Watch: Drone Video of Gray Whales off La Jolla

Using a drone, a Southern California photographer captured breathtaking video Wednesday of several whales off the coast of La Jolla.

Photographer Sandy Rich said the drone footage was shot near Windansea Beach. It shows at least three whales – likely gray whales – making their way across the ocean.

As the whales swim and the drone circles overhead, the whales encounter several dolphins.

Gray whales tend to stay within coastal waters. When they migrate during the winter, the mammals tend to stay within six miles of the coastline, moving further out as the summer begins.

Whale watching season in San Diego is typically at its prime in January, as gray whales begin their northward migration from the lagoons of Baja California toward the Bering and Chukchi Seas, according to the Hornblower San Diego Whale Watching blog.

San Diego is home to approximately 70 miles of coastline located directly on the sea creatures’ migration path, making whale watching a very popular activity in America’s Finest City, especially at prime locations such as Birch Aquarium at Scripps and Torrey Pines State Reserve.

San Diego Mourns Music Icon Prince

Following the report that music icon Prince passed away at the age of 57 on Thursday, music fans the world over have begun to express their memories, grief and impact the beloved musician had on their lives – and San Diegans, of course, are mourning, too.

Throughout the years, Prince performed in San Diego a handful of times (seven dates to be exact), with his last shows a surprise two-night, four-show stand on May 3-4, 2013, at the Legends 6 Ballroom in the Hard Rock Hotel in downtown San Diego.

"We'll have purple exterior and interior lights at the hotel today," Rana Kay, Hard Rock Hotel's Director of Public Relations told SoundDiego. "Every time there's a big loss in the music industry, we feel it at Hard Rock."

Kay remembered back to the four Prince shows that took over the Legend 6 ballroom at the hotel three years ago, noting that Prince was simply spectacular at guitar and commanded the room with a magnetizing presence.

Upon hearing news of the musician's passing, tears were the immediate reactions of staff at the Hard Rock, Kay said.

As a huge fan of Prince herself, Kay said her memories of the musician include listening to his tapes with her sister as teens while they got ready for school each morning.

The huge video board behind the front desk currently has a photo of Prince, and all screens will be radiating purple light in his honor. The hotel's music playlist will be all Prince songs all day, as well. Kay said there are no special events planned as of yet, but fans are welcome to gather there later in the day.

The venue, which only holds 900 people, was the closest many had ever come to the legend, and the energy was palpable, Kay said – even in the gargantuan line of fans hoping to get in, which stretched through the Gaslamp Quarter.

"The vibe was so insane," SoundDiego blogger Scott McDonald recalls. "There was such an intense comradery among everyone in the line that we’d have the possibility of being so close to such a huge figure. You don't get that at a normal show. And he delivered. [Prince] played a lot of new songs, but he also threw in some hits from throughout his career."

McDonald, who grew up in Minneapolis -- the birthplace and stomping ground of Prince himself -- thought back on the three times he saw him and expressed a profound sadness that he would never be able to add to that tally.

"Even when David Bowie died -- and I consider Bowie as one of the greatest rock stars ever -- I didn't feel it as personally as I do [with Prince] now," McDonald told SoundDiego. "For me, Prince was the barometer -- so to think of music in general without him, is a hard concept to grasp. I'm still trying to process it. It's terrible."

On Thursday, the Legends 6 ballroom was hosting a national sales conference for an insurance corporation.

NBC 7 spoke with several attendees of the conference, many of whom were rattled and saddened by the passing of the icon.

Florida resident Dina Glover said she got "chills" and goosebumps when she learned her conference was taking place in the very room where Prince performed.

Sanjay Nanglia, of Cleveland, Ohio, said he's a lifelong fan of Prince and was devastated by the news of the pop icon's death. He and Prince share a birthday, so he feels a deep connection to the singer.

Nanglia grew up in India and told NBC 7 he remembers listening to Prince tapes in the 1980s. After listening to "Purple Rain" and seeing Prince's style, Nanglia said he was inspired to wear lace.

"I just wanted to be him," Nanglia said, adding that he gave his girlfriend at the time the nickname "Purple Rain."

"She's didn't last long -- because of the lace," he joked.

Nanglia said Prince's legacy and unforgettable music will live on forever.

"It's a huge loss to pop music," he lamented.

Nanglia was inspired to break into song as a tribute to Prince, and he belted out parts of "When Doves Cry" and, of course, "Purple Rain."

Other fans at the hotel followed suit, also singing their own versions of classic Prince hits.

Meanwhile, San Diego musicians took to Twitter to express their disbelief.

And even more grieved on Facebook.

San Diego radio station Magic 92.5, which broadcast a mix of old-school R&B and hip-hop songs, announced they'll be playing Prince on-air all day Thursday, April 21 -- and encourages listeners to call in to share their grief. 

"Today is a hard day," Magic 92.5's Program Director and afternoon host R Dub! said in a press release. "Prince is an icon to our audience. The best thing we can do now is play his massive library of hit music and remember what a creative and inspirational legend he is."

Later in the day on Thursday, the Casbah announced a Tribute to Prince show on Sunday night with DJ Artistic, Vaughn Avakian, DJ Claire, Heather Hardcore, Al Howard of the Redwoods collective and Mario Orduno, which begins at 8:30 p.m.

City Attorney Missed Deadline on Dozens of Cases

Dozens of cases were not prosecuted by the San Diego City Attorney's Office because a deputy attorney missed the deadline to file charges. 

According to a memo released Wednesday by City Attorney Jan Goldsmith, 19 of the 98 cases could have been issued.

They included 15 misdemeanor domestic violence cases, two indecent exposure cases (one of which had no victim), one case of a sex offender who didnt register on time, and one case of theft from an elder.

In the memo Goldsmith said, in part, "there is no justification for what happened in this situation. it is inexcusable to allow the statute of limitation to expire, as it did in these cases."

Fatal Mission Beach Hit-and-Run Case Heading to Trial

The case involving a DUI suspect accused of running down a community activist cleaning graffiti in Mission Beach will go to trial, a judge ruled Thursday. 

Jonathan Domingo Garcia, 23, has pleaded not guilty to charges stemming from an alleged road-rage fueled, hit-and-run crash that killed 69-year-old Maruta Gardner. His attorney said his client denies all charges. 

Deputy District Attorney Steven Schott said at about 3 p.m. Friday, Garcia and a friend were drinking 40-ounce cans of beer near 3100 Mission Boulevard. They were seen slashing tires on random vehicles and otherwise vandalizing the cars.

Less than three hours later, Garcia was behind the wheel of his own car, with alcohol, marijuana and another depressant drug in his system, Schott said.

As he drove through Mission Beach, he rear-ended a white Mustang and continued to drive off. When he returned to that same intersection, the white Mustang’s driver was in pursuit.

The Mustang got in front of Garcia, Schott said, so Garcia made an illegal maneuver and zoomed to the right of the Mustang, driving along the road’s shoulder and speeding up to nearly twice the posted speed limit.

According to the prosecutor, he was going that speed less than two seconds before he struck Gardner, who was cleaning graffiti on the curb of Jetty Road and Mission Boulevard.

At his preliminary hearing Thursday, his attorney argued the woman's death appeared to be a result of her head hitting the pavement, not a result of the vehicle collision. He said his client had begun to break and was driving less than ten miles an hour when he struck Gardner.

At the time, she was on the shoulder of the road, as she had stepped back to look at what she was working on. 

"The problem we have here is we have an individual who stepped out into the roadway," his attorney argued, stating Garcia was driving eight miles an hour when he hit Gardner. 

He asked for the gross vehicular manslaughter charge to just a misdemeanor, saying his client has "no recollection of the accident, no memory of hitting anyone." 

Garcia allegedly did not stop after the fatal blow. Garcia stopped to check out his car and then got back in, droving back to the crime scene and again refusing to stop as an officer tried to waved him down, according to the prosecutor. 

Three hours after the incident, investigators said Garcia’s blood alcohol content was still 0.06, and he had tested positive for marijuana and a depressant drug.

Gardner, known for being a pillar of her community, suffered fatal head injuries and died at the hospital.

As the autopsy report was read at the hearing, Garcia sobbed. 

Judge Jay Bloom sent the case to trial. 

He now faces a charge of gross vehicular manslaughter while intoxicated with an allegation that he fled the scene. If convicted, he could be sentenced to 15 years in state prison.

Woman Killed in 'Deliberate' Hit and Run Identified

A woman left for dead after an apparently intentional hit and run in the City Heights area was physically assaulted before the collision, police said Thursday.

The woman who died in the collision on Wednesday morning has been identified as 29-year-old Jasmine Leigh Ruiz.

Police said her body was found beneath a vehicle in the west alley of the 4100 block of Wilson Avenue just after 10 a.m. She died despite efforts by emergency personnel to resuscitate her.

Initially, police thought the crash was an accident. However, after speaking with witnesses and examining the scene, SDPD officials determined the hit-and-run appeared deliberate, and homicide detectives were called in to take over the investigation.

Detectives believe the car was used as a weapon to kill the victim after a physical assault.

Witnesses told San Diego Police Department (SDPD) officers that a group of suspects – possibly one woman and two men, all in their mid-20s and possibly Hispanic – exited the car and ran away from the scene of the crash. The suspects were last seen sprinting southbound away from the alley.

Police said one man, described as heavyset, may have had blood on his shirt. The female suspect may have also been covered in blood.

Investigators are continuing to interview possible witnesses and still need the public’s help in the case. Anyone with information is asked to call the department’s homicide unit at 619-531-2293 or Crime Stoppers at 888-580-8477.

Aide Tells RNC Trump Has Different Private Persona

Donald Trump's top aide assured Republicans that the presidential candidate has the capacity to shift his personality to appeal to women, minorities and other voters in a general election, NBC News reported.

"When he's sitting in a room, he's talking business. He's talking politics in a private room. It's a different persona," top Trump aide Paul Manafort said during the meeting, a recording of which was obtained by NBC News. "When he's out on the stage, when he's talking about the kinds of things he's talking about on the stump, he's projecting an image that's for that purpose." 

Manafort's comments come as Trump is trying to build a more professional campaign that can lock up the 1,237 delegates needed to win a majority at the Cleveland convention. But they're potentially problematic for a candidate who's built a brand centered on telling it like it is and accusing typical politicians of misleading voters.

London Mayor Slams Obama as 'Part-Kenyan' Hypocrite

London's mayor is accusing President Barack Obama of an "incoherent" and "perverse" intervention in the country's so-called Brexit debate after urging British voters to remain in the political bloc, NBC News reported.

In an op-ed article in The Daily Telegraph published as he arrived in London Friday, Obama said the outcome of the vote "is a matter of deep interest to the United States."

European coordination on intelligence sharing, counterterrorism and economic growth "will be far more effective" if Britain stays in the EU, Obama wrote.

Mayor Boris Johnson, who is leading the anti-EU campaign, accused the president of "hypocrisy" and speculated that "part-Kenyan" Obama was expressing an "ancestral dislike of the British empire."

Britons will vote on whether to stay in the European Union or leave in a June 23 referendum.

Dispute Over Airplane in Driveway

A 70-year-old Long Island man who allegedly ignored 17 summonses calling for him to remove a plane parked in his driveway threatened to use a crossbow on town officials who dismantled it.

Crews spent most of the day Thursday disassembling the single-engine Cessna parked outside Harold Guretzky's home in Oceanside, ending a 1½-year saga that pitted Guretzky against his neighbors and the town.

"We gave him a deadline of yesterday to move the plane and he did not do so," said town supervisor Anthony Santino.

Guretzky, who is outside the country, said by phone Thursday he plans to sue the town for $5 million.

"They have no right to take property licensed by the federal government," he said. 

He also threatened to use a crossbow on anyone who touched the aircraft.

"I'm glad I'm not there. If I would be there — I have a crossbow — anybody who comes near that airplane, I'd shoot right through their [expletive] chest," he said.

The plane, dubbed the "Spirit of Oceanside," was removed from Guretzky's driveway piece by piece before being loaded onto a flatbed and carted to a Hempstead park for storage. 

Town officials said housing the aircraft in Guretzky's driveway violates building safety codes.

"It's a relief to the entire area," said one neighbor. "It's very dangerous."

Last year, Guretzky likened it to parking a boat in a driveway and has said he didn't have money to house the plane in a hangar. Some neighbors, however, said there's no comparison.

"There's just no reason for it to be here," said Vincent Labruzzi. "It's not a boat you can put in the water. You can't go down the street and take off, so what's the point?"

Others sympathized with Guretzky.

"He did everything the town asked him to do, and they're still taking it away," one woman said.

Town officials said they plan to bill Guretzky for the cost of removing the plane.

UK Warns LGBT Tourists About NC, Miss.

Britain has advised gay tourists on travel to North Carolina and Mississippi, states that have recently passed laws deemed as discriminatory, NBC News reported.  

The legislation in North Carolina banns anti-discrimination protections for gay and transgender people and Mississippi's law allows businesses to deny service based on their belief on marriage.

"The U.S, is an extremely diverse society and attitudes towards [lesbian, gay, bisexual and transgender] people differ hugely across the country," the U.K.'s Foreign Office said in a statement on its website. "LGBT travelers may be affected by legislation passed recently in the states of North Carolina and Mississippi."

This international notice comes after national backlash against the North Carolina laws, including musicians Bruce Springsteen and rock band Pearl Jam canceling their performances in the state.

Uber to Launch Carpool Service in San Diego

San Francisco-headquartered Uber Technologies Inc. plans an April 25 launch in San Diego of its UberPool ride-hailing service, allowing customers heading to the same destination to share rides at a discounted price.

The San Diego launch follows similar carpool-oriented services recently started locally and nationally by Uber’s chief competitor, San Francisco-based Lyft Inc.

In a statement, Uber officials said the company’s new service is geared toward reducing traffic congestion and pollution by filling more seats in vehicles. Pricing for UberPool rides is expected to be 25 percent lower than they would be for similar rides taken through the company’s existing UberX offering.

San Diego riders will be able to order an UberPool ride by first selecting the UberX option on the company’s mobile application. They can then enter the destination and the number of seats needed, and choose between sharing the ride or requesting the standard UberX.

Officials said riders in the Los Angeles market took more than 5 million UberPool trips in the first eight months that it was offered in that city, and UberPool now accounts for more than 25 percent of Uber trips in Los Angeles.

UberPool was started in 2014 and also launched previously in cities including San Francisco, Paris, New York City and Austin, Texas. Rival Lyft launched carpooling services earlier this year, and its Lyft Line began operating in San Diego on April 15.

Driver Thrown From Vintage Pickup Truck

A man was thrown from his vintage pickup truck during a head-on crash in the Mira Mesa area Thursday.

San Diego Police say the driver of a 1957 Chevy pickup was not wearing his seatbelt when he crashed just before 7 p.m. near Mira Mesa Boulevard and Parkdale Avenue. 

Older model trucks do not require seatbelts. 

The extent of the man's injuries were unclear, but he was alert and talking when taken to the hospital. 

The driver of the other car was not hurt.

Man Accused of DUI, Child Endangerment in Fatal O'side Crash

A child witnessed his father drive into a pedestrian on an Oceanside street, according to witnesses and Oceanside police.

An unidentified man was walking westbound on Mission Avenue east of Mesa Drive at 4:00 p.m. Thursday when he was struck by a 2002 Kia Sedona traveling in the opposite direction. 

Oceanside Police took the Kia driver into custody. Ricky Robledo, 42, is accused of being under the influence of alcohol and with his 8-year-old son at the time of the crash, police said.

Robledo was driving eastbound on Mission Avenue when police say he drifted into the bike lane. He pulled over and waited for emergency crews to arrive.

The pedestrian was identified as in his late 60’s. Emergency personnel rushed him to Scripps La Jolla Hospital where he died of his injuries.

Robledo was booked into the Vista Detention Center for felony DUI, vehicular manslaughter while intoxicated, and felony child endangerment, according to Oceanside Police

Cracker Jack Replacing Toy Prize With Digital Codes for Mobile Games

It's the end of era.

The iconic prize found in a bag of Cracker Jacks will be replaced with stickers containing digital codes for mobile games, the company announced Thursday.

Cracker Jack, which is owned by the Frito-Lay division of PepsiCo, said the company is taking a new approach to their prizes with "baseball-inspired mobile digital experiences directly from the sticker inside."

"The new Prize Inside allows families to enjoy their favorite baseball moments through a new one-of-a-kind mobile experience, leveraging digital technology to bring the iconic Prize Inside to life," Cracker Jack said in a statement.

The new prizes will require fans of the caramel-coated popcorn and peanuts snack to down the Blippar app, available for iOS and Android, and will come in four themes: Dot Dash, Dance Cam, Get Carded and Baseball Star. Cracker Jack will also debut restyled logo and packaging.

The announcement comes as baseball season gets into full swing.

11-Year-Old Dies After Choking

An 11-year-old girl from Somerset, Massachusetts, has died after choking on a marshmallow at a birthday party last Saturday.

Azriel Estabrooks, a student at Somerset's North Elementary School, was found unconscious at the party and hospitalized for almost a week in critical condition, according to NBC affiliate WJAR in Rhode Island.

She died Friday morning, the school principal told WJAR.

Azriel's mother, Iris, said she dropped her daughter off at the party and received a call about an hour later from the mother who was hosting.

"[She said] that I need to hurry up because something happened to my daughter," Estabrooks told WJAR. "She doesn't know what happened."

The fire department responded to the scene, authorities said.

Estabrooks said rescuers found a marshmallow lodged in her daughter's throat. She believes Azriel was unconscious for some time without oxygen to her brain before someone found her and called for help.

Estabrooks accused the host family of negligence. WJAR could not reach the family for comment at the time of the initial report.

Botched Prosecution Has Implications for Victims

In November 2015, the City Attorney’s Office conducted an audit and found 98 criminal cases were mishandled.

Nineteen of the 98 cases had expired under the statute of limitations. The majority of those were domestic violence cases.

Because of what happened in the City Attorney's office, some people accused in those domestic violence cases will never be prosecuted.

The missed cases spread from 2012 through 2015.

In an internal memo sent to staff Wednesday, City Attorney Jan Goldsmith wrote that the City Attorney's office “investigated to determine whether the suspects had any pending or new cases against them” and said none did.

That's not much consolation for Carmel Valley Psychologist Sage Breslin, who works with victims of domestic violence.

She said she was "horrified" after hearing of the City Attorneys mishandling of the cases.

“I am horrified because I am an advocate for these kind of victims,” she told NBC 7 San Diego. “To know how much courage and effort it takes for men and women to come forward when they have been victimized in their homes or in their relationship, to know they bet the farm on it and suddenly there is nothing else they can do? Now it’s never going to be prosecuted? Are you serious? So know they are out there more exposed than ever and they don’t have the law on their side anymore, ready to scoop them up or make sure they are safe?”

Breslin hopes this incident will help change the system.

“I am hoping some sort of precedent can be made so that at least the rules and laws around these timeline be changed or amended in some way," she said. "So that they can at least be afforded the right to prosecute these cases.”

She would encourage the victims in these cases to come forward.

“I think it’s time to have a voice," she said. "I don’t think it’s ok for these particular people to have entrusted the system with their lives and only to be told someone else’s mistake has made it so they can’t prosecute their cases.”

Late Thursday afternoon, Jan Goldsmith released this statement to NBC7 Investigates:

“When we found the files, we were able to save some cases shortly before the statute of limitations expired and those cases were filed. We could not save 19. Our office helps thousands of domestic violence victims each year, but we let these victims down. We contacted each one and offered to meet with them and provide help, including services. We want victims to know that we are there for them notwithstanding what happened in these cases, and we have taken every step possible to ensure it does not happen again.”

Gulls Win First AHL Playoff Game

The Gulls skated past the Texas Stars for a 3-1 victory in the first game of their best-of-5 playoff series.

Antoine Laganiere opened the scoring with a goal with 4:30 left in the first period. 

After the Stars got on the board early in the second, Nick Ritchie lit the lamp to break the 1-1 tie and swing momentum back to the Gulls bench. 

Then Chris Mueller added an insurance goal to give the Gulls a little bit more breathing room and lock down a 1-0 series lead.

San Diego plays game 2 in Austin, Texas Saturday evening before returning home to America’s Finest City.

Game 3 will be Thursday at the Valley View Casino Center and if necessary, the Gulls will host game 4 (Friday April 29th) and game 5 (Monday May 2nd) as well.

The Gulls qualified for the Calder Cup playoffs in their first season in the American Hockey league.

San Diego is one of five expansion AHL franchises competing in California this season after the relocation of many minor league hockey teams this past fall.

Car Travels Miles Going Wrong Way on SR-52: CHP

A sedan drove the wrong way up an off-ramp and kept driving for approximately two miles on State Route 52 before crashing, California Highway Patrol (CHP) officers said. 

The crash happened on westbound SR-52 near the Interstate 805 junction at approximately 7:57 p.m.

A woman behind the wheel of a Toyota Yaris drove for at least two miles going in the wrong direction before colliding with a Honda HRV, officers said. 

The force of the impact sheared off the front end of the Toyota however, the driver was not injured. 

The Honda driver walked away with aches and pains.

CHP Sgt. Dan Kyle credited her skills behind the wheel for saving her life.

The driver “saw what was coming, got over the initial shock right away, really kept her head about her and turned in the proper direction,” Kyle said.

The Toyota driver was given a field sobriety test and then handcuffed on the scene, walked to the squad car and arrested for suspicion of DUI.

Investigators say the wrong-way vehicle entered the freeway through the off-ramp at Regents. 

HS Student Dies in Bathroom Fight

The sophomore who died shortly after a confrontation inside a bathroom at her Wilmington, Delaware, high school has been identified as Amy Joyner-Francis, police said Friday.

Police have not said what caused the 16-year-old’s death, but school and city officials said Thursday she died shortly after a "physical altercation" with two students at Howard High School of Technology.

Students who knew about the fight said they believe it stemmed from a dispute over a boy. 

Police did say a school resource officer called EMS at 8:18 a.m. Thursday for a student complaining of head and chest pain, and that the call quickly escalated to a report of CPR in progress. Joyner-Francis died a short time later at a nearby hospital.

Students at the school, which is part of the New Castle County Vocational Technical School District, returned to class Friday. An autopsy was expected the same day.

"Several female students were involved in a physical altercation at approximately 8:15 a.m. this morning, in a main floor girls bathroom, just at the time classes began for the day," the school district said in a statement.

Shauntea Bellamy cried as he sat outside the school after learning of the student's death. He worked with her as part of youth outreach programs and said she was set to volunteer in a summer program he organizes.

"It hurts when you know her personally and she's not one of my students who are out there in the streets like that," he said. 

Wilmington Mayor Dennis Williams said police were interviewing suspects Thursday evening, but didn't elaborate about whether arrests would be made.

State agencies will help provide support for those affected by the tragedy, Gov. Jack Markell said in a statement. 

Wilmington City Councilman Darius Brown is holding a town hall meeting for the community at 6 p.m. Monday, at Stubbs Elementary School. He said the governor, state attorney general and mayor will speak.

Students were surprised to hear about the girl's death, saying the school is not known for being a trouble spot. Records show there have been 14 reported fights there last school year. Williams called the fight an isolated incident.

Friends of the girl held a vigil in her memory outside the school Thursday night, and another vigil was expected at 6 p.m. Friday. 

"A lot of families were destroyed today," Williams said.
