Bill Cosby's Wife Will Have to Undergo Deposition: Judge

0
0

Bill Cosby’s wife will have to appear for a deposition in a civil suit involving her husband in Massachusetts, NBC News reported.

Camille Cosby’s attorneys argued any information she had about her husband’s “proclivities” would be irrelevant and that she would be protected under state and federal law. They brought forward a motion to oppose a subpoena issued in a defamation case brought by several women accusing Cosby of sexually assaulting them. A judge denied the motion.

"I find no merit in Mrs. Cosby's arguments, and accordingly deny her motion in its entirety," U.S. Magistrate Judge David H. Hennessy wrote.

Cosby has repeatedly denied allegations made by dozens of women who have accused Cosby of sexual misconduct or assault dating back to the 1960s.

Gibson collected 21 saves against the Oilers for his 4th shutout in 12 NHL starts this year.

Gibson started the season in San Diego with the Gulls before getting promoted, but now appears to have a stranglehold on the depth chart in Anaheim.

The Gulls lost 6-1 Thursday night in Texas. They are on the road again on New Year's Day in San Antonio.

The Gulls next home game is Friday, January 8th.

Transportation in parts of Missouri hit roadblocks Thursday as rivers in the midwest swelled to historic levels, NBC News reported.

Authorities closed down interstates 55 and 44, and transportation by boat, car and train were paralyzed in the St. Louis area.

Hundreds of homes in southwestern suburbs of St. Louis were damaged and hundreds of other homes were evacuated in the wake of the powerful storm.

Two rivers surged to record levels since the “Great Flood” of 1993. Waters surged after more than 10 inches of rain fell this week from Illinois to Missouri. At least 22 people were killed in Missouri and Illinois.

Hundreds of new laws go into effect across the country starting Friday from smoking laws to carrying guns in public, NBC News reported.

Hawaii will be the first in the nation to raise the legal smoking age to 21. The law applies to cigarettes, cigars and also electronic cigarettes.

Adults with proper gun ownership permits will no longer need to hide firearms in their shoulder or belt holsters. Those in support of the new law say making guns more visible will deter mass shootings.

Albany, New York, residents who own firearms will now be required to store their guns in a secure container or install trigger locks.

A gunman opened fire on New Year’s Eve revelers at a party in New Orleans, injuring five people Thursday night, according to police.

Police said the shots came from a dark four-door vehicle, which pulled up to the party around 10:00 p.m. ET, NBC News reported.

Police were still investigating the incident early Friday morning.

One of the victims — who were all males from 15 to 22 years of age — was in critical condition. The rest were in stable condition, New Orleans Police spokesman Frank Robertson said.

Runaway Horse Ends Up in School Parking Lot

A runaway horse caused some traffic troubles in San Diego’s East County Thursday morning before ending up in the parking lot of a high school, officials said.

According to the San Diego County Sheriff’s Department, a horse wandered onto busy Mast Boulevard near West Hills Parkway in Santee.

Deputies and officials with the County of San Diego Department of Animal Services were called to the area to corral the horse. They chased the animal along the street and deputies said the horse nearly ran onto State Route 52 at the end of Mast Boulevard.

Officials cornered the horse, and it ran the opposite way, back up Mast Boulevard. Eventually, deputies were able to stop corral the animal in the parking lot of West Hills High School, the sheriff’s department said.

During the chase, officials stopped some traffic in the area as officials worked to keep the horse safe.

By 10:30 a.m., the sheriff’s department said the four-legged runaway had been picked up by its owners. The animal was unharmed. No details were released on where the horse ran away from or how he escaped.

West Hills High School is currently on winter break, so students were not on campus or in the parking lot at the time of the incident.

Accused 'Bridal Bandit' Appears in Court

The San Diego woman accused of stealing wallets and credit cards from brides, wedding parties and guests has a long criminal history including nine previous felony convictions, prosecutors said Thursday.

Denise Gunderson appeared in a San Diego courtroom and pleaded not guilty to 25 counts ranging from burglary theft to identity theft.

Gunderson is accused of posing as a wedding guest while going through purses and other personal bags belonging to brides and their guests. The alleged crimes occurred in Pala Mesa, Coronado, Carlton Oaks and David's Bridal, prosecutors said.

Prosecutors claim she made thousands of dollars in fraudulent credit card charges. Victims' credit cards were used at large retailers like Costco, Walmart and Target to buy gift cards and other related items, police said.

In court Thursday, Gunderson, who also goes by the name Denise Burns, hung her head and covered her face with her hair.

Deputy District Attorney Brendan McHugh asked for $100,000 bail, explaining the defendant has nine felony priors and seven prison priors. McHugh said he believed Gunderson was a flight risk.

However, Judge David Szumowski set bail at $250,000.

She was arrested in Las Vegas on December 6, accused of stealing a wallet at a church. Investigators said she initially lied about her identity. They soon discovered she was wanted on mutliple charges out of San Diego and Riverside Counties.

Gunderson was captured on surveillance cameras using credit cards from stolen brides at local stores, police said. Sometimes the purchases were made just minutes after the brides walked down the aisle.

Newlywed Michelle Tietz told NBC 7 her credit cards were stolen on June 7 during her wedding at the Pala Mesa resort in Fallbrook. More than $1,000 charges were made on her card, she realized it when her and her husband were getting ready to leave on their honeymoon.

“I walked out of the bridal suite about 6:08 p.m. and the first charge was 6:32," Tietz said.

Yvette Lynch, the catering director at Santee’s Carlton Oaks Golf Course, had her wallet stolen from the purse she left in her office during a wedding.

“I think initially the target for this event was the wedding, but we keep the bridal quarters secure,” Lynch told NBC 7.

She shared surveillance video with NBC 7 that showed a woman walking around the golf course the day of the theft, allegedly posing as a lost guest.

An investigator said Denise Burns was charged in 2012, accused of sneaking into teachers’ classrooms in Temecula and stealing their wallets when they were out of class.

Riverside County Sheriff’s Department officials said a friend of the defendant, Sheila Russo, is wanted as a co-conspirator in the crime spree. She faces charges ranging from identity theft and forgery to burglary.

Gunderson's next court hearing is scheduled for January 12, 2016. If convicted on all charges, she faces up to 19 years in prison.

McHugh said it is possible there may be other victims and he suggests anyone who feels they may have been targeted by Gunderson should call the authorities.  If you have any information about this case, you can contact NBC 7 Investigates at (619) 578-0393.

Munich Terror Threat Remains in Place

Munich train stations reopened and trains were running on New Year's Day, but a terror warning about Islamic State extremists intending to blow themselves up in the German city remained in place.

"The information about an imminent terror attack at midnight was very concrete," police spokeswoman Elisabeth Matzinger told The Associated Press on Friday. "Even though nothing happened, our terror warning stays in place."

Just shortly before the city rang in the new year, Munich police had evacuated the main train station and a station in the Pasing neighborhood. Partygoers were asked to avoid crowds.

At a Friday news conference, Bavaria's Interior Minister Joachim Herrmann said a friendly foreign intelligence service had warned Germany of an imminent terror attack at midnight by between five and seven Islamic State militants from Syria and Iraq planning to blow themselves up at locations in Munich, including the two stations.

Authorities were investigating intensively on Friday, Herrmann said, but so far had not made any arrests. He said they had received personal data for some of the attackers and were still in the process of investigating and verifying the information. He would not give any further details on the possible attackers.

More than 500 police and special unit officers from all over the southern Bavaria region were called to Munich late Friday night to help evacuate and secure the stations. On Friday around noon time, some 100 extra officers were still present in the city.

Herrmann asked Munich residents for understanding that police would conduct more ID checks than usual.

Despite police warnings to stay away from big crowds, thousands of people were on the streets of Munich at midnight to welcome the new year with fireworks.

Cities across Europe have been on edge since an attack in Paris in November that killed 130 people.

A few days after the Paris attack, a soccer stadium in Hannover in central Germany was evacuated after a threat against a friendly match between Germany and the Netherlands. The authorities never reported any findings of explosives or concrete attack plans.

Prop B Pension Case Ruling Presents Long-Term Problems

0
0

It could be years until San Diego taxpayers learn how much a pension case ruling might cost them.

While a state labor board decided in favor of city union workers, their leaders say the only sure winners figure to be lawyers.

It's expected that the city will challenge the ruling in a state appeal court -- and get a restraining order, then an injunction to freeze the status quo.

For now, the case adds up to an administrative and financial nightmare.

"What I think we'll actually see, more likely, is some sort of settlement,” says Liam Dillon, assistant editor of Voice of San Diego, NBC 7’s online media partner.

Dillon could imagine a $10 million to $15 million settlement offer from the city that sets the bargaining table for a better global solution: “Because what the (labor board’s) restrictions are -- what the city's supposed to do -- is pretty much impossible to accomplish. "

About 2,000 city employees have been hired under 401(K) style retirement plans in the three years since the Proposition B citizens' initiative took effect.

The labor board's order calls for retroactively awarding them the "defined benefit" pensions the city traditionally offered, plus 7 percent interest.

The mayor and city attorney say they're confident the ruling -- which cited a lack of good faith negotiations, and the involvement of city officials in the initiative -- will be overturned in court.

Union leaders predict the opposite, but say if the city would finally sit down at the bargaining table, a "win-win" solution probably could be worked out.

"Just prior to Prop. B, as firefighters, we agreed to pension reform that significantly reduced pensions for firefighters hired after January 1, 2012,” says Alan Arrollado, president of City Fire Fighters Local 145.’

“As a matter of fact -- the cost of those pensions? The city would be paying less if the firefighters were in those pensions than the current 401(k) that they're in."

But Ed Harris, president of the San Diego Lifeguard Assocation, is pessimistic about a good-faith negotiations scenario.

"My expectation is, they will make the wrong move to protect their political careers,” Harris told NBC 7. “ So they will fight this, pay more money to attorneys. They will ultimately lose, but will have moved on and the taxpayers will be on the hook for it. There's really not a big hook, if you go into it and fix it now."

One person will start 2016 a whole lot richer, thanks to a winning $7 million lottery ticket.

That lucky ticket, a Super Lotto Plus, was purchased at Nordahl Liquor in San Marcos on Christmas Eve.

The winner – who has not yet come forward – can collect a lump sum of $4.6 million after taxes or opt for payments over 30 years.

But the identity of the new millionaire remains a mystery.

Many customers of Nordahl Liquor trickled in on New Year’s Eve evening, hoping lady luck would strike at the store again.

Liquor store owner Steve Kaspolis said he received news of the winning ticket on Wednesday evening.

For selling the winning ticket, Kaspolis will pocket $35,000 -- just in time, has he and his wife are expecting a new baby.

He said he'll likely spend the money on the new baby, a little for himself and also donate some to his church.

And a gift for his wife?

"We'll see. Keep it a surprise," he said.

The winner of the $7 million ticket has 180 days to claim the money.

A gunman killed at least two people and injured seven others outside a cafe-bar in downtown Tel Aviv, officials said. Local authorities are hunting for the killer, NBC News reported.

The shooter opened fire on a group of people outside a cafe-bar, Israeli police spokeswoman Luba Samri said in a statement.

Police spokesman Micky Rosenfeld said officials were investigating whether the incident was terror-related.

"I hid in a shed near the place of the shooting," a witness, who gave his name as Osnat, told Israel's Army Radio. "I heard load noise of shooting, we were ready that any second the shooter [would] enter where we hid. I'm still shaking."

Fire Burns Palm Trees, Spreads to Business

A fire ripped through five large palm trees in Vista overnight before spreading to a nearby auto repair business, officials confirmed, in an incident that may have involved New Year’s Eve fireworks.

Deputy Fire Chief Ned Vander Pol with the Vista Fire Department said crews rushed to the blaze that sparked in palm trees in the 100 block of Terracina Way around 1 a.m. Friday.

When firefighters got there, they found five 40-foot palm trees engulfed in flames. The fire had also spread to a nearby business, the Olympic Auto body shop at 119 Terracina Way, Vander Pol said.

Working together, crews from the Vista, San Marcos and Oceanside fire departments were able to quickly knock down the fire in the palm trees and at the body shop.

The cause of the blaze is under investigation. Vander Pol says witnesses told officials they saw fireworks going off in the area shortly before the fire sparked.

The fire caused at least $15,000 in damage. No injuries were reported.

Man Reports Killing Wife on New Year’s Day

A man in east San Diego called authorities in the early hours of New Year’s Day to report he had shot and killed his wife in their family home in unincorporated El Cajon, officials confirmed.

At around 12:35 a.m., the San Diego County Sheriff’s Department (SDSO) Lakeside Substation received a call from Hauati "Howard" Fa'anunu, 41, claiming he had shot his wife at their home in the 8200 block of Melrose Lane.

Deputies were dispatched to the house. When they arrived, they discovered Faanunu’s wife, unresponsive, suffering from trauma to her upper body. Her husband, however, was nowhere to be found.

About a half-hour later, Faanunu turned himself in at the El Cajon Police Department. Deputies from the sheriff’s department were called to the police station to take the homicide suspect into custody. Faanunu was booked into jail on suspicion of murder.

Homicide investigators roped off the couple’s home and collected evidence overnight. Officials said Faanunu was being interviewed and was cooperating with the investigation.

Lt. Kenneth Nelson said investigators suspect six children – ages two to 13 – were inside the home at the time of the shooting, but it is unknown if any of the children actually witnessed the crime. The children were unharmed, Nelson confirmed.

The children were dropped off with family members after the incident, officials said. Shortly after investigators left, family members returned for the children's belongings.

"We heard some shots in the night, but New Year's around here, people shoot their guns, so we didn't think anything of it," said neighbor John Pool.

Other neighbors told NBC 7 the couple had marital problems and were separated, living apart for a time.

The family was active in an East County Mormon church, neighbors said, and Howard worked for a local water district.

"The kids, they were very nice kids, six of them," said Pool. "So I feel sorry for the kids. They'll probably end up at their granddad's."

Lt. Nelson said officials do sometimes see an increase in violent and deadly domestic violence cases this time of year.

“It is an absolute tragedy and, unfortunately, when the holidays come around, emotions tend to run a little high, tempers seem to run a little bit short. It’s not uncommon to see a small uptick in violent issues – especially among family members – this time of year, unfortunately,” he told NBC 7.

The case is under investigation. Anyone with information should contact the SDSO Homicide Detail at (858) 974-2321 or Crime Stoppers at (888) 580-8477.

The San Diego County Medical Examiner’s (ME) office will conduct an autopsy on the victim and determine her cause and manner of death. Her name will be released once her family is notified.

Obviously, Memorial Day is not exclusive to San Diego, but it’s certainly worth jotting down the date in your planner. The unofficial start to the summer lands on May 30 this year, and thousands will flock to our sandy beaches to celebrate. Of course, thanks to the generous sunshine, beach days are appropriate pretty much year-round in America’s Finest City, too.

San Diego County Fair
June 3 through July 4
Attracting more than 1.5 million visitors each year, the San Diego County Fair is the largest annual local event and one of the largest 10 fairs in the United States. For the 2016 season, the fairgrounds in Del Mar will officially open to the public at 4 p.m. on June 3, and will run through July 4. As usual, the San Diego County Fair will be closed Mondays (except for the 4th of July), and the first two Tuesdays of the season. This year’s theme is “Mad About the Fair,” a tribute to Lewis Carroll’s classic tale, “Alice in Wonderland,” which promises to turn the fairgrounds into a large-scale, Mad Hatter-style tea party “fused with influences from steampunk, cosplay, great literature, whacky machinery and all of the fun and magic you have come to expect.” Of course, indulgent, fried fair food will also play a role at the event. Come hungry.

Del Mar Opening Day & Opening Day Hats Contest
July 15
On your mark, get set, go! The 2016 Del Mar horse racing season begins July 15 with all of the glitz, glamour and hats (oh, so many hats) of the famous Opening Day celebration. Over-the-Line (OTL) Tournament
July
A San Diego summertime tradition, Over-the-Line (OTC) is hosted each July by the Old Mission Bay Athletic Club (OMBAC) in Fiesta Island. The annual tournament typically gathers about 1,200 teams from around the world to play Over-the-Line, a bat and ball sport first played in Mission Beach in the 1950s. The rules are simple: games last three innings, no one had to run bases and the main goal is to hit the ball “over the line” about 55 feet in front of the batter. Teams dress up in wacky costumes and bring tents, chairs, beer and hilarious signs to the beach for the carefree, daytime tournament.

San Diego Comic-Con International

Mangled Car 'Torn in Half' in Deadly Wreck: CHP

0
0

A car that plowed into a tree off Interstate 5 in the San Diego area was so badly wrecked that it was essentially torn in two, killing the Navy service member inside, California Highway Patrol (CHP) officials said Friday morning.

“Upon arrival, it was actually unrecognizable as a car,” said CHP Sgt. Brant Lowry at the scene of the deadly crash off northbound I-5, in Chula Vista south of J Street, on New Year’s Day. “We figured out it’s a Ford, two-door. It was pretty much torn in half.”

The crash was reported just before 7 a.m., but Sgt. Lowry said there are no witnesses.

When officers arrived, they discovered the mangled vehicle -- a Ford Escort ZX2 -- had drifted off the freeway and slammed into a tree. Inside, the driver was dead.

The victim was identified by the San Diego County Medical Examiner’s (ME) office as a black, 21-year-old man who was active duty with the U.S. Navy. He was seated in the car, still wearing his seat belt, and there was no evidence that the man tried to hit his brakes, CHP officials said.

Sgt. Lowry said the crash may have happened overnight, in the earlier hours of New Year’s Day. He said the car was “cold to the touch,” indicating the crashed car had been there a while before someone spotted the wreck and reported it to authorities.

The name of the driver has not yet been released. An autopsy and toxicology report will be conducted by the ME's office.

The deadly crash is under investigation and anyone with information should contact the CHP office at (619) 220-5492. It is unknown, at this point, if alcohol contributed to the collision.

Knife-Wielding Man Sexually Assaults Woman in Car

A man wielding a large knife allegedly forced a woman into a car in Clairemont overnight and sexually assaulted her, police said.

The San Diego Police Department (SDPD) confirmed the violent attack was reported around 3:30 a.m. on New Year’s Day at Shawline Street and Clairemont Mesa Boulevard. The suspect threatened the victim with a 7-inch knife and forced her to get into a car. She was then sexually assaulted, sex crimes detectives said.

According to investigators, the suspect was driving a maroon pickup truck, but no further description was immediately released.

The suspect may have been a repeat offender, out of jail after a similar, prior offense, officials said.

"That's even more scary, having a knife or weapon to scare people, to sexually harass them," said Mana Khagavi, a resident of the area. "It's a nightmare for so many ladies here."

Another resident, Michelle Johnston, told NBC 7 their neighborhood is normally a safe one, where they watch out for each other.

"I do hope they catch him and bring him to task, bring him to justice," said Johnston.

The victim was later released and was interviewed by police. The suspect remains at large.

Skywriters Scold 'Disgusting' Donald Trump Over LA

0

A message denouncing Republican billionaire Donald Trump floated high above the Rose Parade in Southern California Friday, calling the presidential candidate "disgusting."

The skywriting scrawled over the annual New Year's Day parade in Pasadena read: "America is great, Trump is disgusting."

Running with the slogan "Make America great again," Trump remains the frontrunner among Republicans vying to be elected president this November. He's retained a lead in the national polls for months, despite being denounced by many for remarks perceived as sexist and racist, including suggesting that Muslims shouldn't be allowed in the country.

Trump hasn't directly responded to the writing, but he did retweet a supporter's response to a report about the skywriting.

"They're spending millions but you're still going to win go Donald Trump," said user @sprinklermanus in reply to a CNN tweet. The user also tweeted Friday that "homosexuality is a sin" and disparaged another Twitter user as a whore.

The Rose Parade winds its way through Pasadena every year on New Year's Day, showcasing large, colorful floats and big marching bands. It precedes the Rose Bowl college football game, where Standford was taking on Iowa Friday.

The game drew more political attention earlier in the day, when candidate Carly Fiorina tweeted she was rooting for Iowa despite having graduated from Stanford.

'Affluenza' Teen and Mom Had Gun With Them: Report

Ethan Couch, also known as the "affluenza" teen, hid out in a Mexican resort with his mother before he was caught earlier this week, and two staff members at a Puerto Vallarta hotel told Reuters that the two had a gun with them.

Couch and his mother Tonya were caught Monday in Puerto Vallarta. The 18-year-old had violated his probation and a manhunt for him ensued. Couch was on 10 years probation after successfully invoking an "affluenza" defense while on trial for a 2013 drunken-driving crash that killed four people.

The gun was left in a drawer at the Los Tules hotel after changing rooms during their Dec. 20 to 25 stay, the hotel staffers told Reuters. However, NBC News has not independently confirmed a gun was found. The Tarrant County, Texas, District Attorney's office told NBC News it is investigating.

Couch remains in Mexico City in custody while his mother was deported and is in Los Angeles.
