through the internet. Trump liked the idea, a way to empower people, the filings explain. Sexton was “at all relevant times” the President of Trump University and in charge of operations, according to the court documents.

 

The documents detail how Trump was involved in the creation of “goals and expectations” for the school and approving the curricula and was. Trump was “personally involved in hiring decisions” of instructors and mentors and had no role in ”evaluating whether the marketing materials were legally compliant,” according to the court documents. He depended on Trump University's counsel and compliance team “to review marketing materials” for legality.
